What To Do If Your Claim Is Denied
After you file for unemployment, the state may accept your claim, and youll receive your benefits. But what if youre denied benefits or the state asks you to provide additional information? You can file an unemployment appeal and explain your situation in a hearing.
The state unemployment office will typically send you a letter that will list the date and time of your hearing. These hearings are generally conducted over the phone.
Check With Your State Unemployment Office
Check with your state unemployment office for information on what benefits you are entitled to. Initial benefits may be different from weekly benefits, there may be a waiting period before you receive payment, and some states have maximum payout amounts or timelines.
It’s important to do your research and contact your states unemployment agency quickly, so you have all the accurate information you need to collect the benefits youre entitled to.
You will find information on qualifying for benefits in your location on your state’s unemployment website, as well as detailed information on what you need to do to submit a claim.

Note All Work And Earnings
When you claim your benefits, you will have to report any work you have done in the weeks being claimed as well as the gross earnings . Even if you have not received payment from the employer yet, the earnings must still be reported over the time worked. Failure to report work and earnings is a crime and can carry severe penalties.
Am I Allowed To Refuse Job Offers
If a claimant refuses an offer for work, and fails to adequately explain why the position would have been unfit or undesirable, then his or her unemployment claim could be automatically denied. This can be prevented by faithfully reporting any refusals made to work, providing full explanations of why the offer could not be accepted.

Work And Earnings Reporting
The unemployment claim week begins on Sunday and ends on Saturday at midnight. The first question asked on your weekly certification is, âDid you work or attend paid training?â If you performed any type of work during the week of certification, you must answer âyesâ to that question.
You must report all your work and gross earnings for the week in which you worked, even if you have not been paid. If you have questions about how to report your earnings, call the Claims Center.
You must report:
- Volunteer work
- Cash value of work performed in exchange for anything of value
If you work less than full-time and earn less than your weekly benefit amount during a given week, you may continue filing since you will be entitled to partial unemployment benefits if you are otherwise eligible. Workforce Services will apply a 30 percent earnings allowance to calculate your weekly benefit payment. For example, if your weekly benefit amount is normally $300.00, you could earn $90.00 without affecting payment for that week, however you must still report those earnings.
If your earnings equal or exceed your weekly benefit amount or you work 40 or more hours during the week, you will not receive any payment or waiting week credit for that week. You must accept all suitable work offered to you or report to the department you failed to accept such work.

Tips For Recording Job Search Activities
An unemployment week starts Sunday at 12:00 a.m. and ends Saturday at 11:59 p.m. All four reported contacts must be made in this Sunday through Saturday time period in order to count towards your eligibility. If your claim is selected for review, we will contact the employers you reported to verify the job contacts made. To be prepared for this review, please consider the following:
- When applying through a website remember to document the website address, company offering the job , job title and the jobâs ID number. For example: XYZ business.com, Company Name , customer service rep, job #1234
- Just looking at an employerâs website is not a contact. A resume or application has to be sent to the employer through the website for the contact to be considered valid
- Applying to different positions with the same company can count as separate contacts as long as you document the different jobs being applied for. For example: Contact #1 = XYZ Company, office assistant, job #789. Contact #2 = XYZ Company, receptionist, job #9876
- Keep all email confirmations from employers during the time you file for unemployment insurance benefits
What You Need To Know
Update 12/29/20: The federal government has extended the federal unemployment benefit programs available through the CARES Act for an additional 11 weeks. Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation will be available through March 14, 2021, with qualified claimants benefits fully phasing out by April 5, 2021. Federal Pandemic Unemployment Compensation benefits will resume with $300 weekly payments until March 14, 2021.
To receive these extended federal benefits, continue to certify weekly while unemployed. To allow your fellow New Yorkers to reach NYS DOL representatives about regular matters, please do not call to inquire about the federal program extensions at this time. As we receive additional guidance on the federal programs from US DOL, we will provide updates on our website, social media platforms, and directly via emails and texts.
- Waiting weeks for unemployment benefits have been waived during this crisis. If youve seen the term waiting week on your payment history, it is a relic of our existing system and does NOT impact your benefits.
- To collect regular unemployment insurance benefits, you must be ready, willing, and able to work. We understand that many of you are unable to work due to the COVID-19 pandemic and the impact of NYS on PAUSE. If you would otherwise be able to work, you should answer âYESâ in order to receive your benefits.
Guidelines For Qualifying For Unemployment Benefits
How can you tell if you’re eligible to receive unemployment? Each state sets guidelines that determine whether an individual will be eligible for unemployment benefits, and how much compensation they will receive.
There are eligibility requirements to qualify for unemployment benefits, including having worked a certain number of weeks for a certain number of hours each week. Those guidelines also determine how many weeks of benefits an unemployed worker can collect.
You’ll find detailed information regarding eligibility criteria on your state unemployment website. In most states, you will need to have worked for a certain period of time, met minimum earnings requirements, and have lost your job through no fault of your own. If your claim is denied or contested by your employer, you can appeal the denial.
But even if youve been terminated for cause, dont assume youre out of luck. You may be able to collect, depending on the circumstances, and whether or not the termination was justified. Its worth it to learn about your rightsincluding your right to appeal a denial of your unemployment claimsbefore you give up on the idea of filing for benefits.
Check with your state unemployment department for information on qualifying for and collecting unemployment compensation in your location.
