How Does Retirement Pay Affect My Benefits
Retirement pay could lessen your benefits, make you disqualified, or have no effect at all. If you are not entitled for periodic payments, it has no effect. If an employer for whom you worked during the base year of your claim either contributed to the retirement fund or maintained it, then your retirement pay is deducted dollar for dollar.

If you were fired because you lacked the skills to perform the job or simply werent a good fit, you wont necessarily be barred from receiving benefits. However, if you engaged in misconduct, you will not be eligible to receive unemployment. In Oregon, among other things, misconduct means an intentional violation of the employers rules, the failure to conform to standards which an employer can reasonably expect from an employee, or careless behavior that is so frequent or severe that it shows a disregard for the employers interests. For example, showing up to work under the influence of alcohol or drugs or having several unexcused absences after written warning would typically qualify as misconduct.

How Do I Apply
To receive unemployment insurance benefits, you need to file a claim with the unemployment insurance program in the state where you worked. Depending on the state, claims may be filed in person, by telephone, or online.
- You should contact your state’s unemployment insurance program as soon as possible after becoming unemployed.
- Generally, you should file your claim with the state where you worked. If you worked in a state other than the one where you now live or if you worked in multiple states, the state unemployment insurance agency where you now live can provide information about how to file your claim with other states.
- When you file a claim, you will be asked for certain information, such as addresses and dates of your former employment. To make sure your claim is not delayed, be sure to give complete and correct information.
- It generally takes two to three weeks after you file your claim to receive your first benefit check.

How Do You Apply For The New California Unemployment Checks
This isn’t a process where you should need to apply, as those who now qualify are people who previously applied for Pandemic Unemployment Assistance, but who were denied it.
With new criteria being added, this means some of those denied support will now receive it and the authorities already have their details. It is the Employee Development Department who will be getting in touch with those eligible to organise the payments.
You can also contact the department to ask about your specific case, even though notifications should be automatic.
In terms of the amount that these new unemployment checks will be worth, this will vary quite significantly depending on the individual circumstances of each case.

While some states have not been able to hire programmers to update their old COBOL code, that is not a problem here in Oregon, Krumenauer said. But it still takes time to write new programs and test them to make sure that they work.

What Can You Do To Ensure Youre Getting What Youre Owed
The huge influx of recent unemployment claims were partly caused by the number of people who qualify under this years unique circumstances but who wouldnt under normal circumstances.
The Coronavirus Aid, Relief, and Economic Security Act extends unemployment benefits to many who didnt previously qualify. Independent contractors, freelancers, gig workers, and the self-employed may be eligible for payments through the Pandemic Unemployment Assistance program, established by the CARES Act. Since these types of workers dont pay state unemployment insurance taxes and they dont have employers who pay into the unemployment system, they arent normally eligible for unemployment benefits.
But how you apply for PUA benefits isnt the same across the board. Different states have different procedures and rules on who qualifies for benefits, says Daniel Kalish, managing partner at the national employment law firm HKM Employment Attorneys. The stimulus package included language saying states should be more lenient with who gets extra benefits, but didnt spell out exactly how, says Kalish.
Because there is so much confusion right now surrounding qualification, Kalish has this straightforward advice: If you have had any reduction of your take-home compensation at all, you should apply for unemployment benefits, even if youre unsure whether you qualify. As long as you are honest in your application, there is no negative repercussion for applying. All they can say is no, he says.

How Much Money Will I Receive
Just as each state sets its eligibility guidelines, each state determines its maximum monetary benefit. In many states, benefits equal up to half your weekly earnings up to a certain amount.
Typically, these benefits are available for up to 26 weeks. During times of high unemployment, unemployed workers may be eligible for additional weeks of compensation.

How To Appeal A Denial Of Unemployment Benefits In Oregon
If your claim for unemployment is denied, you have 20 days to appeal the decision with the Office of Administrative Hearings. You can request a hearing by sending a letter or fax to the Office of Administrative Hearings.
After receiving your appeal request, a hearing will be scheduled to receive evidence from both you and your employer. An Administrative Law Judge will conduct the hearing by telephone and issue a written decision. If you disagree with the ALJs decision, you may appeal to the Employment Appeals Board by the date stated in the ALJs notice of decision. And, if you disagree with the Boards decision, you may file an appeal with the Oregon Court of Appeals.
