Which Employees Are Covered

An employee is entitled to coverage if he or she suffers an off-the-job illness, injury, or other disabling event and:

  • the employee has worked for a covered employer for at least four weeks
  • the employee works for a successor of a covered employer
  • the employee is a domestic or personal employee who works at least 40 hours per week for one employer, or
  • the employee works for an employer who has voluntarily elected to provide coverage.

Whats It Like To Return To Work After Short

As the above answer illustrates, depending on your disability, different logistical elements obviously need to be sorted out upon your return.

But thats not the only factor at play heretheres also an emotional and relational element involved when you return to the office after an extended amount of time off.

Most of it was just emotional and mental fatigue after having spent four months not really on a computer every day or using my brain in that kind of way, says Tiernan.

There was the expectation that I was going to be able to jump back in right away, she adds. Looking back, I appreciate that now because I dont think I wouldve been able to transition as well as I had if it had been slow.

In addition, companies arent stagnant and there are likely some larger changes that will happen while youre out on your leaveincluding employees leaving and new team members being added. There were shifts that occurred during my time gone, so I needed to readjust to the changes that had happened, Tiernan adds.

When Can You Receive Both Unemployment & Long

It is unlikely that you will qualify for unemployment and disability benefits at the same time. However, there are always exceptions to the general rule.

For example, you might qualify for unemployment benefits if you are partially disabled while receiving partial long-term disability payments. Even so, it is best to talk with our long-term disability lawyer before you apply for either unemployment or long-term disability benefits.

It is more likely that you might qualify for unemployment benefits followed by long-term disability benefits or vice versa. However, the application process can be tricky. If you file a second application for benefits immediately after the termination of the other benefit, your statements from your first application could impact your second application. Again, it is best to speak with our long-term disability attorney if you believe you could qualify for both unemployment and long-term disability benefits.

Another issue that you could encounter is the termination of your long-term disability insurance coverage. If you lose your job, your employer may terminate your LTD policy. However, some LTD policies remain in effect for a short period after employment terminates.

How Much Will You Get Paid When You Take Short

A comprehensive guide to Short

When you take advantage of your short-term disability benefit, your time off is paidbut that doesnt necessarily mean youll be getting your full paycheck.

The amount youll earn is dependent on your specific plan. Some plans offer full salary replacement, but most dont. Instead, they offer a percentage of compensation with a dollar amount cap.

There are also programs that award you different amounts based on your longevity with the company, says McDonald. If you are there for 10 years and have a 26-week disability period, you might get three months at 100% and then three months at 50%.

If you live in one of the five states where short-term disability benefits are mandated, then the amount youll be compensated will be regulated as well.

Denying To Yourself That You Have A Disability

Many people take a long time to learn to cope with a new condition, and in the beginning won’t admit to themselves, their family, and their medical provider that they have an injury or illness that stops them from being able to work. Because of this, at first you might not be giving your medical providers an accurate or full understanding of your condition or how much it affects your day-to-day activities. It’s extremely important that you let your medical provider know exactly what is going on, because in most cases State Disability Insurance relies on your medical provider to let them know how serious your disability is, and how long it might last. If you haven’t been completely honest with your medical provider and then apply for SDI, the report about your disability might be inaccurate or incomplete, and you might be turned down or you might be given benefits for a shorter period of time than you need. Note: In some cases, EDD may order an independent medical examination.

Collecting Unemployment And Social Security Disability Benefits Simultaneously

Contrary to what you might think, it is possible to collect Social Security disability insurance and unemployment benefits at the same time. Of course, it is rather difficult to qualify for both of these benefits at the same time because the eligibility criteria are fundamentally at odds. To qualify for unemployment, you must be actively looking for a job. To qualify for a disability claim with SSDI, you must be permanently and totally disabled. Only a small handful of applicants can meet both of these criteria.

If you receive unemployment benefits, the Social Security Administration will take them into account when they examine your SSDI application. It is your responsibility to prove to the SSA that thereâs no conflict between the two benefits.

The same is true for Supplemental Security Income benefits, which are paid to disabled persons. While it is theoretically possible to receive this benefit alongside unemployment benefits, the criteria for the two programs are again largely at odds with each other. Unlike receiving Social Security retirement benefits and SSDI, receiving unemployment benefits may reduce your Supplemental Security Income benefit. Claimants should consult with a qualified disability attorney in either of these cases in order to ensure that they are following the rules and receiving every benefit that they qualify for.

The Limited Employment Eligibility Loophole

If, while collecting unemployment benefits, you are searching for work that is within the limitations of your disability, you might be able to convince an examiner or an administrative law judge to allow you to collect both unemployment and disability benefits.

