Unemployment Benefits Vs Disability Benefits

Can I Get Unemployment and Disability Insurance Benefits ...

When you apply for unemployment benefits, you are acknowledging that you are able and ready to work if a job becomes available. The unemployment office requires individuals who receive unemployment benefits to actively seek employment. Refusing reasonable offers for jobs or failing to actively search for work is a reason to terminate your unemployment benefits.

On the other hand, when you apply for long-term disability benefits, you claim the exact opposite. Whether you are applying for Social Security disability income or applying for long-term disability benefits through a private insurance carrier, you are stating in your application that you are unable to work because of a qualifying disability.

The definition of disabled may differ slightly between government and private disability insurance. However, the common factor is that you are claiming you cannot work.

Will An Application For Unemployment Benefits Disqualify A Claimant From Receiving Ssdi

As a general rule, the receipt of unemployment insurance benefits does not in and of itself lead to the conclusion that you are not entitled to Social Security disability benefits. The United States Supreme Court has ruled that a person may qualify for Social Security disability benefits even though he or she remains capable of performing some work. It is the position of the Social Security Administration that you do not have to choose between applying for Unemployment Benefits and Social Security disability benefits.

The receipt of unemployment benefits is, however, one of the many factors that are considered in determining whether you are disabled. Therefore, an application for unemployment benefits is evidence that the Social Security Administration/Judge must consider together with all of the medical and other evidence. Both the Social Security Administration and the state unemployment agency will likely take notice of your dual claim, require an explanation, and use that information in making eligibility determinations.

Be sure to discuss this issue with your disability attorney before you make your initial social security application or unemployment application.

How Much Paperwork Is Involved

The exact paperwork youll be required to complete is again dependent on your specific plan. But the process typically begins with a relatively straightforward claim form that requires some information from you , your employer , and validation from your doctor that your condition prevents you from working.

Fortunately, if you find yourself confused about any of the documents or applications, you can ask for helpwhether its from your companys own HR department or even people at your doctors office.

I actually found the team at my physicians office to be extremely helpful, says Tiernan, who admits her own leave process was slightly more complicated, as she took advantage of both short-term disability and FMLA for the birth of her child .

They have a whole team dedicated entirely to filling out forms and navigating this process, so I was on the phone with them a lot. They helped me figure out the best forms to fill out, what the dates would be, and any follow-ups that I needed. They even spoke to my HR team directly here at the office.

Disability and Unemployment

Individuals receiving both unemployment insurance and SSDI face possible repercussions for double dipping. It is possible for an individual to erroneously receive unemployment insurance despite being ineligible for unemployment due to his ability to qualify for SSDI. In some states, an individual who erroneously receives unemployment insurance must pay back the state.

This can occur while a recipient of unemployment insurance awaits a decision on his application for disability insurance. In applying for disability insurance, new circumstances may disqualify the recipient for unemployment insurance. Withholding information from a state employment insurance office can constitute fraud, potentially resulting in criminal prosecution as well as a hefty fine.

Can You Collect Social Security Disability And Unemploymentdisability Lawyers In Akron Ohio

Can you apply for social security disability if you are getting unemployment? The answer to that question is yes. However, it depends on whether you are claiming benefits on your work record or SSI . SSI is based on financial need, thus if your unemployment benefit is too high, you cannot receive this type of Social Security. Disability Insurance Benefits may be appropriate depending upon your age and your specific medical condition.

The coronavirus has put many Ohioans out of work since March 2020. When you first lost your job, you probably collected unemployment and had planned on going back to work once the economy improved and the virus subsided. But, what if your health has significantly declined since you lost your job? In such a case, Social Security Disability is something that you should definitely consider.

In normal times, unemployment pays about half of the unemployed workers lost wages. However, pandemic relief laws initially provided both half of the unemployed workers wages plus an additional $600 dollars per week. A few months ago, this was lowered to half of ones wages plus an additional $300 per week. These figures frequently led the unemployed to be paid more on unemployment then they earned while they were working. It is currently unclear whether this additional unemployment will be reinstated and at what amount.

When Does It Make Sense For Me

If you think you might be able to take on a part-time job that doesnt bring in more than $1,000 a month, you might want to consider applying for SSD and unemployment.

If youre among those who can collect unemployment benefits while looking for a part-time job, you still need to research how your unemployment benefits might affect any Supplemental Security Income . If you do qualify for unemployment benefits and start receiving monthly payments, those payments can affect your eligibility for the disability program. You can be denied SSI benefits if your unemployment checks cause your monthly income to exceed the limits.

If you go the route of applying for both, you arent saying that you can hold down a full-time job but youre also not saying that you are unwilling to look for a job. In this situation, you state that your disability prevents you from working full-time and that you need unemployment benefits to make up for your lack of a job while you seek other options.

Note that some states require you to be willing to look for a full-time job in order to receive unemployment benefits. Youll need to check with your state laws ahead of time.

Can you file for both unemployment and Social Security Disability Benefits?

Youll need to file a claim for disability compensation. When you file, youll have to provide evidence showing that your disability prevents you from holding down a steady job. Well also review your work and education history. Example: A Veteran has a service-connected heart condition and a 60% disability rating. She was still able to work until last year when she began to get chest pain when doing anything physical, like walking or lifting boxes. Her doctor told her to retire as soon as possible. She filed a claim for more disability compensation. We reviewed her work and education history and agreed that she was individually unemployable because of her service-connected disability. So we increased her disability compensation to the same rate as a 100% disabled Veteran.

When you file a disability claim, youll also need to fill out these additional forms for Individual Unemployability benefits:

What Is Social Security Disability

The Social Security and Supplemental Security Income disability programs are some of the largest Federal programs in the country. They provide assistance to those individuals who are suffering from disabilities that prevent them from working. You can only qualify for eligibility by proving that you are unable to work full-time for at least a year or more and that you have already accrued enough work credits to qualify for SSD. Your condition must interfere with work-related activities and must meet the SSAs definition of disability.

One of the main requirements of collecting SSD benefits is that you must be unable to perform substantial gainful activity for at least one year. This does not mean that you cant make any money working, however. As long as you are making less than $1,180 per month then you would still continue to qualify for SSD benefits.

Disability Insurance Benefits And Taxes

Generally, if you pay the entire amount of the disability premium yourself, your disability benefits will be tax-free. This may bring your income while on disability closer to your current take-home pay.

If your employer pays all or part of the disability premium, your disability benefits will be subject to income taxes.

Eligibility Criteria: Social Security Disability And Unemployment Benefits

There is no hard and fast rule which requires denial of Social Security Disability Insurance or Supplemental Security Income claims by those already receiving unemployment benefits. But there is an obvious tension between the two types of benefits:

  • Unemployment: Must be ready, willing and able to work on a full-time basis
  • Disability: Must be unable to work a full-time job for 12 months because of a disabling medical condition. If a person is expected to be unable to work for 12 months, this qualifies as well.

A 1999 U.S. Supreme Court case held that Social Security disability claims did not inherently conflict with other types of benefits. But the reality is that if an administrative law judge sees that a claimant has admitted he was ready, willing and able to work, then this is not consistent with a claim for disability benefits.

Unemployment benefits: Ineligible if you’re getting disability?

Yes, you can apply for unemployment benefits and long-term benefits at the same time, but it is typically not a good idea. When you file your applications for benefits, you are contradicting yourself. On the unemployment application, you state you can work. On the disability application, you state you cannot work.

The state unemployment office may deny your application based on your assertion that you cannot work. Likewise, the Social Security Administration or the private disability insurance carrier may point to your unemployment application or benefits as proof that you can work.
