Filing For Weekly Benefits
Once youve filed your initial claim for unemployment benefits, you can access your account each week and apply for benefits, check on the status of the claim to see when payment was made, and review how much unemployment compensation is left in your account. Mark your calendar with the day you need to file. Payment won’t be made unless you file for benefits each week for which you’re eligible.
While receiving unemployment, you must be actively willing to work and actively looking for work. The definitions of actively willing to work and actively looking for work also vary by state.

History Of Fpuc Authorization And Funding
As noted, additional unemployment benefits of $600 per week were originally authorized by the CARES Act through July 31, 2021. This was followed by the Lost Wages Assistance program, authorized by an Aug. 8, 2020, presidential memo and subsequent Department of Labor guidance.
LWA funds, which were expected to last from Aug. 1, 2020, to Dec. 27, 2020, were depleted by Sept. 5, 2020. The signing of the Consolidated Appropriations Act of 2021 into law on Dec. 27, 2020, restarted the FPUC program and authorized $300 FPUC payments beginning after Dec. 26, 2020, and ending on or before March 14, 2021.
The American Rescue Plan Act of 2021, which became law March 11, 2021, extended FPUC payments through Sept. 6, 2021. ARPA also provided a waiver of federal income taxes on the first $10, 200 in unemployment benefits received in 2020.
According to the U.S. Department of Labor, regular unemployment benefits replace about 38% of a worker’s wages, on average.

Work Search Waiver Expiration
The most immediate impact on eligibility for unemployment benefits is the expiration of the stateâs Work Search Waiver and, for many, the requirement to register for job search assistance.
For years, law required individuals to actively pursue new work opportunities to remain eligible to receive benefits.
Gov. Ron DeSantis continued to extend the expiration of this waiver in an effort to ease the burden of returning to the workforce during the pandemic.
On May 12, Dane Eagle, executive director of the Florida Department of Economic Opportunity, announced the state would allow the waiver to lapse as business owners voiced frustration with hiring new employees.
Many business owners say theyâre struggling to hire new workers because people are âreceiving more on unemployment than they would on the job,â although economists say itâs not that simple.
Federal Reserve Chairwoman Janet Yellen said the changing dynamics of the nationâs workforce is not to blame entirely on extended unemployment benefits, but rather a number of factors, including people moving to new cities, people âupskillingâ into new and more stable career fields, and competition among industries that are offering higher wages, better benefits, and hiring incentives.

Once I Start Receiving Benefits What Do I Have To Do To Remain Eligible To Receive Benefits
Once you apply for benefits, you will need to periodically certify that you are ready, willing, and able to work in order to continue receiving benefits, and you may need to provide evidence of your job search. Most states allow for certification by telephone, mail, or Internet. Click on your state in the map at the bottom of this page for a link to certify for UI benefits online.
Most states require you to continue following the normal procedures for weekly or biweekly certifying for UI benefits, even if you are not receiving the benefits because the state agency has determined that you are ineligible. If you do not follow the certification process, you may win your appeal on eligibility but not be able to collect the benefits for the time you were challenging the determination.

What If I Am Denied Benefits How Can I Appeal A Denial Of My Claim
You could be denied benefits for a variety of reasons, including not completing paperwork in a timely manner, not having enough wages during your base period, or being disqualified because you were fired from your last position due to misconduct, among many others.
If you are denied unemployment benefits, Florida allows you to file an online appeal, by mail, or by fax. You will have 20 days to do so from the time you receive your determination notice. After receiving your appeal, the agency will schedule a telephone hearing and an appeals referee will rule on your case. A decision will then be mailed to you.
If you disagree with this decision, you can make an appeal to the Unemployment Appeals Commission, again within 20 days after you receive your notice. Commissioners will review your information and issue another written decision.
If you disagree with the Commissions findings, you can appeal that decision to the Florida District Court of Appeal.
What If I Am Denied Benefits
If you are denied benefits or disagree with your monetary determination, you have the right to appeal that decision.
You can submit a request for a hearing in person or by writing to your local office. Requests for Appeals must be filed in person at the local office or be postmarked within ten days of the date of the Notice of Determination. Most of the time, an appeal hearing is scheduled within a few weeks after the appeal is filed.
All parties are mailed a Notice of Hearing that provides the time, date, location, and issues to be covered in the hearing. You may request permission to participate in the appeal hearing by telephone.
While your claim is under appeal, you should continue requesting your weekly benefits and do all things necessary to maintain your UI eligibility. If it is determined that you are eligible for benefits, you will receive benefits only for the weeks for which you requested your weekly benefits timely and met all other eligibility requirements.
Although the hearing is not a trial, it is an administrative proceeding and somewhat formal. Its purpose is to find facts and resolve issues. Witnesses are sworn in, questioned and cross-examined by an appeals referee. Each side presents its version of the facts. The hearing is recorded and the recorded testimony is included with documents and other evidence as part of the formal record of your appeal. After the hearing, the appeals referee decision will be mailed to the parties involved.