You might also be able to collect disability and unemployment benefits by searching only for jobs that would require the employer to make special accommodations for your disability that most employers would be unwilling to make.

What Medical Conditions Qualify For The Disability Tax Credit

The disability tax credit is different from other disability benefits plans. The above disability plans focus on how your medical condition affects your ability to work. The is not focused on your ability to work. Rather, it focuses on impairment with your daily activities.

Eligibility Criteria for the Disability Tax Credit

  • be blind
  • be in at least one basic activity of daily living
  • be significantly restricted in two or more basic activities of daily living
  • need life sustaining therapy

You will automatically qualify for the disability tax credit if your medical condition causes blindness or you to need life sustaining therapy.

To qualify as blind your visual acuity in both eyes must be 20/200 or less or your field of vision in both eyes is 20 degrees or less.

To qualify under the life sustaining therapy requirement, the therapy must be needed to support a vital function, and you must need it at least 3 times per week for an average of 14 hours per week.

The basic activities of daily living include the following:

  • Speaking
  • Dressing
  • Mental functions necessary for everyday life

To qualify for the disability tax credit you must show that you are markedly restricted in one of these areas. A marked restriction means that you are unable to do the BADL or take an inordinate amount of time to do it. This restriction must be present 90% of the time.

What Happens If You Cant Return To Work After An Injury That Isnt Job

The answer to this question depends on a couple of things. One of them is whether your injury is short-term or long-term. Texas does not provide for short-term disability coverage through the state. But if you have purchased a private short-term disability insurance policy or your employer provides it, you can file for benefits to cover the time off work due to your short-term injuries.

If you have an injury that is expected to leave you unable to work for a year or more, you may be able to get long-term disability benefits through Social Security. There are two types of benefits:

Social Security Disability Insurance SSDI is for people who have worked and paid into Social Security.Supplemental Security Income SSI is for disabled, elderly, or blind people with minimal income and resources.

You can visit the Social Security Administration for more information on these programs.

Can I Collect Disability Insurance Benefits If I Am Collecting Unemployment Benefits

It is challenging for a disabled claimant to obtain either short or long term disability benefits when they are receiving or have received unemployment benefits. It is not impossible to get STD or LTD benefits, but a claimant would be much better off not seeking unemployment. One of the criteria to be eligible for unemployment benefits is that the employee must be able to work, available to work and actively seeking work. In a situation where a person has an own occupation policy, then it could be possible to receive unemployment and disability benefits. The other important reason to not seek unemployment is that in most ERISA / GROUP disability policies, any unemployment benefits received will offset any disability benefits which are owed.

How To Apply For Short Term Disability Insurance Coverage

Many employers offer short term disability insurance coverage to employees as a group plan. Many companies even pay the full premium for their employees. A handful of states require employers to provide this coverage.

If you cannot get short term disability through an employer or other group membership, you can buy an individual policy. This can be done through an insurance agent or directly from an insurance company that offers this type of coverage.

Group plans are guaranteed issue, meaning you automatically qualify for coverage without going through underwriting. Short term policies sold on an individual basis are sometimes guaranteed issue as well.

However, most short term policies sold directly to an individual will require the applicant to answer health-related questions. These questions will ask whether you are currently or in the past have been treated for any number of pre-existing conditions. If so, you may be disqualified for getting coverage or have your benefits limited.

Unemployment Benefits Impact On Social Security & Vice Versa

As mentioned previously, the state of Minnesota is the only state in the union that currently offsets the unemployment benefits of those who are already receiving Social Security income. If you live in this state, your unemployment benefits may be reduced by an amount equal to half of your Social Security benefits.

But, collecting unemployment benefits never has any type of impact on the amount of Social Security you receive. If you take Social Security at age 62 and are still working, then your earned income can reduce your Social Security benefit, but because unemployment benefits are considered to be unearned income, there is no impact.

Can You Get Unemployment And Disability Consecutively

Although it is difficult to obtain unemployment and disability at the same time, can you get unemployment and disability consecutively? Meaning can you get one right after another?

In most cases, yes. You can receive unemployment and then become unable to work and obtain disability. Similarly, you can receive disability and then become able to work again and receive unemployment.

If you are currently receiving unemployment, but you have a disability policy, then you can file a claim for disability. Some disability policies are provided through an employer. If your disability policy was through your employer, then you may no longer be covered by the policy if you were terminated and are now receiving unemployment. However, some disability policies extend for a period after employment, so you may still qualify. If you have an independent disability policy, then you may be able to make a claim when you become unable to work. At that point, you will also have to inform the unemployment office that you are no longer ready, willing, and able to work. If you are seeking SSD, then you may qualify when your ability to work drops below a certain amount.
