How To File A Partial Claim

If you lost work and you are working part time 30 hours or fewer a week and making $504 or less per week, the following guidelines apply when reporting your part-time work , effective August 16, 2021 and forward:

  • 10 or fewer hours of work = 0 days worked: No reduction in weekly benefit rate
  • 11 16 hours of work = 1 day worked: 75% of weekly benefit rate

Each state determines its own eligibility requirements for partial unemployment benefits. But, no matter which state they live in, all claimants have to satisfy certain basic criteria. They must be able and willing to work full time if they can. They must also report all hours they have worked in the course of part-time employment plus their gross earnings. They must also work a certain minimum number of hours and earn at least a certain amount. These limits vary by state.

Prospective claimants need to check with their stateâs unemployment office website for a complete list of necessary requirements. Some states require claimants to report how many jobs they applied for each week, while others have less stringent requirements. Itâs important to understand that collecting unemployment benefits is not simply a matter of sending in a notification and then expecting to get a check every week.

Here are a few examples of how unemployment benefits are calculated in different states. New Yorkâs unemployment agency determines weekly benefits for part-time workers by looking at the number of hours a claimant works each week.

State law determines eligibility for unemployment benefits, including partial unemployment benefits. Generally speaking, however, an employee will be eligible for benefits if all of the following are true:

  • You are underemployed, meaning that you are working part time through no fault of your own. For example, if your company cut the hours of everyone in your department in order to avoid layoffs, you would likely meet this eligibility requirement. You may also be eligible if you lost your full-time job and have only been able to find occasional or limited part-time work. Depending on your stateâs rules, you may be eligible for partial benefits if you had two part-time jobs and lost one of them.   • You meet your stateâs minimum earnings or minimum hours worked requirements. These are the same whether you apply for regular or partial unemployment benefits.
  • You are able and available to work more. In other words, if your hours are cut to ten per week, you wonât be eligible if you decide to go back to school full time and wouldnât be able to work more hours.

Filing An Initial Claim

To file an initial claim, you must complete an Application for Unemployment Insurance Benefits via Easy Arkansas Claims . The online application is available from 6 a.m. to 6 p.m., Monday through Friday.

You have one year to file the request from the date shown on the Monetary Determination.

Working While Receiving Unemployment Benefits

If you work during weeks in which you request Unemployment Insurance benefits, you may still be paid benefits if your gross wages are less than your weekly benefit amount. Any earnings greater than 1/3 of your weekly benefit amount will be deducted dollar-for-dollar from your weekly benefit payment.

You must report any changes in your unemployment status while you are receiving benefits. It is your responsibility to report all your earnings when requesting weekly benefits.

Please note that if you work full-time hours in any given week, you will be considered employed “full-time” regardless of wages, and you will not be eligible for benefits for that week. Claimants who report wages from new employment will have their regular UI weekly benefit proportionately reduced to offset new wages, and in many circumstances claimants will remain eligible for the $300 weekly stipend until their regular wages exceed 133 percent of their regular weekly benefit amount .
