How can you tell if you’re eligible to receive unemployment? Each state sets guidelines that determine whether an individual will be eligible for unemployment benefits, and how much compensation they will receive.

There are eligibility requirements to qualify for unemployment benefits, including having worked a certain number of weeks for a certain number of hours each week. Those guidelines also determine how many weeks of benefits an unemployed worker can collect.

You’ll find detailed information regarding eligibility criteria on your state unemployment website. In most states, you will need to have worked for a certain period of time, met minimum earnings requirements, and have lost your job through no fault of your own. If your claim is denied or contested by your employer, you can appeal the denial.

But even if youve been terminated for cause, dont assume youre out of luck. You may be able to collect, depending on the circumstances, and whether or not the termination was justified. Its worth it to learn about your rightsincluding your right to appeal a denial of your unemployment claimsbefore you give up on the idea of filing for benefits.

Weekly Claims And Work Search Requirements

Q) How do I file my weekly claim?

A) To file a weekly claim, log in to your account. You must file a weekly claim for any week that you want payment, even if your eligibility is being decided or you have an appeal pending. Answer all required questions on the weekly continued claim.If you need assistance with your claim, call UI Customer Service at 1-866-239-0843 between 8 a.m. and 4:30 p.m. Monday through Friday.

Q) When should I file my weekly claim?

A) The current week is the week that just ended on Saturday. Weekly claims must be filed 8:00 a.m. Sunday through 5:30 p.m. Friday for the prior week only. This means individuals have six days to file the previous week’s claim. Weekly claims can be filed online using a mobile device or computer. Have this information available when filing your weekly claim: Social Security Number, PIN, total amount of gross wages earned during the week, and total amount of gross holiday pay, gross vacation and severance, if received. Delay in filing your weekly claim could result in denial of benefits.

How Do I Return Unemployment Benefits I Shouldn’t Have Received

If you received unemployment benefits you were not eligible for , we will send you a notice. It is important to repay this benefit overpayment as soon as possible to avoid collection and legal action. After receiving a notice, visit Benefit Overpayment Services to learn how to repay an existing overpayment.

If you want to repay these benefits before receiving a notice, review the following:

  • Benefit check not cashed Return the original check to the EDD.
  • Benefit check cashed Send a personal check, cashier’s check, or money order made payable to the EDD.
  • Debit card If the funds are still on your card, transfer them to your bank account and then repay them by sending a personal check, cashier√Ęs check, or money order made payable to the EDD.

Include a letter with the following information:

  • Name.
  • Social Security number or EDD Customer Account Number .
  • Week or weeks that the returned payment applies to.
  • Reason for returning the benefits.
  • Date you returned to work .
  • Gross earnings for each week of benefits being returned .

How Does Unemployment Work

Unemployment compensation receives the bulk of its funding through taxes paid by employers, and each state runs its own unemployment program. States have autonomy regarding who can receive unemployment benefits, for how long, and the amount of compensation.

File For Unemployment Benefits

If you recently lost your job through no fault of your own, are unable to work due to a natural disaster or quit for good cause related to the work or the employer, you may be eligible to receive unemployment benefits. Eligible claimants may receive up to 20 weeks of unemployment insurance benefits through the state.Before applying, check to see if you qualify for unemployment benefits.

Why Did I Receive A Section 1277 Letter

If you received a Notice of Determination of Invalid Claim, Section 1277 after applying for a new claim, this means you did not work or earn enough wages over the past year to qualify for a new regular unemployment claim.

If your new claim is invalid, you may still qualify for a federal extension on your prior claim. For more information, visit Benefit Year End.

If you received a new debit card from Bank of America that you did not request, it could be because:

  • You recently submitted an application with a different name than what we had on file.
  • You verified your information through ID.me using a different name than what you provided on your unemployment application.

This change requires Bank of America to issue a new debit card to match the updated name we have on file. For example, if you provided the name Mike Doe when you first applied, but then verified through ID.me as Michael Doe later, we will update your records to Michael Doe and a new debit card will be issued for that name.

Important: Use your new card only. All funds from the old card will be transferred to the new card, and you will not be able to use the old one. No further action is needed.

  • Update 12/29/20: The federal government has extended the federal unemployment benefit programs available through the CARES Act for an additional 11 weeks. Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation will be available through March 14, 2021, with qualified claimants benefits fully phasing out by April 5, 2021. Federal Pandemic Unemployment Compensation benefits will resume with $300 weekly payments until March 14, 2021.

  • To receive these extended federal benefits, continue to certify weekly while unemployed. To allow your fellow New Yorkers to reach NYS DOL representatives about regular matters, please do not call to inquire about the federal program extensions at this time.   • Waiting weeks for unemployment benefits have been waived during this crisis. If youve seen the term waiting week on your payment history, it is a relic of our existing system and does NOT impact your benefits.
  • To collect regular unemployment insurance benefits, you must be ready, willing, and able to work. WASHINGTON, DC The U.S. Department of Labors Employment and Training Administration has issued updated guidance that provides implementation information to states regarding two unemployment insurance programs: Federal Pandemic Unemployment Compensation and Mixed Earner Unemployment Compensation .

On Dec. 27, 2020, President Trump signed into law the Consolidated Appropriations Act of 2021, reauthorizing the payment of FPUC benefits and creating the new MEUC program. Todays guidance provides states with important information about the extension of FPUC program authority, and the initial program authorization of MEUC.

In addition to reauthorizing FPUC, the new law also modifies the program, which expired July 31, 2020. FPUC now provides $300 per week to supplement benefits for weeks of unemployment beginning after Dec. 26, 2020, and ending on or before March 14, 2021. FPUC is not payable with respect to any week during the gap in applicability, that is, weeks of unemployment ending after July 31, 2020, through weeks of unemployment ending on or before Dec. 26, 2020.

It is not yet clear whether this restrictive definition will apply to benefits under the temporary Pandemic Unemployment Assistance program established by Congress in the Coronavirus Aid, Relief, and Economic Security Act.

    You Don’t Account For Taxes

    Don’t forget that unemployment earnings count as taxable income, including the extra $600 per week provided by the stimulus bill. Federal income tax is withheld at a rate of 10%, and you may owe state taxes depending on where you live.

    You can elect to either have withholdings taken out from the start of your benefit period, or you may be required to make quarterly estimated payments. Either way, make a plan for paying taxes on your unemployment benefit.

    Ultimately, “Unemployment insurance is an earned benefit,” Evermore says. “People have an entitlement to it if they lose work through no fault of their own. People should see it that way and do everything they can to access their benefit.”
