Liability Conditions By Business Type
General business employers are liable on:
- The first day of the calendar quarter you pay remuneration of $300 or more, – or –
- The day you obtain any or all of the business of a liable employer
Non-profit employers are liable:
- On the first day of the calendar quarter you pay remuneration of $1,000 or more, – or –
- As of the first day of the calendar year you employ four or more workers on at least one day in each of 20 different weeks during that year or the prior calendar year
Employers of household help are liable the first day of any calendar quarter you pay remuneration of $500 or more.
Effective January 1, 2020, employers of agricultural labor are liable as of:
- The first day of any calendar quarter after January 1, 2020 in which you pay remuneration of $300 or more, – or –
- The day you obtain any or all of the business of a liable employer

Government employers are liable the first day of the calendar quarter you pay remuneration to employees in covered employment. It does not matter how much remuneration you pay or the number of employees.

Child Labor Laws
Employers must make a schedule for all minors employed by the employer and post it in a conspicuous place. The schedule sets forth the hours minors start and end work and time allotted for meals. The hours of work can be changed, as long as the changes are posted on the schedule. Minors may work only on the days and at the times posted on the schedule. If minors are present at other times or if no schedule is posted, it is a violation of the Child Labor Law.
Public Works/Prevailing Wage Rates
The current Prevailing Rate Schedule notice must be:
- Posted in a prominent and accessible place on the site of the public work project.
- Encased in, or constructed of, materials capable of withstanding adverse weather conditions.
- Titled PREVAILING RATE OF WAGES in letters no smaller than 2 x 2 inches.

Employers Are Advised To Perform An Internal Audit With Employment Counsel To Confirm All State And Federal Employment And Labor
On December 16, 2022, Gov. Hochul signed Bill A7595/S6805 into law, which goes into effect immediately.
The law amends New York Labor Law Section 201, which previously stated:
Wherever persons are employed who are affected by the provisions of this chapter or of the industrial code, the commissioner shall furnish to the employer copies or abstracts of such provisions, rules and orders as he may deem necessary affecting such persons. The copies or abstracts shall be in such language as the commissioner may require and shall be kept posted by the employer in a conspicuous place on each floor of the premises.
The amendment now adds the following provision to the end of the statute:
Digital versions of such copies and abstracts shall also be made available through employers website or by email. Employers shall provide notice that documents required for physical posting are also available electronically. All other documents required to be physically posted at a worksite pursuant to state or federal law or regulation shall also be made electronically available in the manner described pursuant to this section.
Employers that fail to comply with state and federal employment law posting requirements may be subject to fines. Compliance with these requirements also can be used to rebuff claims from employees that they were unaware of their rights.

According to New York Unemployment Insurance posters, Unemployment Insurance is temporary income for eligible workers who become unemployed through no fault of their own and who are ready, willing, able to work and have sufficient work and wages in covered employment. In New York State, the money for unemployment insurance benefits comes from taxes paid by employers. No deductions are ever made from a workers paycheck for unemployment insurance and employees are made aware of this provision by reading New York Unemployment Insurance posters. It is the Department of Labor that determines whether an unemployed worker qualifies for unemployment.
Due to increased manipulation of the UI system by employers, the SUTA Dumping Prevention Act of 2004 was signed by President Bush in August of 2004. In order for New York to conform to the requirements of this act, legislation effective January 1, 2006, was recently enacted that prohibits the practice of SUTA dumping. Employers and financial advisors engage in SUTA dumping when they attempt to manipulate state experience rating systems in order to obtain a lower tax rate than their unemployment experience would otherwise allow.

After You Have Registered
- We assign each liable employer an eight-digit employer registration number. Please use your registration number on all correspondence, quarterly returns and payments that you send to us.
- If you are liable for Unemployment Insurance, you must electronically submit a Quarterly Combined Withholding, Wage Reporting and Unemployment Insurance Return . File the NYS-45 online by visiting the Department of Taxation and Finance website. For more information, call 899-8810.

Who Must Post: Federal contractors and subcontractors must post the employee notice conspicuously in and around their plants and offices so that it is prominent and readily seen by employees. In particular, contractors and subcontractors must post the notice where other notices to employees about their jobs are posted.
Additionally, federal contractors and subcontractors who post notices to employees electronically must also post the required notice electronically via a link to the OLMS website. When posting electronically, the link to the notice must be placed where the contractor customarily places other electronic notices to employees about their jobs. The link can be no less prominent than other employee notices. Electronic posting cannot be used as a substitute for physical posting.
Where a significant portion of a federal contractor’s or subcontractor’s workforce is not proficient in English, they must provide the employee notice in languages spoken by employees. OLMS will provide translations of the employee notice that can be used to comply with the physical and electronic posting requirements.
