Ask the Lawyer: Qualifying for unemployment

If you are not able to file your weekly claim certification this week, please check your BEACON portal to see if you have an âApply for Benefitsâ button. If you have this button, there could be several reasons including, but not limited to:

  • You did not apply for benefits last week,
  • Your benefit year has expired , or
  • Your monetary eligibility needs to be redetermined.

Even if your account is active and you have a balance, if you have an âApply for Benefitsâ button, then you need to re-apply for benefits to be able to file your weekly certification as required by Maryland unemployment law and federal program rules.

If you wish to re-apply for benefits, you should access your BEACON portal from an internet browser, click on the âApply for Benefitsâ link on your home page, and follow the steps. You cannot complete this process from the MD Unemployment for Claimants Mobile App.

Reminder: Claimants have through Saturday, June 12 to file their weekly certification for the week. If you have successfully filed your weekly certification this week, please ignore this message. There are no issues with the BEACON system.

Ive Started Working Again But Not Full Time Can I Continue Getting Unemployment Benefits

Attorneys with Texas RioGrande Legal Aid tell clients in this situation to continue requesting payments like normal, including their income and hours worked.

How Much Money Will I Receive

Just as each state sets its eligibility guidelines, each state determines its maximum monetary benefit. In many states, benefits equal up to half your weekly earnings up to a certain amount.

Typically, these benefits are available for up to 26 weeks. During times of high unemployment, unemployed workers may be eligible for additional weeks of compensation.

Some state unemployment office websites offer benefits calculators. To find more information, use CareerOneStop to find your states program.

Remember that unemployment benefits are usually considered taxable income and must be reported on your state and federal tax returns.

How To File For Unemployment Benefits Online

Filing for unemployment varies by state, but you should be able to file online. In New York, for example, filing for unemployment benefits is relatively simple. Unemployed workers can visit the Unemployment Benefits website to submit a new unemployment claim, claim weekly benefits, or check on the status of an existing unemployment compensation claim. Filing by phone is also an option.

In California, workers can also file an unemployment insurance claim by completing an online form. The site also features a form that can be printed out, completed, and mailed or faxed, as well as a toll-free number you can call to file for unemployment.

Most states have similar options, and each has a website with the details on how to apply for unemployment benefits.

How to find your state unemployment office:

  • These sites can be found by searching for “your state name unemployment” via your favorite search engine.
  • Claimants will be asked to create a username and/or password in order to log in to their account to file for unemployment benefits.
  • Carefully follow the instructions for filing in your state to avoid claim delays. You’ll receive a confirmation of your claim once your application is processed.

Dont Count On Extra Help From The Federal Government

As part of the CARES Act, Congress originally provided an extra $600 per week that was added on top of state unemployment benefits. However, this $600 federal add-on expired at the end of July, and Congress and the White House havent been able to agree on an extension.

While negotiations are still ongoing for a second stimulus plan, even if one finally passes, there are no guarantees that itll include another federal addition to unemployment. So when youre budgeting your expenses, plan on only having access to what your state provides. Then if a federal addition is eventually passed into law, itll be icing on the cake.

You Don’t Account For Taxes

Don’t forget that unemployment earnings count as taxable income, including the extra $600 per week provided by the stimulus bill. Federal income tax is withheld at a rate of 10%, and you may owe state taxes depending on where you live.

You can elect to either have withholdings taken out from the start of your benefit period, or you may be required to make quarterly estimated payments. Either way, make a plan for paying taxes on your unemployment benefit.

Ultimately, “Unemployment insurance is an earned benefit,” Evermore says. “People have an entitlement to it if they lose work through no fault of their own. People should see it that way and do everything they can to access their benefit.”

If all else fails: Ask again, but louder.

Houston resident Kimberly Lantz suggests calling your local representatives office. After she was laid off from her job as a hotel sales manager in March, she filed for unemployment right away, but the TWC denied her claim for regular benefits because of an issue with her recent work history.

For the next seven months, she would try in bursts to get in touch with the workforce commission to find out whether she qualified for pandemic assistance. But she could never get through. It wasnt until she called state Rep. Ed Thompsons office in October to discuss her situation that she got an answer from the TWC. Within a week, $20,000 of backpay was deposited into her account.

Should You Reach Out To An Unemployment Lawyer

In general, it doesnt make sense to hire a lawyer right out of the gate. If you receive a letter saying your claim has been denied or that you are not eligible for benefits that you think is wrong, thats when you should look into legal services, Stettner says.

Unfortunately, getting legal representation can be difficult or not worth the cost of hiring a lawyer. A lot of states limit the fees an attorney can charge for unemployment representation, Kalish says. That prevents attorneys from gouging clients who are desperate and in need, he says. But in states where such caps are extremely low, it can be hard to find legal representation for unemployment cases. On the other hand, legal representation may be too expensive in states with no restrictions.

You might be able to find public interest groups that provide pro bono unemployment legal counseling. For example, the Unemployment Law Project provides free legal advice and representation for unemployment cases in Washington state. But these organizations are so overwhelmed they are likely only able to help a small fraction of people in need. Its really tricky to provide a large number of people with good unemployment advice, Kalish says.
