Note All Work And Earnings

NY to Launch New Unemployment Site | NBC New York

When you claim your benefits, you will have to report any work you have done in the weeks being claimed as well as the gross earnings . Even if you have not received payment from the employer yet, the earnings must still be reported over the time worked. Failure to report work and earnings is a crime and can carry severe penalties.

Claimant And Employer Contact Information

The Division of Unemployment Insuranceâs website and call centers are currently experiencing an unprecedented volume of users due to COVID-19. This may result in longer than usual wait times. We apologize for any inconvenience and thank you for your patience during these uncertain times.

Please be assured that Maryland does not have a waiting week like many other states do. No matter when or how they file, Marylanders become eligible for benefits starting the day after they separated from employment. Your payment will be backdated to the date you became unemployed, not when your claim was processed. If you are determined to be eligible, you will be paid for all benefits due.

Appeal A Denial Of Benefits

If you were denied unemployment benefits, you may file an appeal online. The Florida Department of Economic Opportunity refers to those seeking benefits as Claimants. Claimants, employers, and authorized representatives may appeal a decision that was not made in their favor.

You must wait until after a determination is mailed or delivered to file an appeal. The determination will also contain instructions on how to file your appeal after a denial of benefits.

Warning: If You Are Offered Your Old Job Back

Some people may be tempted to stay on unemployment instead of returning to workâat least through the period where FPUC provides that extra payment per week, in addition to each state’s regular unemployment payment. Be wary of following that approach.

Businesses who receive loan forgiveness under the Paycheck Protection Program have been pushing for an answer to whether they would lose loan forgiveness if laid-off employees refuse to return when offered their old jobs back . The Treasury Department issued an FAQ saying this would not happen if they make a good-faith, written offer to rehire a laid-off employee and have documented evidence of being turned down by the employee. An “interim final rule” on this issue is coming.

But here’s what that FAQ also said: “Employees and employers should be aware that employees who reject offers of re-employment may forfeit eligibility for continued unemployment compensation.” In other words: Refuse to go back and you could lose your unemployment insurance.

What Is An Offer Of Suitable Employment And How Is It Connected To Unemployment Insurance Eligibility

Most state unemployment insurance laws include language defining suitable employment. Typically, suitable employment is connected to the previous jobs wage level, type of work, and the claimants skills.

Refusing an offer of suitable employment without good cause will often disqualify individuals from continued eligibility for unemployment compensation.

For example, if an individuals former employer calls the individual back to work after having temporarily laid the individual off for reasons related to COVID-19, the individual would very likely have to accept the offer to return to work, or jeopardize his or her eligibility for unemployment insurance benefits, absent some extenuating circumstance, such as if the individual tested positive for COVID-19. The job an individual held before the spread of COVID-19 will constitute, in the vast majority of cases, suitable employment for purposes of unemployment insurance eligibility.
