In addition, workers receiving benefits in all programs were eligible for an additional $600 weekly unemployment benefit, which expired in July. In August, President Donald Trump signed an executive order that extended $300 in extra weekly unemployment for some workers, but some states have already run out of funding for the program.
On Thursday, the House passed Democrats $2.2 trillion coronavirus stimulus bill, which would extend most programs and reinstate the additional $600 weekly unemployment benefit, but the package is unlikely to pass the Republican-controlled Senate and become law.

In order to receive your unemployment benefit, you must log into your state department of labor account and recertify your claim every week. You’ll answer questions about how much time you worked or any wages you earned that week. If you earned $0, you’ll receive your maximum unemployment benefit for that week.
If you’re called back to work at the same schedule and rate from before your layoff, you should immediately let your state unemployment office know, says Michele Evermore, a senior policy analyst at the National Employment Law Project.
You must notify your state agency that you’re earning wages on the first day you’re back to work, not when you get your first paycheck. For example, if you’re recalled to work on July 15 but won’t be paid until July 31, you still must stop your unemployment benefit as of July 15.

Additional Unemployment Insurance Programs
State benefits last for 26 weeks, meaning that if a worker spent six weeks on unemployment, they’d have 20 weeks left to claim. But even if a worker has run out of state benefits, the CARES Act put programs in place for them to claim additional unemployment insurance.
“If you were laid off for more than 26 weeks, you’d restart and go into PEUC, probably,” said Evermore, referring to the Pandemic Emergency Unemployment Compensation program, which extends state unemployment benefits by up to 13 weeks through the end of the year.
And, most states have special extended benefit programs that are available to workers during times of high unemployment. In a majority of states, these programs extend unemployment for another 13 weeks, though some states differ in length Florida and North Carolina offer about six weeks, while other states pay up to 20 weeks.
Workers who have exhausted other benefits could also apply for the Pandemic Unemployment Assistance program, which was created to help those that traditionally weren’t eligible for state UI, such as independent contractors and gig workers. The PUA program offers 39 weeks of unemployment benefits but requires that people have lost work due to the Covid-19 pandemic.
A Year Of Unemployment Benefits
The CARES Act and other rules mean people can get benefits over a much longer period of time than is typically the case.
The law funds an additional 13 weeks of benefits for unemployment recipients. This extension, called Pandemic Emergency Unemployment Compensation, expires at the end of 2020.
States also have rules, which predate the CARES Act, that offer extended benefits during periods of high unemployment in their state.
Most states have triggered these additional benefits, typically around 13 extra weeks, Evermore said. Some states like Florida and North Carolina pay fewer and others pay up to 20 weeks.
Unlike the 13 extra weeks offered through the CARES Act, which are unavailable past year-end, the extra weeks offered via extended benefits can bleed into next year if a person remains unemployed.
So, our theoretical unemployed worker could access $380 a week for a whole year. .
This amount would be available over several periods of unemployment during that time period.
The person would also get $600 a week through July 31 in federal supplement payments.
Workers generally dont have to reapply when transitioning into new periods of duration, though some states may vary in their processes, Evermore said.
The CARES Act offered some groups, like self-employed and gig workers, a total 39 weeks of unemployment benefits, via the Pandemic Unemployment Assistance program. It expires at the end of the year.

You Can Stop And Restart Unemployment Aid Throughout Your Benefit Year
When you first apply for unemployment, you become eligible to receive a certain amount of money based on how much you used to earn every week, averaged over the previous four quarters. On average, this amount will replace roughly half of your previous earnings or less, and exact calculations vary by state. In April 2020, state-provided unemployment averaged $333 per week nationwide but ranged from a low of $101 in Oklahoma to $531 in Massachusetts.
This dollar figure is the maximum of what you can receive in unemployment every week for a benefit year of 52 weeks.
The number of weeks you can collect unemployment within that 52-week period will depend on your state. State allowances range from a low of 12 weeks in Florida and North Carolina to a high of 28 weeks in Montana but are most commonly 26 weeks. You don’t have to use your weeks of unemployment consecutively, but generally you do have to use them within a year of when you first qualified for benefits.
So, for example, let’s say you live in a state that offers 26 weeks of unemployment. You qualify for aid and claim benefits for 13 weeks. Your employer reopens and you’re rehired, so you stop collecting benefits while you’re working full-time. Twenty-six weeks go by. If the business shuts down again after that period, you’ll still have a remaining 13 weeks to collect unemployment before your benefit year expires.
This is how your unemployment period could break down in normal circumstances.

A hearing is a formal legal proceeding where an administrative law judge decides what benefits, if any, must be paid, and may decide any other issues. To request a hearing, you must file an Application for Hearing with the OAC using the form located at colorado.gov/oac/oac-form-links.
A prehearing conference is a hearing conducted by an administrative law judge at the Division of Workers Compensation. Prehearing conferences are limited to procedural issues such as scheduling of formal hearings and discovery . Any party can schedule a prehearing conference. If a prehearing conference is scheduled in your case, you should attend either in person or by telephone.
A settlement conference may be requested by either party, but will not be held unless all parties agree to participate. Both prehearing and settlement conferences can be conducted by telephone. You may settle all or part of your claim with your employer or the insurance company. The settlement involves giving up all or some of your rights to future workers compensation benefits in exchange for an agreed-upon amount of money. Settlements are completely voluntary.
