What Are Unemployment Benefits

Unemployment benefits provide you with temporary income when you lose your job through no fault of your own. The money partly replaces your lost earnings and helps you pay expenses while looking for new work. The benefits, from taxes your former employer paid, are not based on financial need. While you receive benefits, your job is to get back to work as quickly as possible.

  • Don J. Usner/Searchlight New Mexico

Last March, Teresa Espindola, a 46-year-old painter in Tijeras, was having problems getting unemployment payments. She was locked out of New Mexicos online system and couldnt get anyone on the phone. After months of fruitless calls, she emailed a state employee named Bill.

I didnt know who he was, Espindola said. All she knew was that he worked for the department she was having trouble with.

In fact, her correspondent was Bill McCamley, the Cabinet secretary of the Department of Workforce Solutions, the agency that administers unemployment benefits. As the department floundered under a wave of out-of-work New Mexicans, he started helping people resolve issues himself. Soon after his email exchange with Espindola, another employee fixed her problem caused by a typo in the computer system.

McCamleys intervention demonstrates just how much the pandemic has strained the states unemployment system. Scores have applied for unemployment benefits but didnt see the cash for weeks or months, if ever.

    Unemployment Tax Break 2021

The Internal Revenue Service allows taxpayers to waive up to $10,200 earned through unemployment compensation. Most taxpayers can benefit from this tax break. The income limit for this tax break is $150,000 which applies to all taxpayers regardless of their filing status. Whether you file taxes as single, married filing jointly, or head of household, your income must be less than $150,000. If you make a single dollar above this limit, you wont get this tax break.

Here is how to claim the unemployment tax waiver.

Fill out Schedule 1 like you normally would and report the unemployment compensation earned during 2020. You can then use the Unemployment Compensation Exclusion Worksheet to figure out the amount youre eligible to waive from taxable income. This will enable you to waive the majority of your unemployment compensation.

Although most taxpayers are eligible for the unemployment tax waiver, you might have already filed taxes as the news on this came out a bit late with the American Rescue Plan. If youve already filed taxes, you need to amend your 2020 tax return. This will enable you to waive off the unemployment compensation and you wont pay taxes on up to $10,200 received in unemployment. This tax waiver will enable you to keep up to the designated amount if your AGI is less than $150,000.

Are You Out Of Work Through No Fault Of Your Own

More unemployment benefits available for some New Mexicans

One of the most disputed issues between employers and employees is whether the employee is out of work through no fault of his or her own. Like most other states, New Mexico treats layoffs, terminations, and voluntary resignations differently.

    Collecting Unemployment After a Layoff

The simplest scenario is where the employee was laid off due to lack of work or other business reasons that have nothing to do with the employee’s quality of work. If your company was downsizing and laid you off, you will still be eligible for unemployment benefits.

    Collecting Unemployment After Being Fired

Being terminated is not an absolute bar to recovering unemployment. If you were fired because you simply lacked the skills for the job or weren’t a good fit personality-wise, you won’t be barred from receiving benefits. In general, you will be disqualified only if you were fired for misconduct. In New Mexico, misconduct is behavior that shows a willful disregard for the employer’s interests. For example, intentional violations of company rules, acts of insubordination, multiple unexcused absences, or showing up to work under the influence of drugs or alcohol may qualify as misconduct.
