NC makes cuts to unemployment benefits

Sign into your online account at des.nc.gov and click on the Apply for Pandemic Emergency Unemployment Compensation link to apply. Federal guidelines require you to file a separate claim for PEUC to receive these benefits. You will not automatically receive PEUC when you exhaust regular state unemployment insurance benefits.

If you are not eligible for PEUC, you will not see the Apply for Pandemic Emergency Unemployment Compensation link in your online account.

Is There A Supplemental Payment

The $600 weekly supplement was in effect for weeks ending April 4 through July 25. This program was reinstated at a lower $300 weekly rate beginning December 27, 2020, and has been extended until September 6, 2021.

Additionally, two prior programs provided a supplemental payment for eligible claimants.

The Lost Wages Assistance program will provide an additional $300 per week for the weeks ending August 1 through September 5, 2020. To be eligible for the additional LWA supplement, you must:

  • Be receiving at least $100 per week in unemployment benefits from any other state or federal source and
  • You may need to self-certify that you are unemployed due to a COVID-related reason these reasons are listed under the PUA benefits description above. If you need to self-certify, you will see a link on the Customer Menu page in your online account to File Lost Wages Assistance Certification. If you do not see this link, you do not need to complete this certification.
  • The Increased Benefit Amount program will add $50 per week for eligible claimants, for the weeks ending September 6 through December 26, 2020, or whenever funds are exhausted, whichever is earlier. Eligibility depends on whether you are receiving state or federal benefits, and when you initially filed for benefits. You do not need to file a separate claim for IBA benefits, and payments should begin around October 30, 2020. Please see the DES website for further information on eligibility: IBA Eligibility

    Whats The Unemployment Situation In Nc

    As of last week, about 240,000 people were getting unemployment benefits in North Carolina, the Associated Press reports. But itâs not clear how many of those were getting extra money each week through the federal program.

    Without the $300 a week bump from federal coronavirus relief funding, the average unemployment benefit in North Carolina is about $235 a week.

    Another big change to unemployment started Monday, requiring anyone who is getting benefits to look for a job. The governor had suspended the job search requirement during the pandemic.

    âUnemployment benefits have provided a critical lifeline for many North Carolinians living on the edge due to the pandemic,â the governor said when he signed the order in May.

    âReinstating the work search guidelines will help connect claimants with employers, resources and tools to help them return to the workforce,â Cooper said in a statement.

    Web And/or Phone Issues With Accessing The North Carolina Unemployment System

    Over 2.2 million unemployment benefit claims have been filed since March 15. As a result, the DES has experienced an unprecedented call volume and delays in online claim processing due to required updates for federal programs. Although the DES has hired additional personnel, they strongly encourage new claimants to apply online. Effective August 24, weekly claims must be filed online.

    Existing Claimants: Claimants receiving unemployment benefits due to the coronavirus pandemic must continue to certify every week to receive the additional FPUC $600/week benefit. The extra $600/week compensation is retroactive to the week beginning on March 29 and ends on July 31. FPUC payments are automatically added to the weekly benefit payment. The DES started making payments under this program on April 15.

    Upon exhausting regular unemployment benefits, you must file a separate application to receive PEUC benefits. Once youve signed in to your account online, you will see a link to Apply for Pandemic Unemployment Compensation. If you are not eligible for PEUC, you will not see this link on your account.

    Claimants that have exhausted both regular unemployment and PEUC benefits may be eligible for an additional 9.6 weeks of unemployment benefits. If eligible, claimants will see a link to Apply for Extended Benefits on their account.

    You should respond to all requests for information regarding a claim from DES. Neither claimants nor employers get to choose which employer is charged for a claim.     DES has detected a recent increase in suspected imposter fraud in the unemployment benefits system. Fraud safeguards put in place by DES flagged suspicious claims to prevent payments from being released.

    Imposter fraud occurs when a persons stolen identifying information is used to file a fraudulent unemployment claim. The stolen personal information is often obtained through outside data breaches, phishing scams and schemes that were part of larger criminal efforts unrelated to unemployment. DES has not experienced a data breach.

    If you receive communications relating to an unemployment claim and you did not apply for benefits, you or your employer should report the suspected fraud to DES.

    What Are The Accepted Covid

  • You have been diagnosed with COVID-19 or are experiencing symptoms of COVID-19 and are seeking medical diagnosis member of your household has been diagnosed with COVID-19
  • You are providing care for a family member or a member of your household who has COVID-19
  • A child or other person in the household for whom you are responsible for is unable to attend school or another facility that is closed as a direct result of the COVID-19 and this makes you unable to work

The eligibility rules, prior earnings requirements, benefit amounts, and other details vary from state to state. Here are the basic rules for collecting unemployment compensation in North Carolina.

    Am I Eligible For Benefits During A Leave Of Absence From My Job

    Generally, you are not eligible for benefits during a leave of absence from your job. In order to be eligible for benefits, you must be unemployed through no fault of your own, be actively seeking work, and be able and available to accept work if it is offered to you. In limited circumstances, an exception may apply to the general rule. DES will make a determination in each case.

    If I Live In North Carolina How Do I File An Interstate Claim

    If you live in North Carolina, but do not have wages in North Carolina, you can file an interstate claim in the state where you have wages. You must contact the agency responsible for UI claims in that state and follow its instructions for filing your claim.

