Learn The Rules For Unemployment Eligibility Benefit Amounts And More In Indiana

By Lisa Guerin, J.D.

Indiana workers who have recently lost their jobs might be eligible for unemployment benefits: payments available to employees who are out of work temporarily, through no fault of their own. Although the basic rules for unemployment are similar across the board, the benefit amounts, eligibility rules, and other details vary from state to state. Here’s how unemployment benefits work in Indiana.

Waiting For Unemployment Back Pay We Got Answers From The New York State Department Of Labor

BUFFALO, N.Y. Many of you have reached out to 2 On Your Side asking about your unemployment benefits and the back pay you still havent received. Wednesday we got answers for you from the New York State Department of Labor.

Governor Andrew Cuomo has said several times that people will get their back pay, but some people have been waiting for more than two months, and they need to pay their bills.

Our response rate is much, much better than any other state, Cuomo said in a press conference on Wednesday. But if you havent gotten your check, none of that matters. I understand that. The good news is youre not losing any money because when you get your check, itll be for the full amount, but you still dont have the check today. All that matters to you is you want that check in your hand today because you need it. I get that. We have made tremendous progress in a very short period of time. But again, no one could have seen this coming. If no one would have built a website and office apparatus to handle millions of calls when you never expected it to happen. But we have reduced dramatically the wait time and the response time.

Wayne Shattuck is waiting for that check. He works for a school and has been unemployed since mid-March. This week, he got some money, but he still hasnt gotten his back pay. His wife is also unemployed.

Shattuck would like his back pay and does not know when he will be able to return to work since he works for a school.

How Your Base Period And Benefit Year Are Determined

Massachusetts employers are required to report wage information to the Department of Unemployment Assistance on a quarterly basis. This wage information is used to determine whether you have earned enough wages to qualify for unemployment benefits.

If you disagree with the wages reported by your employer

If you disagree with the wages reported on your Monetary Determination notice, you can provide proof of the wage amounts you are disputing by completing and returning the Wage and Employer Correction sheet that was mailed to you with your notice. DUA will review the information and make any necessary adjustments.

If it is determined that you have not earned enough wages under either the primary or the alternate base period, you have the right to file an appeal and present additional supporting documents at a hearing.

Your benefit year

Once your claim is established, it will remain open for 1 year . This period of time is called your benefit year.

Your maximum benefit credit is available to you for the duration of your benefit year or until you have exhausted your maximum benefit credit. Once your benefit year expires, any unpaid benefits will no longer be available to you.

Calculating Your Duration Of Benefits

How to Collect Unemployment

The number of weeks you are eligible to receive UI benefits is called your duration of benefits. Your duration of benefits is calculated by dividing your maximum benefit credit by your weekly benefit amount.

The maximum number of weeks you can receive full unemployment benefits is 30 weeks . However, many individuals qualify for less than 30 weeks of coverage.

The following examples show how to determine your duration of benefits.

Example 1

In this example, you would be eligible to receive $362 for 24 weeks.

Do You Meet The Minimum Earnings Requirement

Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment. In Florida, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you filed your claim in October of 2021, the base period would be from June 1, 2020, through May 31, 2021.

During the base period, your work history and earnings must meet all three of these requirements:

  • You must have been paid wages in at least two of the four calendar quarters that make up the base period.
  • Your earnings during the entire base period must be at least one-and-a-half times your wages in the highest paid quarter of the base period. For example, if you earned $5,000 during your highest paid quarter, your total earnings for the base period year must be at least $7,500.
  • You must have earned at least $3,400 during the entire base period.

Overpayment Notice On Id Theft Claims

If you receive a Statement of Overpaid Unemployment Benefits Account for an unemployment benefits claim that you did not file, you should report the ID theft claim on TWCs online Fraud Submission portal. See Unemployment Benefits ID Theft for more information.

Once TWC confirms that a claim was filed using a stolen ID, the individual named on the claim is not responsible for any overpayment and the employers tax rate or reimbursement is not affected. Once ID theft is confirmed, any future overpayment statements will be suspended. However, you may continue to receive billing statements while the investigation is ongoing.

You do not need to respond to these statements.

It is important to promptly repay an overpayment because:

  • The overpayment stays on your claim record until you repay it in full.
  • If you apply for benefits,TWC will apply each eligible payment toward reducing your overpayment until the overpayment is repaid.
  • The Texas State Comptroller can recover your overpayment by withholding certain payments to you. That means the state cannot pay you lottery winnings, unclaimed property, unemployment benefits, or state job-related expenses, except for wages, until you repay the overpayment in full.
  • Some state funding for college students cannot be released until you repay the overpayment in full.

If Your Appeal Is Appealed

Does collecting unemployment affect my Social Security benefits? | Your Coronavirus Finances

Unfortunately, this is not always a one-and-done process. You might win your appeal only to receive notice that your employer is again appealing the decision so your successful unemployment appeal can be reversed. You usually have the right to do the same if your appeal is denied.

The subsequent hearing might take place before a different judge or panel. For example, a second appeal goes to the Board of Review in New Jersey. This state is particularly generous about the appeals process. You can reach out a third time to the Appellate Division of the New Jersey Superior Court if the second review doesnt go your way.

What Can Affect My Minnesota Unemployment Insurance Benefits

How to Calculate Your Unemployment Benefits

To keep your Minnesota unemployment benefits eligibility, you must maintain eligibility each week you receive benefits. The following may affect eligibility or cause adjustments to the benefit amount you receive:

No longer meeting weekly eligibility requirements

You must maintain all points of eligibility to continue receiving benefits. If you get a seasonal or part-time job with an income threshold that still qualifies you for benefits, you must maintain an active job search. Receiving some income does not make you exempt from job search eligibility requirements. Additionally, if you have or develop a medical condition that prevents you from working, youre no longer eligible for benefits.

    Working/earning wages while receiving benefits

In your Minnesota unemployment weekly claim, youll be asked whether or not you worked during that period and the wages you earned. Though earning an income does not immediately disqualify you from receiving benefits, your Minnesota unemployment rate will likely be reduced if you earned wages during that period.

    Fraud and payment errors

If you make a mistake on your weekly Minnesota unemployment claim, you should contact the Minnesota unemployment department. Your benefits will be adjusted accordingly and there will be no penalty. If you discover that you have made a mistake during the Minnesota unemployment claim filing process, you should contact the unemployment department as soon as possible.
