Uia Calls For Expanded Fed Overpayment Waivers 1099

The Unemployment Insurance Agency announced Monday that they have called for expanded federal overpayment waivers, and say claimants 1099-G forms will be issued by the end of February.

According to the UIA, they are calling on their federal partners for a resolution on behalf of the states workers in response to, notices for unemployment benefits overpayments and collection activity related to non-fraudulent claims filed during the pandemic.

They state they have requested additional waivers from the U.S. Department of Labor to make sure that no Michiganders are negatively impacted.

We continue to work with our partners on an issue that other states across the country are also dealing with and we call on Congress to quickly devise a solution that will help Michigans working families, stated UIA Director Julia Dale.

The UIA says as part of their approach to the waivers issue, they have, endorsed a National Association of State Workforce Agencies letter sent to Congressional leaders that encourages Congress to pass legislation that would allow states to waive non-fraudulent pandemic-related unemployment compensation overpayments.

Additionally, the UIA states that they are advising benefit recipients that programming changes related to waivers granted in 2021 will result in the issuing of the 1099-G tax forms towards the end of Feb.

They say they asked for and have received an extension from the IRS.

Waivers do not relieve a claimant of their income tax obligations, Assendelft said.

There is however a place on your taxes to record your repayment of government funds. The Internal Revenue Service addresses repayments on page 71 of its federal income tax guidance issued to the public for tax year 2021, noting that a taxpayer can deduct a repayment from their income.

Who Gets A Restitution Waiver Remains Unclear

The state hasnt yet determined when it will resolve the number of restitution waivers it will issue, or how many people will have to repay benefits.

The states accounting shows $8.5 billion in unemployment benefits it shouldnt have paid since the start of the pandemic, including $2.8 billion paid in fraudulent claims, according to a recent audit.

The remaining $5.7 billion represents claims that were later ruled ineligible due to rule changes, UIA error or other reasons. At least 758,000 unemployment claims had to be reconsidered and approved after the state disclosed it hadnt initially followed federal guidance. Roughly half have received waivers of repayment so far.

The agency has not yet made clear how many of those claims have yet to be resolved.

The recent federal labor ruling will allow the state to issue more waivers, but many details remain in flux, including when an individual will learn a waiver has been granted.

UIA spokesperson Nick Assendelft told Bridge this week that the state is reviewing the 40-page federal document on which people who received Pandemic Unemployment Assistance and other temporary programs through last September are waiver eligible. Roughly 70 percent of the 3.46 million residents who filed for unemployment during the pandemic collected temporary benefits.

Does Michigan Participate In The Combined Federal/state Filing Program

Yes, Michigan participates with the CF/SF Program. This means that the Internal Revenue Service shares certain income record form information, automatically satisfying a taxpayer’s filing requirement with Treasury. The exception to this general rule is Form 1099-NEC. While Form 1099-NEC is included in the CF/SF Program beginning tax year 2021, Michigan requires the state copy be filed directly with Treasury.

In order for a taxpayer or their service provider to take advantage of this program, they must apply with the IRS and remit eligible income record forms electronically through the Filing Information Returns Electronically System.
