You should file your claim for unemployment benefits in the state where you live and worked. .

If you become unemployed in one state and then move to another, you can file your claim in your new state. However, your benefits will be determined by the rules of your former state. Although your new state administers your claim, the cost of your benefits is charged back to the state in which you became unemployed. A move will also add time to processing your claim, usually increasing the delay by several weeks.

Keep in mind that, even when you relocate, you still must meet all the requirements of the unemployment insurance program to qualify for benefits. Your new location must be one to which you were required to move by family circumstances or in which it is logical for you to expect to find a new job. For example, you cannot decide to move to a small seacoast town with virtually no business activity because you like the countryside there, quit your old job for no other reason, then expect to be eligible for unemployment insurance when you get to your new home and cannot find work.

    Connecticut Increases Penalties For Misclassifying Employees As Independent Contractors

    On May 6, 2010, Connecticut enacted a law increasing the penalties to be imposed upon employers for misclassifying workers as independent contractors. The law will become effective October 1, 2010.

    Specifically, the new Connecticut law does the following:

    • increases civil penalties for businesses that misclassify employees as independent contractors from $300 per violation to $300 per dayper violation
      • makes it a Class D felony to either misrepresent the number of its employees or cast them as independent contractors in order to defraud or deceive the state so as to pay lower workers compensation insurance
      • makes it a Class D felony for any employer that is fully insured for workers compensation to fail to pay the required state assessments for administration of the Workers Compensation Commission and the Second Injury Fund and

        Connecticut Attorney General Richard Blumenthal, who co-chaired the commission recommending passage of the new law, commented that calling workers independent contractors when they are really employees costs workers benefits, taxpayers revenue and honest businesses a fair opportunity to compete for work.

        The issue as the states economy struggles to grow isnt the gap itself so much as affordability for people on the lower-income side of the divide. Pandemic relief programs have started to dry up for people scraping by, even as a new influx of affluent people have moved into the state.

        That migration, along with chaos jostling sectors such as housing, retail, commercial development and manufacturing, has highlighted three pressing questions for the Connecticut economy that may have reached a tipping point.

        What is the path to convincing employers to add good-paying jobs here, whether in traditional workplaces or in home offices?

        What will it take to bring back the roughly 100,000 Connecticut residents who were working two years ago but remain on the sidelines now?

        That cost crisis, absent a magnet city to attract young professionals, has vexed the state for decades.

        Once you have qualified for unemployment insurance benefits, you are not free to simply sit back and welcome the checks each week. You must continue to comply with the state program’s rules and rituals to keep them coming.

        You must visit the unemployment insurance office or complete specific paperwork as frequently as your state requires it. Periodically, you must verify that you remain unemployed but available for work, that you remain physically able to work, and that you are actively looking for work. The documents you sign will typically ask you to certify that you continue to meet these requirements, and it is usually a criminal offense to lie about any of your answers.

        In some states, you are also required to list a minimum number of potential employers to whom you have applied for work since the last time you signed for benefits. This requirement may vary according to economic conditions.

        The unemployment insurance program cannot require you to take a job that varies much from your normal field of work and your normal wage level. But these ranges are subject to interpretation, so exercise care in deciding where to apply for a new job.         Unlike workers’ compensation benefits, unemployment insurance benefits are taxed as income. Because the benefit amounts paid are often below the taxable annual earning level, however, many states will not take the automatic step of deducting any taxes from your unemployment benefit check.

        Department of Labor officials said additional information about American Rescue Plan provisions will be released soon and will be updated on the state Department of Labor websites federal programs webpage.

        After the new claim is filed and processed, claimants will be notified that they may begin their weekly certifications.

        Officials said the claim processing times are currently one to three days, but the surge of applications is expected to increase processing times to a week.

        Connecticut Department of Labor Commissioner Kurt Westby today announced that the agency has launched a new Consumer Contact Center tool that will help residents who need unemployment claims assistance. The new feature, accessed through the www.FileCTUI.com page, allows people to schedule a call back up to two weeks out. Additionally, the agency released early application timelines for the new federal Mixed Earner Unemployment Compensation program established under CARES Act II.

        Commissioner Westby said, Demand for unemployment assistance continues to be very high and is climbing due to the CARES Act II. In just six months, the Contact Center has fielded nearly 600,000 inquiries. The newest federal programMixed Earner Unemployment Compensationwill generate additional benefits for some claimants and additional inquiries to the Contact Center.
