An employee is entitled to coverage if he or she suffers an off-the-job illness, injury, or other disabling event and:

  • the employee has worked for a covered employer for at least four weeks
  • the employee works for a successor of a covered employer
  • the employee is a domestic or personal employee who works at least 40 hours per week for one employer, or
  • the employee works for an employer who has voluntarily elected to provide coverage.

When Can You Receive Both Unemployment & Long

It is unlikely that you will qualify for unemployment and disability benefits at the same time. However, there are always exceptions to the general rule.

For example, you might qualify for unemployment benefits if you are partially disabled while receiving partial long-term disability payments. Even so, it is best to talk with our long-term disability lawyer before you apply for either unemployment or long-term disability benefits.

It is more likely that you might qualify for unemployment benefits followed by long-term disability benefits or vice versa. However, the application process can be tricky. If you file a second application for benefits immediately after the termination of the other benefit, your statements from your first application could impact your second application. Your physician will need to sign off on your claim form before you even submit your application, to vouch for the fact that your injury or illness prevents you from working.

After you submit your claim, your employer or the insurance company who administers your short-term disability plan will request that you submit your medical records so that they can review them and verify that theyre consistent with your disability claim. Collecting Unemployment And Social Security Disability Benefits Simultaneously

Contrary to what you might think, it is possible to collect Social Security disability insurance and unemployment benefits at the same time. Of course, it is rather difficult to qualify for both of these benefits at the same time because the eligibility criteria are fundamentally at odds. To qualify for unemployment, you must be actively looking for a job. To qualify for a disability claim with SSDI, you must be permanently and totally disabled. Only a small handful of applicants can meet both of these criteria.

If you receive unemployment benefits, the Social Security Administration will take them into account when they examine your SSDI application. It is your responsibility to prove to the SSA that thereâs no conflict between the two benefits.

The same is true for Supplemental Security Income benefits, which are paid to disabled persons. While it is theoretically possible to receive this benefit alongside unemployment benefits, the criteria for the two programs are again largely at odds with each other. Unlike receiving Social Security retirement benefits and SSDI, receiving unemployment benefits may reduce your Supplemental Security Income benefit. What Medical Conditions Qualify For The Disability Tax Credit

The disability tax credit is different from other disability benefits plans. The above disability plans focus on how your medical condition affects your ability to work. The is not focused on your ability to work. Rather, it focuses on impairment with your daily activities.

Eligibility Criteria for the Disability Tax Credit

  • be blind
  • be in at least one basic activity of daily living
  • be significantly restricted in two or more basic activities of daily living
  • need life sustaining therapy

You will automatically qualify for the disability tax credit if your medical condition causes blindness or you to need life sustaining therapy.

To qualify as blind your visual acuity in both eyes must be 20/200 or less or your field of vision in both eyes is 20 degrees or less.

To qualify under the life sustaining therapy requirement, the therapy must be needed to support a vital function, and you must need it at least 3 times per week for an average of 14 hours per week.

The basic activities of daily living include the following:

Long-Term Care insurance pays for a variety of services for people who are unable to care for themselves due to an injury such as a paralysis from a car accident, a chronic illness such as arthritis, an acute episode such as a stroke, or a cognitive impairment like Alzheimer’s disease. Long term care services may include assistance in a home, adult day care center, an assisted living facility, or nursing home.

New enrollments into LTCi are no longer available as of February 1, 2016.

Employees who had enrolled in LTCi may continue the coverage currently in place. Employees enrolled in this coverage must pay CNA directly for their LTCi premiums.

In a situation where a person has an own occupation policy, then it could be possible to receive unemployment and disability benefits. The other important reason to not seek unemployment is that in most ERISA / GROUP disability policies, any unemployment benefits received will offset any disability benefits which are owed.

How To Apply For Short Term Disability Insurance Coverage

Many employers offer short term disability insurance coverage to employees as a group plan. Many companies even pay the full premium for their employees. A handful of states require employers to provide this coverage.

If you cannot get short term disability through an employer or other group membership, you can buy an individual policy. This can be done through an insurance agent or directly from an insurance company that offers this type of coverage.

As mentioned previously, the state of Minnesota is the only state in the union that currently offsets the unemployment benefits of those who are already receiving Social Security income. If you live in this state, your unemployment benefits may be reduced by an amount equal to half of your Social Security benefits.
