Basic Requirements That Must Be Met

SUB plans are registered by Service Canada through the SUB program in Bathurst, New Brunswick. Plans must be registered before their effective date.   • requires it be entirely financed by the employer
  • requires that on termination, all remaining assets of the plan will be reverted to the employer or be used for payments under the plan or for its administrative costs
  • requires that written notice of any change to the plan be given to Service Canada within 30 days after the effective date of the change
  • provides that the employees have no vested right to payments under the plan except during a period of unemployment specified in the plan

    Note All Work And Earnings

    When you claim your benefits, you will have to report any work you have done in the weeks being claimed as well as the gross earnings . Even if you have not received payment from the employer yet, the earnings must still be reported over the time worked. Failure to report work and earnings is a crime and can carry severe penalties.

    Work And Earnings Reporting

    The unemployment claim week begins on Sunday and ends on Saturday at midnight. The first question asked on your weekly certification is, âDid you work or attend paid training?â If you performed any type of work during the week of certification, you must answer âyesâ to that question.

    You must report all your work and gross earnings for the week in which you worked, even if you have not been paid. If you have questions about how to report your earnings, call the Claims Center.

    You must report:

    • Volunteer work
    • Cash value of work performed in exchange for anything of value

    If you work less than full-time and earn less than your weekly benefit amount during a given week, you may continue filing since you will be entitled to partial unemployment benefits if you are otherwise eligible. Workforce Services will apply a 30 percent earnings allowance to calculate your weekly benefit payment. For example, if your weekly benefit amount is normally $300.00, you could earn $90.00 without affecting payment for that week, however you must still report those earnings.

    If your earnings equal or exceed your weekly benefit amount or you work 40 or more hours during the week, you will not receive any payment or waiting week credit for that week. You must accept all suitable work offered to you or report to the department you failed to accept such work.

    What You Need To Know

    • Update 12/29/20: The federal government has extended the federal unemployment benefit programs available through the CARES Act for an additional 11 weeks. Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation will be available through March 14, 2021, with qualified claimants benefits fully phasing out by April 5, 2021. Federal Pandemic Unemployment Compensation benefits will resume with $300 weekly payments until March 14, 2021.

    You must be physically and mentally able to work full-time. If you are ill, injured, on a leave of absence or unable to work for any other reason, you may not be eligible for benefits for that period of time.

    You are required to report that you are not available for work when any condition exists that could prevent you from working, accepting work or seeking full-time work. This includes, but is not limited to:

    • In Country Travel
    • School attendance
    • Loss of transportation

    You may be required to provide evidence of your ability to work, such as a doctorâs statement.

    You must be immediately available to accept full-time work. You cannot place unreasonable restrictions on the hours you will work, the wage you will accept, or the distance you will travel to work.

    If your employer is holding your job while you are on an approved leave of absence you will not be considered available for work.

    General Business

    General business employers are liable on:

    • The first day of the calendar quarter you pay remuneration of $300 or more, – or –
    • The day you obtain any or all of the business of a liable employer

    Non-Profit Employers

    Non-profit employers are liable:

    • On the first day of the calendar quarter you pay remuneration of $1,000 or more, – or –
    • As of the first day of the calendar year you employ four or more workers on at least one day in each of 20 different weeks during that year or the prior calendar year

    Household Employers

    Employers of household help are liable the first day of any calendar quarter you pay remuneration of $500 or more.

    Agricultural Employers

    Effective January 1, 2020, employers of agricultural labor are liable as of:

    • The first day of any calendar quarter after January 1, 2020 in which you pay remuneration of $300 or more, – or –
    • The day you obtain any or all of the business of a liable employer

    Government Employers

    Vacation Holiday Severance Or Separation Pay

    Severance pay is defined as a payment made by an employer that would not have been made except for the severance of the employment relationship. All vacation, holiday, severance or separation pay you have received or will receive must be reported to the Claims Center. These types of payments are usually considered earnings. You will not be eligible for waiting-week credit or unemployment benefits for weeks in which those payments equal or exceed your weekly benefit amount.

    Weekly Claim Filing Instructions

    You must file weekly claims to receive benefits. To file a weekly claim, you will need your Social Security Number and PIN. The unemployment claim week begins on Sunday and ends on Saturday at midnight. We encourage you to file your claim on Sunday or as soon as possible after the Saturday week-ending date. You can file your weekly claim online at jobs.utah.gov, select âSign Inâ then âmy Unemploymentâ and then choose âFile Weekly Claim.â

    You will be asked for your PIN each time you use the system. Your PIN is the four-digit number you selected when you established your claim.

    Each week you must answer questions to determine your eligibility for benefits. Failure to file a weekly claim in a timely manner could result in a denial of benefits. The system will not permit late filing. Each weekly claim should be filed as soon as possible after the Saturday week ending date. If the claim has not been closed, the Department will allow 20 days after the week ending date to file a timely claim.A weekly claim filed 21 or more calendar days after the week ending date will be denied unless good cause for late filing is established. Your claim will be reopened effective the Sunday of the week in which your claim is filed.
