Getting Unemployment Insurance When You Could Be Getting Sdi Instead
If you got laid off, but you can’t actually work because of a non-work-related disability, it can be a mistake to apply for Unemployment Insurance .
Many people don’t know about the State Disability Insurance program, and apply for UI instead. However, SDI can give you a larger benefit for a longer period of time than UI, and you won’t get UI benefits if you’re not able to look for work and accept work if it’s offered. Plus, you can’t get UI and SDI at the same time. So even if you are unemployed, it’s better to apply for SDI if you have a non-work-related injury or illness that keeps you from being able to work. If you learn about SDI after applying for UI, you can transfer from UI to SDI instead of staying on UI benefits.
Giving Up On Edd Because They Are Difficult To Reach
It can be frustrating trying to contact the California Employment Development Department about State Disability Insurance or Paid Family Leave because EDD staff are often extremely busy and hard to reach, but it is important to keep trying, especially if you have questions about your application or what’s happening with your benefits. EDD provides a list of ways to contact them, including online chat, phone, local offices, and by mail. You may need to try more than one way to contact EDD.

What Medical Conditions Qualify For Short

One reason is that they know how many administrative law judges who work for Social Security look at people applying for both benefits at the same time: suspiciously. Some judges will outright deny the disability claims of any applicants who are collecting unemployment benefits.
Other disability advocates point out that there are situations where an older person could be legitimately entitled to disability benefits due to a “medical-vocational allowance” even though they are able to do some work.
For instance, let’s consider a 55-year-old person who has been limited to desk work because of a severe spine condition. Social Security will give them a “sedentary RFC.” But assume this person has always done heavy labor and doesn’t have any desk job skills. According to Social Security’s rules, because of their age, past job skills, and education, they aren’t expected to learn how to do a sedentary job, so they should be approved for disability benefits. In that case, the individual can collect disability benefits, but could actually do some sedentary work . So if this person collects unemployment compensation while they wait for a disability decision, there’s no real conflict because they are, at least in a sense, ready and able to work.

Back in 2006, the Chief ALJ of Social Security issued a memorandum on this specific issue. He noted that the receipt of unemployment benefits does not preclude disability benefits.
He further noted that SSAs position is that it should not force claimants to choose between disability benefits and unemployment benefits.
However, he cautioned that judges should be mindful of individuals who are seeking employment in positions that require more functional ability than the person is claiming to have.
A big take away from this memo is that while you can apply for unemployment and disability, your statements to both should be consistent.
