In July, Governor Kathy Hochul announced that NYSIF distributed more than $550 million over the past year to New York businesses through its discounts and dividends programs. NYSIF offers discounts to companies that it insures directly and that exhibit robust worker safety protocols. It provides dividends for companies that belong to a NYSIF safety group, where employers in similar industries pool together to reduce workers’ comp costs. The program is a part of Governor Hochul’s mission to provide relief and cost savings to New York businesses.

Ten months into the coronavirus shutdown, it still takes a stroke of luck to get someone on the phone in the New York state unemployment office, according to many frustrated people who need answers.

Unable to access benefits, thousands of jobless people are relying on each other for advice and insider tricks.

Lenna Bennett said the most popular question on the unemployment Facebook group she moderates is this: What is the contact number for the New York State Department of Labor?

The answer is 888-209-8124.

In a time when most people no longer memorize phone numbers, unemployed New Yorkers can quickly recite that one.

What theyre looking for is an inside number, a short cut to waiting for hours on hold or being disconnected.

Some people call Gov. Andrew Cuomos office directly and hope to be transferred. They call senators and Assembly members.

They pass along magic tricks: Enter your social security number and pin incorrectly three times and you get transferred to a person.

Angela Alaimo, a union laborer from Malone, learned this from the group: Hit the prompt that asks if you need a translator, even if you dont speak another language.

An agent who works on the translator line was able to fix her claim.

Liability Conditions By Business Type

General Business

General business employers are liable on:

  • The first day of the calendar quarter you pay remuneration of $300 or more, – or –
  • The day you obtain any or all of the business of a liable employer

Non-Profit Employers

Non-profit employers are liable:

  • On the first day of the calendar quarter you pay remuneration of $1,000 or more, – or –
  • As of the first day of the calendar year you employ four or more workers on at least one day in each of 20 different weeks during that year or the prior calendar year

Household Employers

Employers of household help are liable the first day of any calendar quarter you pay remuneration of $500 or more.

Agricultural Employers

Effective January 1, 2020, employers of agricultural labor are liable as of:

  • The first day of any calendar quarter after January 1, 2020 in which you pay remuneration of $300 or more, – or –
  • The day you obtain any or all of the business of a liable employer

    New York extends unemployment benefits

    To receive unemployment insurance benefits, you need to file a claim with the unemployment insurance program in the state where you worked. Depending on the state, claims may be filed in person, by telephone, or online.

    • You should contact your state’s unemployment insurance program as soon as possible after becoming unemployed.
    • Generally, you should file your claim with the state where you worked. If you worked in a state other than the one where you now live or if you worked in multiple states, the state unemployment insurance agency where you now live can provide information about how to file your claim with other states.

    Employers Must Go Online to Review Them To Protest Charges and Report Fraudulent Claims

    The New York State Department of Labor is no longer mailing out Notice of Experience Rating Charges or Notice of Benefit Reimbursement Charges statements to employers. Going forward employers will need to monitor their account information online through the Departments website.

    Employers should be carefully monitoring their Notice of Experience Rating Charges to ensure all of the individuals who are collecting benefits are eligible to be doing so otherwise these charges could increase your UI rate in future years. If you see, for example, a current employee listed as collecting benefits, that may be a red flag. Employers can also advise employees to report any unusual documents or communications from the NYSDOL for claims they haven’t filed.

    If you identify a fraudulent claim and report it, the state will audit it and then credit your account.

    How Do You Appeal An Unemployment Benefit Denial In New York

    If you are denied benefits for any reason, you have the right to appeal the decision by requesting a hearing in front of an impartial Administrative Law Judge of the New York Unemployment Insurance Appeal Board.

    You can request a hearing online by sending a message to the state through your NY.gov account. You may also request a hearing by completing a Claimant Hearing Request Form and mailing it to: New York State Department of Labor, PO Box 15131, Albany, NY 12212-5131.

    Your hearing request must be made within 30 days from the date of your determination notice. If a ruling is in your favor, you will be awarded back benefits for the period you waited for a decision. You have the right to bring an attorney to your hearing to represent you.

    If you disagree with the results of the hearing, you can appeal the decision to the Unemployment Insurance Appeal Board. You must file that appeal within 20 days after the ALJs decision was mailed to you.

    If you still disagree with that decision, you can file a further appeal with the Appellate Division of the New York State Supreme Court.

    How To Apply For Unemployment In New York

    NYS Unemployment Work Search Activity Requirements

    To apply for benefits, you must log in to the New York Department of Labor website.

    You can also apply by calling the Telephone Claims Center at 209-8124. New York is currently offering extended telephone filing hours:

    • MondayThursday, 8:00 a.m. to 7:30 p.m
    • Friday, 8:00 a.m. to 6:00 p.m.
    • Saturday, 7:30 a.m. to 8:00 p.m..

    When you file a claim, you will be prompted to set up a Personal Identification Number or PIN. You will use this pin when you call the New York unemployment number to claim your weekly benefits or to certify your benefits.

    To file a New York unemployment claim, you will need:

    • your last employers contact information
    • the last day you worked for them

    When And How Will I Be Paid My New York State Unemployment

    It takes about three to six weeks from the time you file New York unemployment claims to when you receive your first payment due to processing and reviewing of your New York unemployment application.
