  • We are often asked: Can I collect unemployment while applying for Social Security disability insurance? The short answer is YES, but the road to obtaining SSDI is often two years or more on the long-end and a few months on the short-end. Due to the long wait and the fact that you are not working, and therefore technically unemployed, unemployment benefits are often an attractive option. Although you are unemployed by definition, collecting unemployment benefits while applying for SSDI is somewhere in the gray area of what you should not do.

    Unemployment benefits are distributed by the state you reside. In contrast, SSDI is distributed by the federal government. On one hand, when you apply for unemployment benefits you are telling your state government: I am ready, willing, able, and actively seeking employment. On the other hand, when you apply for SSDI you are telling the federal government: I am disabled and unable to work. In situations where you feel you may be able to work part-time , applying for SSDI and unemployment may be an option. By filing for both, you are signaling that while you cannot work full-time you need unemployment benefits to make up for the lack of employment while you search for alterative employment opportunities.

    You Have Paid Ei Premiums

    If you are employed in insurable employment, your employer will deduct EI premiums from your wages or salary. These premiums go into the EI Fund. There is no minimum or maximum age for paying EI premiums.

    You pay EI premiums on all your earnings up to a maximum amount. In 2020, for every $100 you earn, your employer will deduct $1.58, until your annual earnings reach the maximum yearly insurable amount of $54,200. The maximum amount of premiums to be paid in 2020 is therefore $856.36.

    Since Quebec has its own program that offers maternity, paternity, and parental benefits, the Government of Canada has adjusted the premiums accordingly for that province. In 2020, the premium rate for workers in Quebec is set at $1.20 for every $100 of earnings, up to a maximum amount of $650.40 for the year.

    After weeks of waiting and being told no, laid-off Wisconsin workers who also collect federal disability payments got some better news on Monday: They, too, can get jobless pay.

    A U.S. Department of Labor official, in a letter sent Monday to the state Department of Workforce Development , said that Wisconsin residents enrolled in the Social Security Disability Insurance program and who lost work because of the COVID-19 pandemic can qualify for special unemployment payments for workers not eligible for regular unemployment compensation.

    In a press release emailed at 9:31 p.m. Monday, DWD stated that having received awaited official guidance the department today encouraged Social Security Disability Insurance recipients whose ability to work was impacted by COVID-19 to apply for Pandemic Unemployment Assistance benefits.

    DWD said eligible applicants could receive PUA retroactive to the first week they were out of work due to COVID-19, as far back as the week ending Feb. 8.

    The DWD statement said that Gov. Tony Evers, DWD Secretary Caleb Frostman, and Democratic members of Wisconsins Congressional delegation had sent letters to the Labor Department arguing that SSDI recipients out of work due to COVID-19 should not be excluded from receiving PUA benefits, especially during a period of public health emergency.

    Yes, you can apply for unemployment benefits and long-term benefits at the same time, but it is typically not a good idea. When you file your applications for benefits, you are contradicting yourself. On the unemployment application, you state you can work. On the disability application, you state you cannot work.

    If you are terminated while on disability, you may be able to collect unemployment. However, as long as you are unable to perform your job duties, you will be unable to collect unemployment benefits. All 50 states have the same requirements for a person to be eligible for unemployment compensation. First, the individual must be physically able to work. Second, the person must available for duty. Third, the person must be actively interviewing for jobs.

    In most cases, those who are terminated from employment while out on short term disability will be able to go on and receive unemployment benefits. This is because they are likely to recover from their disabling condition sooner rather than later and, therefore, be able to perform their job duties. Those who are terminated while on long term disability, however, may remain unable to work. Because of this inability to retain substantially gainful employment due to disability, a person would be unable to collect unemployment.

    Should you be terminated while on disability and be eligible for unemployment benefits, you should file for these benefits as soon as you recover. Because the amount of wages you earned in the year you seek to collect benefits may be affected by your disability leave, you may be able to use an alternate base year. The alternate base year set by your date of disability will allow you to qualify for unemployment benefits based on what you made in a normal year that was not affected by your disability.

    What Do Disability Experts Advise

    Many Social Security disability lawyers advise against collecting unemployment benefits when applying for Social Security disability. One reason is that they know how many administrative law judges who work for Social Security look at people applying for both benefits at the same time: suspiciously. Some judges will outright deny the disability claims of any applicants who are collecting unemployment benefits.

    Other disability advocates point out that there are situations where an older person could be legitimately entitled to disability benefits due to a “medical-vocational allowance” even though they are able to do some work.

    For instance, let’s consider a 55-year-old person who has been limited to desk work because of a severe spine condition. Social Security will give them a “sedentary RFC.” But assume this person has always done heavy labor and doesn’t have any desk job skills. According to Social Security’s rules, because of their age, past job skills, and education, they aren’t expected to learn how to do a sedentary job, so they should be approved for disability benefits. In that case, the individual can collect disability benefits, but could actually do some sedentary work . So if this person collects unemployment compensation while they wait for a disability decision, there’s no real conflict because they are, at least in a sense, ready and able to work.

America is one messed up place!
