Update 1/27/2021 1099 Tax Form and Unemployment Fraud

Unemployment benefits are taxable at both the state and federal level, and the Michigan Unemployment Insurance Agency issues a 1099 tax form to individuals who received unemployment benefits. University of Michigan employees who had legitimate unemployment claims in 2020 will receive a 1099 tax form. Unfortunately, because the state of Michigan is behind in resolving fraudulent unemployment claims, employees who were victims of unemployment fraud in 2020 may also receive a 1099.

If you received a 1099-G from the Michigan UIA and did not receive unemployment benefits during Calendar Year 2020, you need to take action:

  • If you have already reported the fraudulent unemployment claim to the state and you receive a fraudulent 1099, please email so the university can confirm a fraud protest has been filed.
  • If you have not previously reported unemployment fraud and receipt of the 1099 is your first indication of unemployment fraud, follow the instructions below reporting unemployment fraud and email so the university can file a fraud protest.
  • When you file your 2020 income tax returns, make both the IRS and the Michigan Department of Treasury aware that you are not reporting the unemployment compensation income because you did not receive the payments. .

    Detect Fraud Prevent Fraud

UI Fraud is a crime, and it affects everyone. It drives up unemployment taxes for businesses, it affects people with legitimate unemployment benefit claims, and it puts a strain on the states unemployment trust fund. The person committing fraud could be a claimant who is intentionally misrepresenting information being provided to the Unemployment Insurance Agency when filing and/or certifying for unemployment benefits or could be a traditional fraud matter whereby a criminal is impersonating or representing themselves as a claimant for unemployment benefits. In every instance of fraud, individuals may face criminal prosecution, fines, and penalties of up to four times the amount.

UIA is committed to the prevention, detection, investigation and prosecution of those who commit unemployment insurance fraud.

How Does the UIA Detect and Prevent Fraud?

    • UIA Fraud Manager Program utilizes proprietary scoring determined from an examination of fraudulent claims to identify claim inconsistencies. This proprietary scoring program has been the single largest influencer in combatting the rampant number of fraudulent claims filed from 2013 through 2017.

    Identity Theft:

Identity theft occurs when someone uses another personâs informationincluding wage, employment, and credit card informationto take on their identity. Identity thieves can also use another persons name, Social Security number, and employment information to illegally file UI claims and collect UI benefit payments.

Are You Available And Actively Searching For Work

    Michigan unemployment system

To keep collecting unemployment benefits, you must be able to work, available to work, and looking for employment. If you’re offered a suitable position, you must accept it.

Whether a position is suitable depends on how similar the job is to your previous employment, how much you will be paid, the working conditions, and the skills, experience, and training required for the position. Once you have collected half of the benefits available to you, you will be required to expand your search and accept work outside your past work experience. You will be required to accept a job if the pay is average for similar work in your area, at least the state minimum wage, and at least 120% of your benefit amount.

You must engage in a sustained and systematic effort to find new work, and you must submit a detailed monthly record of your job contacts and work search activities. You may also have to appear for an evaluation of your continued eligibility to receive benefits.