    If you are a base period employer and your account is potentially liable for a portion of the charges resulting from a claim for UI benefits, you will be mailed a Notice of Initial Claim and Potential Charges To Your Account . You must provide a timely and complete response to this notice so that the reason for separation can be reviewed. Your response will be used to determine an appropriate action regarding liability, if any, on your account.

    How Are Weekly Benefits Determined In North Carolina

    When you file a claim, DES will send you a Wage Transcript and Monetary Determination letter. This shows all employers you worked for and what your wages were for your base period. This does not guarantee you will be paid North Carolina unemployment benefits but outlines how much you could be paid and for how many weeks if you meet all North Carolina unemployment requirements.

    How much you will be paid is determined by the amount of wages earned in your Base Period. As part of your initial North Carolina unemployment application process, you will need to determine what your total gross wages were during your Base Period, as well as how much you received during each calendar quarter. Your Period is the first four of the past five completed calendar quarters prior to the date you applied for benefits.

    To qualify for benefits, you must have qualifying wages which are defined as six times the average insured weekly wages in at least two quarters of either the Base Period or an alternate Base Period. To file North Carolina unemployment, you must have at least $780 in wage in one of the last two quarters to establish a Weekly Benefit Amount.

    The Weekly Benefit Amount is calculated by adding the wages paid to you in the last two completed quarters of your Base Period and dividing that number by 52.

    If that amount is less than $15, you are not eligible for benefits. The maximum North Carolina amount also known as a Weekly Benefit Amount you can receive is $350.

    Base Period: Calendar Quarters

    Enter your total wage earnings for each of the four calendar quarters listed, which are the first four of the most recent five completed calendar quarters. You must have wages in at least two quarters, and must also have earned at least $790 in at least one of the most recent quarters of the based period in order to qualify for benefits.

    If you do not qualify under the standard base period, you may be able to use the most recent four completed quarters as an alternate base period.

    What Happens After September 4 2021

    • The week ending September 4, 2021, is the last week of unemployment for which you can receive federal benefits. You may file your weekly certification for that week on or after September 5, 20201, and if eligible, you will receive payment for your last week of federal benefits.
    • State unemployment insurance benefits will continue to be available after September 4, 2021. Under state law, state unemployment benefits currently provide eligible claimants with up to 13 weeks of benefits in a one-year period, with a maximum benefit of $350 a week.

    What If I Am Out Of Work Due To A Strike

    You are disqualified from receiving unemployment benefits during an active labor dispute. You are not qualified for unemployment benefits when your partial or total unemployment is due to:

  • an active labor dispute at the factory, plant, etc. where you work or last worked or
  • an active labor dispute at another factory, plant, etc., owned by the same employing unit, which causes the materials or services necessary for operation of your factory, plant, etc. to become unavailable.

    NC Works Career Centers are reopening, but some are only open in limited capacities. The way to determine what services are available at a specific center is to check the NC Works page and determine how to get help. Some centers, like the Alamance Center, are open to the public, but limited staff and a limited number of customers are allowed inside at a time. Other centers, like the Alexander Center, offer virtual services only. The Mecklenburg/Charlotte Center, offers services virtually and by appointment.

    What If My Claim Is Rejected

    If your claim is denied or the DES determines youre no longer eligible, youll receive a written notice that includes an address and instructions for appealing. But the fastest way to file an appeal is online through the DES online benefits system. Once youve filed your appeal, the DES will send a notice with the date, time and contact information for your scheduled hearing.

    Increase In Identification And Security Measures

    DES has partnered with ID.me to verify the identity of unemployment claimants. A claimant will receive an email from DES with a notification that they must verify their identity through ID.me to be eligible for benefits. A claimant should click on the link in the email to start the verification process.

    When a claimant signs into their DES account, they will be asked to verify their identity using Multi-Factor Authentication. DES will send a passcode to their email address. The user must enter that passcode and their regular password to access their account.

    Federal Pandemic Unemployment Compensation

    Call for Fixes to NC Unemployment Insurance Benefits

    Federal Pandemic Unemployment Compensation is a supplemental benefit that is paid on top of an individuals weekly benefit amount for state unemployment insurance benefits, Pandemic Emergency Unemployment Compensation, Extended Benefits or Pandemic Unemployment Assistance.

    The American Rescue Plan Act, signed into law by the President on March 11, 2021, extends the FPUC program through September 2021.

    FPUC provides a $300 per week benefit from Dec. 27, 2020 Sept. 4, 2021.

    FPUC provided a $600 per week benefit from March 29 July 25, 2020.

    Note: If you do not receive at least $1 in benefits for a week because you earned excessive wages, you will not be eligible to receive FPUC for that week.

    Acceptable Job Search Activities

    Reemployment activities that count as work search contacts include: taking skill set courses provided by NC Works Career Centers and/or partner agencies industry or occupation-specific training soft skills training like a social etiquette class and taking a workshop on a subject like resume preparation or interviewing. Attending English as a Second Language classes and using online career tools, such as Indeed, provided by NC Works Career Centers, also count for work search contacts.

    An applicant should keep a detailed record of their work search activities every week. North Carolina does not have a work share program, in which employers retain employees, but reduce the hours of a group of employees.

    Will I Have To Pay Taxes On My Unemployment Benefits

    Unemployment insurance is taxable income and must be reported on your IRS federal income tax return. This includes the federally funded enhanced extended benefits provided in 2020 and 2021. Your local state unemployment agency will send you form 1099-G to file with your tax return . This form is sent in late January and outlines the amount of benefits paid to you during the previous year. You can choose to withhold income tax during the year with 10 percent being the maximum generally allowed.
