Am I Eligible For Unemployment Benefits In New Jersey

To qualify for unemployment assistance in New Jersey, you must meet all applicable eligibility requirements as defined by New Jersey Unemployment Compensation Law. Those requirements include the following:

  • The claimant is unemployed through no fault of his or her own
  • The claimant is able and willing to accept suitable work when its offered
  • The claimant shows documented sufficient recent earnings that meet the minimum required by New Jersey law
  • The claimant worked in New Jersey during the past 12 months

How Do I Apply For Unemployment Benefits

File New Jersey Unemployment Claim

You can apply for unemployment benefits online — just create an account on the NJ Department of Labor’s website.

Due to a high volume of claims right now, there’s a specific daily schedule you’ll need to follow to file for benefits. If the last four digits of your Social Security number are between:

  • 0000 and 2500, file between 8 a.m. and 10 a.m.
  • 2501 and 5000, file between 10 a.m. and noon
  • 5001 and 7500, file between noon and 2 p.m.
  • 7501 and 9999, file between 2 p.m. and 4 p.m.

You can file between 4 p.m. and 7 p.m. if you miss your initial window.

You’ll also need to provide information that includes:

  • Your Social Security number or Alien Registration Number if you’re not a U.S. citizen
  • Details of your work history over the past 18 months — employer name, address, and last day of employment
  • Your severance package details, if you’re getting severance pay

What If My Claim Is Rejected

You can check the status of your claim online through the agencys website. Youll need to provide your name, Social Security number and date of birth to get an update.

If the state denies your claim for unemployment benefits, you can file an appeal and state your case. To prevent the initial denial from becoming final, youll need to file your appeal within seven calendar days after delivery of the determination letter or within 10 calendar days of its mailing you can get an exception to this rule if you can show good cause.

You can submit your appeal online or by mail. State your reason for disagreeing with the determination to deny benefits and continue to certify your weekly unemployment benefits while you wait to get a response. This will ensure that you get credit for those weeks if your appeal is accepted. And again, make sure to attend all scheduled appointments with the agency.

The state Labor Department will no longer attempt to recover some overpaid unemployment payments after the federal government updated its guidance on pandemic-related unemployment benefits.

The change could affect more than 250,000 New Jerseyans who received extra unemployment benefits through no fault of their own, Labor spokeswoman Angela Delli-Santi said. The department is working through the details and will soon notify eligible claimants of the next steps, Delli-Santi said.

Unemployment skyrocketed during the first weeks of the pandemic, leaving the Labor Department flooded with hundreds of thousands of claims as businesses suddenly shuttered. Congress expanded unemployment benefits for workers who arent typically eligible, like gig workers and freelancers, but those guidelines changed dozens of times as new laws were passed.

About 130,000 residents have received letters from the state asking them to repay unemployment benefits paid in error, with the state blaming the strict federal guidelines. People who owe the Labor Department money typically cant receive more benefits until their claim is resolved.

Now, under the new guidance from the U.S. Department of Labor, there are five categories claimants must qualify for to see their overpayments waived, all related to pandemic benefits, like Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation .

How Much Might I Get

Unemployment benefits in New Jersey are typically calculated at 60% of your average weekly wage during your base year, up to a maximum of $713 per week. The minimum weekly benefit amount you can receive ranges from $120 to $138, depending on the number of dependents listed in the application. New Jersey claimants are receiving emails that their claims are not payable at this time after the state Labor Department switched people over from High Extended Benefits to the Pandemic Emergency Unemployment Compensation program.

The Labor Department claimed it would be a seamless transition for claimants switching to the Pandemic Emergency Unemployment Compensation program when the state triggered off of High Extended Benefits.

But John Flynn was one of the people the Labor Departments programming mistakenly excluded from the transition, and he was unable to certify as his claim showed up expired. After a week, the department said the issue had been resolved and claimants should continue certifying during open hours.

And while hes been able to certify, Flynn hasnt gotten his money in over two weeks. When he opens his claim, which is unpayable, it states in red letters that no action is needed on his behalf.

I hope I get backpay, but its more about the not knowing how long this will go, said Flynn, a writer for an ad agency who was laid off in March 2020. Im stuck in this claim not payable loop until Im not sure when.

The Labor Department believes all of these claimants can again certify for benefits without issues, according to spokeswoman Angela Delli-Santi.

Delli-Santi said the department is very sorry when this occurs and that staff tries to resolve the situation as quickly as possible.
