Are You Out Of Work Through No Fault Of Your Own

One of the most disputed issues between employers and employees is whether the employee is out of work through no fault of his or her own. Like most other states, New Mexico treats layoffs, terminations, and voluntary resignations differently.

Collecting Unemployment After a Layoff

The simplest scenario is where the employee was laid off due to lack of work or other business reasons that have nothing to do with the employee’s quality of work. If your company was downsizing and laid you off, you will still be eligible for unemployment benefits.

Collecting Unemployment After Being Fired

Being terminated is not an absolute bar to recovering unemployment. If you were fired because you simply lacked the skills for the job or weren’t a good fit personality-wise, you won’t be barred from receiving benefits. In general, you will be disqualified only if you were fired for misconduct. In New Mexico, misconduct is behavior that shows a willful disregard for the employer’s interests. For example, intentional violations of company rules, acts of insubordination, multiple unexcused absences, or showing up to work under the influence of drugs or alcohol may qualify as misconduct.

These benefits are being offered through the federal Pandemic Unemployment Assistance program.

Workers who became unemployed, had hours reduced, or had an inability to work as a direct result of the COVID-19 pandemic may qualify for this unemployment assistance.

People who may qualify for PUA include individuals not eligible for regular unemployment benefits:

What Is An Offer Of Suitable Employment

To keep collecting unemployment benefits, you need to demonstrate that youre unable to work. That means you usually cant keep collecting if you refuse a suitable job that offered you pay. That doesnt mean you have to take just any job, however. A suitable job usually means its safe for you to do that work and is reasonably accessible to you. You may have the option to turn down jobs that pay far less than you used to make, if theyre outside your career field and below your level of experience, if you can reasonably expect to find work in your field again. Check with your local unemployment office to confirm if you can turn down a particular job and still continue your benefits.

New Mexico Approved And Funded For Lost Wages Assistance Program

Aug 26, 2020 | Jobs & the Economy, Other Affected Services

New Mexico was the first state in the country to submit a grant application to the Federal Emergency Management Agency for Lost Wages Assistance . The New Mexico Department of Workforce Solutions has received approval and grant funding from FEMA for the program that was authorized through an August 8th Presidential Memorandum.

New Mexico was the first state to apply for the Lost Wages Assistance Program, as we know how much our friends and neighbors need this extra cash to get them through this tough time, said Bill McCamley, NMDWS Secretary. Since that time we have initiated a plan to roll out the program smoothly, trying to make it as easy as possible for New Mexicans to get all of their needed benefits as quickly as possible.

Eligible individuals will receive $300 in addition to their regular weekly benefit amount. Currently, New Mexico has only been approved for up to three weeks of payments, beginning July 26, 2020, through Aug. 15, 2020. The department has applied for an additional week of funding to extend the supplemental benefit through August 22. NMDWS will continue to apply for grant funding from FEMA for as many weeks as possible in order to maximize the supplemental benefits provided to New Mexicans.

The Greater Albuquerque Chamber of Commerce said this could be a concern but the reinstatement is a great first step to getting New Mexicans back to work. I think there is some concern that could you know, that could happen, Scott Darnell, with the Greater Albuquerque Chamber of Commerce said. Were optimistic that requiring those still on unemployment insurance to actively look for work will lead to more offers being made and positions being filled.

Darnell said the reinstatement is welcome news.It is a staple of the unemployment insurance program for good reason. We should encourage work in this country and the goal should always be that somebody goes on to unemployment insurance for a short period of time to help them as theyre looking for work, Darnell said.

As of May 7, 2021, about 81,000 claimants were receiving benefit payments.
