Michigan Unemployment 2021 Tax Form Coming Even As Benefit Waivers Linger

Michigan unemployment officials say 1.2 million residents about 25 percent of the states labor force should receive a 1099 tax form by the end of February, a month late, so they can file annual income taxes.

But even as workers await the document, the state has yet to decide whether thousands of jobless workers will have to repay up to $5.7 billion in unemployment benefits the state says it paid in error during the pandemic.

That could leave some taxpayers saddled with reportable income on 2021 federal and state taxes that they may later have to return to the state.


Some question how many residents may face garnishment of their wages or tax refunds if they are later ordered to repay overpayments, even if they obtained benefits in good faith and requested a repayment waiver.

If I were somebody who collected benefits in 2021 I would be very upset and very confused, said David Blanchard, an Ann Arbor attorney who has filed a class-action lawsuit against the Unemployment Insurance Agency for changing benefit eligibility rules a year after payments were made.

The state thinks you owe it back, but you have to record it on your taxes as money received, he said. And then it might be waived, too.

UIA received a federal extension in January, allowing it to delay distribution of 1099-G forms which report income received from a government entity for one month.

The first batch of tax refunds went out to single people without dependents, whose tax returns are the simplest. The IRS said that married couples and heads of household taxpayers who claim children or other dependents will wait longer to see tax refunds.

The next set of refunds will come in “mid-June,” the agency said, adding: “The review of returns and processing corrections will continue during the summer as the IRS continues to review the simplest returns and then turns to more complex returns.”

Many of these taxpayers are anxiously waiting refunds. Nicholas Lilley, a student and social media manager living near Akron, Ohio, estimates he’s due at least $2,000. Lilley and his husband both lost university jobs last year and received unemployment benefits. Lilley has since been re-hired part time. His husband has not, and his unemployment benefits are set to expire at the end of June.

The couple, who have been delivering food for DoorDash to earn additional money in preparation for the benefits cutoff, damaged their car on a recent delivery. Lilley was hoping to use his tax refund to pay for repairs, but he’s still waiting.

“We had thought, after we filed our taxes, that in May we’d get it,” he said. “I’m like, how far is it going to be?”

Although the IRS says there’s no need to file an amended return, some early filers may still need to, especially if their recalculated AGI makes them eligible for additional federal credits and deductions not already included on their original tax return.

The IRS, for example, can adjust returns for those taxpayers who claimed the earned income tax credit and, because the exemption changed their income level, may now be eligible for an increase in the tax credit amount which may result in a larger refund. About The Unemployment Compensation Exemption

The American Rescue Plan Act, which was enacted in March, exempts up to $10,200 of unemployment benefits received in 2020 from federal income tax for households reporting an adjusted gross income less than $150,000 on their 2020 tax return. If you received more than $10,200 in unemployment compensation last year, any amount over $10,200 is still taxable.

The IRS has identified over 10 million people who filed their tax returns before the plan became law and is reviewing those returns to determine the correct amount of tax on their unemployment compensation. For those affected, this could result in a refund, a reduced tax bill, or no change at all.

The IRS started recalculating impacted tax returns with returns from single taxpayers who had relatively simple returns, such as those filed by people who didn’t claim children as dependents or any refundable tax credits. The tax agency then shifted to joint returns filed by married couples who are eligible for an exemption up to $20,400 and others with more complex returns.

Remember, though, that the tax exemption only applies to unemployment benefits received in 2020. So, if you receive unemployment compensation in 2021 or beyond, expect to pay federal tax on the amount you get.
