Because of the pandemic, the length of time someone can receive benefits has been extended multiple times. And its happened again: With the new federal stimulus package, benefits can now continue until Sept. 6.

The main points:

  • An extra $300 a week will be added to weekly benefits until Sept 6.
  • The first $10,200 you received from unemployment in 2020 will not be taxed by the federal government as long as your household income is less than $150,000. You will still have to pay state and city taxes on your benefits, because the New York state and city governments measure income separately from the feds.

Login or create an ID account at https://unemployment.labor.ny.gov/login and simply follow the instructions to file a claim.

If you have never filed a claim for benefits in New York State, all you have to do is create a Personal Identification Number . This is a four-digit number that must be kept confidential. This PIN will be used to access the system to certify weekly benefits and update your account.

How Unemployment Works In New York

Heres a quick overview of how the unemployment insurance process works in New York.

  • Before you apply, make sure you meet all benefit requirements. You must meet all requirements to be eligible to collect unemployment insurance in New York. Among other things, you must have lost your job through no fault of your own, you must be ready, willing and able to accept suitable employment, and you must conduct an ongoing job search.
  • If you meet all benefit requirements, then you can apply for unemployment insurance. To do so, you must log in to the New York Department of Labor website or call the Telephone Claims Center at 209-8124, MF, 8:00 a.m. to 5:00 p.m.
  • Determine the amount of your benefit. This is calculated based on wages earned in either your Basic Base Period or your Alternate Base Period. To find out how much your actual weekly benefits will be, use this calculator.
  • Determine the number of weeks you can draw benefits. Based on your particular circumstances, the New York Department of Labor will send you a notice of how many weeks of eligibility you have. Normally you can draw 26 weeks of benefits in any given Benefit Year.
  • Conduct an ongoing job search. You are required to look for full-time work while drawing benefits, and you must do at least three work search activities each week.

    Do You Meet The Minimum Earnings Requirement

    Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment compensation. In New York, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you filed your claim in October of 2020, the base period would be from June 1, 2019, through May 31, 2020.

    New York recognizes an alternate base period for those who can’t meet the earnings requirements in the regular base period. The alternate base period is the last four completed quarters before the person files for unemployment. This alternate period takes more recent employment into account. Even filers who qualify using the regular base period can ask the agency to instead use the alternate base period to calculate their benefits, if that would result in a higher weekly amount.

    How Much Will You Be Paid By Unemployment Each Week When Will Your New York Unemployment Claim Be Processed And Paid

    To calculate the amount of the benefit you are entitled to, the state of New York unemployment process uses one of two possible base periods. Base periods are divided into calendar quarters and the quarter you were paid the highest amount of wages determines the amount of your New York unemployment weekly claims. While you can determine ahead of time how much New York unemployment compensation you receive, you will be formally notified before your benefits begin.

    New Yorks Basic Base Period is the first four of the last five completed calendar quarters prior to the beginning date of the UI claim. If you have earned enough wages in your Basic Base Period, those wages will be used to calculate your benefit amount.

    If you do not have enough wages in the Basic Base Period to establish a claim, you may be able to use an Alternate Base Period. It is the last four completed calendar quarters prior to the beginning of the claim.

    How Much Might I Get

    New York determines the amount of your weekly unemployment benefit by reviewing earnings during whats known as a base period. New Yorks basic base period covers your wages for the first four calendar quarters before the quarter in which you file for unemployment.

    To qualify for unemployment insurance benefits, you must meet all of these earnings requirements for the base period.

    • Earned wages at jobs covered by unemployment insurance in at least two calendar quarters
    • Received payment of at least $2,600 in one calendar quarter
    • Received total wages that are at least 1.5 times the amount of wages earned in your highest quarter

    Your weekly benefit rate will be 1/26 of the high-quarter wages you earned in your base period. For example, if your wages during the base period were $4,394, the state would divide that amount by 26 to calculate your weekly payment amount of $169.

    Weekly unemployment benefits in New York range from $104 to $504 for claims effective Jan. 6, 2020, or later. Again, because states may change their benefits during times of crisis, its possible these maximums can change during recessions or other difficult economic situations.

    Expiration Of Federal Unemployment And Pandemic Benefits

    As of September 5, 2021, several federal unemployment benefit programs have expired across the country, per federal law. The federal benefit programs that have expired include:

    Unemployment Insurance benefits will continue to be paid to eligible claimants.     Are You Out Of Work Through No Fault Of Your Own

    You must be out of work through no fault of your own to qualify for unemployment compensation in New York. If you are laid off, lose your job in a reduction-in-force , or get “downsized” for economic reasons, you will meet this requirement. You will also likely be eligible for unemployment benefits if you are fired because you don’t meet the qualifications for the job or you fail to meet the employer’s performance or productivity standards.

    In New York, employees who are fired for work-related misconduct may not qualify for unemployment benefits. If you are fired for conviction of a felony , you also won’t be eligible for benefits.

    NY state is extending unemployment benefits

    Partial benefits are available to individuals who work fewer than 4 days per week and earn less than $504 during that week. Each day or partial day that you work causes your unemployment benefits rate to drop by 25%. For example, if you work three days of the week and earn $400, your benefit rate will drop to $100. If you work only two days of the week, your benefits will drop to $200. If you work one day of the week, your benefits will be only $300.

    Receiving partial benefits extends the amount of time that you can collect unemployment. However, if you receive more than $504 per week , you canât receive unemployment benefits for that week.

    When you file your unemployment claim, youâll be asked to enter the date of the last day that you worked. This should be the last day that you were physically present at your job, whether it was full-time or part-time work. If your more recent employer employed you for only part-time work, enter this employerâs information as the âlastâ or âmost recent employerâ when you fill out your claim. If you plan to continue working part-time for this employer, you will enter âlack of workâ as the reason why you wish to collect unemployment.
