I received a 1099-G but did not receive Unemployment Insurance compensation payments in 2020. What does this mean?

If you receive a 1099-G but did not receive Unemployment Insurance compensation payments in 2020, you may be the victim of identity theft. Please report your case of suspected fraud as soon as possible online or by calling our fraud hotline at 609-777-4304.

What if the amounts on my 1099-G form are not correct?

Please note: Your 1099-G reflects the total amount paid to you in 2020, regardless of the week that payment represents.

Meaning, if you were paid in 2020 for weeks of unemployment benefits from 2019, those will appear on your 1099-G for 2020. Similarly, if you were paid for 2020 weeks in 2021, those will not be on your 1099-G for 2020 they will appear on your 1099-G for 2021.

If you were overpaid benefits, your 1099-G will still reflect, per federal law, the amount of funds paid to you, regardless of any funds you have returned. Please refer to the section titled Repayments in the IRS Publication 525 Taxable and Nontaxable Income for guidance on how to report overpayments/returned funds.

Unemployment Program Extensions Under Covid Relief Bill

The $900 billion COVID-19 relief package was passed into law on Dec. 27, 2020, which among several other pandemic relief measures extends and provides additional federal funding for enhanced unemployment benefits. This includes the Pandemic Unemployment Assistance , Pandemic Emergency Unemployment Compensation and a reinstatement, but halving of the Federal Pandemic Unemployment Compensation Program which provides a $300 supplemental weekly unemployment payment. I have also posted this video discussing the frustrations around the current $300 payment!

These programs have been funded and extended for 11 weeks , covering the weeks of December 27th, 2020 to March 14th, 2021. To receive FPUC benefits, you must be receiving regular UI, PEUC, EB, or PUA.

NJ DOL 2021 11-week Extension Payment Details and Updates on $300 FPUC, PUA and PEUC

NJDOL has successfully completed programming for the 11-week benefit extension for the over 75,000 expired PUA and PEUC claims. Claimants who had been waiting and are eligible to claim these 11-weeks should have been notified by email and can certify during their regular schedule once the extended weeks are added to their claim balance. If you have not received your notification AND cannot certify in the next few days your claim is likely held up due to additional manual processing/verification or you were deemed ineligible. Some examples are further discussed in the comments below.

Information Needed For Your Federal Income Tax Return

Nj Unemployment W2 Form 2017

Each January, we mail an IRS Form 1099-G to individuals we paid unemployment benefits during the prior calendar year. The 1099-G form provides information you need to report your benefits. Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS. You can file your federal tax return without a 1099-G form, as explained below in Filing Your Return Without Your 1099-G.

A 1099-G form is a federal tax form that lists the total amount of benefits TWC paid you, including:

  • Unemployment benefits
  • Federal income tax withheld from unemployment benefits, if any
  • Alternative Trade Adjustment Assistance and Reemployment Trade Adjustment Assistance payments

Questions Pertinent To Employers/independent Contractors

Q: Lets start with the pandemic unemployment assistance program. Give us the big-picture view?

File photo

Robert Asaro-Angelo: The most important piece to note here is that this is for folks who are not part of the unemployment insurance system in the traditional sense. They were either a business owner or an independent contractor. They werent W2 wage earners, so they werent paying premiums on unemployment insurance.

The process works differently.

Q: Walk us through it.

RAA: Its counterintuitive, but the first step is that you need to be found ineligible for the traditional unemployment benefits, which means you need to go through the process of filing for unemployment and being denied. If you go through the PDF on our website, youll see a step-by-step screenshot guide with more answers to your questions about that process.

Q: Will the process be quick and easy?

RAA: Unfortunately, no. There are new sets of rules for the pandemic unemployment assistance, which arent even up yet. But, lets be very clear: We want to get the money out as soon as possible. This is 100% fully federally funded. So, it is in our best interests of the state and our unemployment trust fund, which every employer in the state and every employee pays into, to have as many people claiming pandemic unemployment assistance as possible. Its just going to take a little time to go through that process because of the way it was written.

RAA: Correct.

Do I Have To Pay Taxes On The Extra $600

The Coronavirus Aid, Relief, and Economic Security Act provided for the Federal Pandemic Unemployment Compensation program when President Trump signed it into law on March 27, 2020. It provided an additional $600 per week in unemployment compensation per recipient through July 2020. That money is also taxable after the first $10,200.

You might be paid up if you arranged to have income tax withheld from your benefits, but federal law caps withholding on benefits at 10%. That might not be enough to offset all taxes owed if you had additional income during the year.

Not all states were technologically prepared to withhold anything from that extra $600 portion. Their unemployment systems simply werent up to the task, and many initially collapsed during the first weeks of increased visits to their sites.

Youll still have to pay tax on benefits you received over $10,200 if you asked for withholding and it didnt happen.

This 10% withholding cap prevents you from having extra money withheld now to try to compensate for not having anything withheld earlier in the year. You can ask for extra withholding from your paychecks, however, if you return to work.

Is A 1099 G Form Good Or Bad

Is a 1099 G taxable income? Unemployment compensation is generally taxable income to you, so Form 1099-G gives you the amount of unemployment benefits you must report on your tax return. You may opt to have federal income tax withheld on those benefits. If you do, the amount withheld will be reported in Box 4.

How Taxes On Unemployment Benefits Work

    Unemployment W2 Forms Online Nj

Unemployment benefits are income, just like money you would have earned in a paycheck. Youll receive a Form 1099-G after the end of the year, which will report in Box 1 how much youve received in the way of benefits. The IRS will receive a copy as well.

You would have paid taxes on the full amount of your unemployment benefits if you filed your taxes before the ARPA was passed. The IRS issued a statement on March 31, 2021, urging taxpayers who had already filed not to file an amended return related to the new legislation. The IRS will recalculate and adjust all tax returns received prior to the ARPA that report unemployment income during the spring and summer of 2021 and will issue any resulting refunds.

Youll have to pay taxes on the remaining amount if you received more than $10,200 in unemployment compensation. Your 1099-G will have the information youll need to transfer to your tax return.

Unemployment compensation has its own line on Schedule 1, which accompanies your 1040 tax return. Youll transfer the amount in Box 1 of Form 1099-G to Line 7 of Schedule 1, and then the withholding amount in Box 4 of the 1099-G goes directly onto your 1040 tax return on Line 25b.

The amount that was withheld will appear in Box 4 if you asked to have income tax withheld from your benefits.

You must still report your unemployment compensation on your tax return, even if you dont receive a Form 1099-G for some reason.
