The Consolidated Omnibus Budget Reconciliation Act, commonly known as COBRA, is a federally mandated program through which you can retain your employer’s policy for up to 18 months. If you do elect COBRA coverage, be prepared to pay significantly higher monthly premiums; youll be required to cover the amount your employer was contributing plus a 2% administration fee. Oftentimes COBRA isnt worth it, as most unemployed individuals can find a much more affordable policy on the marketplace.

Advantages of COBRA

The good thing about COBRA is that it makes it mandatory under federal law for an employer to allow employees to pay to stay on their health care 18 months after theyve left their job. This can also stretch to 36 months if you qualify.

Disadvantages of COBRA

The not-so-great thing about COBRA is that it does mean youll pay the full cost of the health insurance premium yourself. Youll pay more than what you saw coming out of your paycheck when you were employed because your employer was subsidizing a percentage of that health care premium.

What Happens If I Decline My Health Insurance Through My Employer

If you decline individual health insurance through your employer, you can enroll in an Obamacare plan through the Marketplace. Although you most likely will not qualify for any subsidies or other financial assistance. You will only be able to qualify for cost savings if the following applies:

1. Your employer-sponsored health plan doesnt meet the minimum value standard.

If your employer-provided plan does not include substantial coverage , it doesnt meet the standards. And if it doesnt pay for at least 60% of covered medical costs, it wont either.

2. The cheapest plan through your employer costs more than a certain percentage of your household income.

And again, that plan must meet the minimum value standard. This number is 9.83% ; and each year the IRS issues an update on this percentage. This calculation is made using your portion of the monthly premium that covers you, the employee. This does not include premiums for others in your family.;

Most job-based health insurance plans are deemed to be affordable and found to meet the minimum value standard.;But if your employer-sponsored plan isnt, you may qualify for a Marketplace subsidy depending on your income level.

Subsidies And Lawful Immigrants Ineligble For Medicaid

According to the IRS, Certain aliens with household income below 100% of the federal poverty line are not eligible for Medicaid because of their immigration status. You may qualify for the PTC if your household income is less than 100% of the federal poverty line if you meet all of the following requirements:

  • You or an individual in your tax family enrolled in a qualified health plan through a Marketplace.
  • The enrolled individual is lawfully present in the United States and is not eligible for Medicaid because of immigration status.
  • You otherwise qualify as an applicable taxpayer .

What If I Dont Know What My Income Will Be Next Year

When you apply for the premium tax credit, you will be asked to estimate your expected income for the upcoming year. Often a good place to start is to consider what your income is this year, or what income you reported on your tax return last year. However, if your circumstances have changed since then, for example, if you recently lost your job, you should make your best estimate of what your income will be next year.

As you estimate income for this year, be sure to take into account unemployment benefits you will receive in the year.; During the COVID-19 crisis, some working people who did not used to be eligible for unemployment benefits can now receive them.; Contact your state Unemployment Office for more information.;;; In addition, during the COVID-19 crisis, unemployment benefits were temporarily increased by $600 per week through July; smaller supplements continued in some states after July.; When you apply for premium tax credits, be sure to include information about the unemployment benefits you expect to collect in 2020.

    When you fill out a Marketplace application, youll find out if you qualify for any of these types of coverage:

    • A Marketplace insurance plan. You may qualify for premium tax credits and savings on deductibles, copayments, and other out-of-pocket costs based on your household size and income.     What Youll Pay Each Month

    The unemployment-based subsidies will cover the full cost of the benchmark plan. So youll have access to two Silver plans that have no premium, and youll likely have access to a variety of Bronze plans and possibly some Gold plans that have no premium.

    If you pick a plan thats more expensive than the benchmark plan, including the higher-cost Silver plans, youll pay at least some premium each month.

    If youre in a state that has additional state-mandated benefits that arent covered by premium subsidies, you may find that you have to pay at least a dollar or two each month in premiums, regardless of which plan you select.

    Who Is Eligible For Unemployment

    The unemployment-based subsidies are available to anyone who has received or been approved to receive unemployment compensation at any time this year.

    Eligibility for the unemployment-based subsidies includes people whose income is under the federal poverty level, as long as theyre not eligible for Medicaid. People with income under the poverty level are normally not eligible for subsidies, which means theres a coverage gap in the states that have refused to accept federal funding to expand Medicaid. But a person who would otherwise be in the coverage gap can receive a full premium subsidy and full cost-sharing reductions in 2021, if they receive unemployment compensation at any time during the year.

    CMS has confirmed that the full premium subsidies are only available if its a taxpayer who is receiving the unemployment compensation. If its a dependent who is receiving it, the household is eligible for the cost-sharing reductions , but not the full premium subsidies.

    Even if you only received unemployment compensation for one week of 2021, youre potentially eligible for the enhanced subsidies for the entire year. But subsidy eligibility would end if and when you become eligible for employer-sponsored health coverage , or premium-free Medicare Part A.

    The ARP has not fixed the family glitch, so family members would also lose access to any subsidies in the exchange if they become eligible for employer-sponsored coverage thats considered affordable for the employee.
