One of the requirements of collecting unemployment is that you must be available and actively seeking work. If you need help looking for a job, the Nevada JobConnect Career Center has a variety of resources to point you in the right directions.

Are You Available And Actively Searching For Work

To keep collecting unemployment benefits, you must be able to work, available to work, and looking for employment. If you’re offered a suitable position, you must accept it.

Whether a position is suitable depends on several factors, including your experience and previous earnings, how long you’ve been out of work, and your chances of getting work in your usual occupation..

In Nevada, you will be considered “available” for work only if you don’t have any restrictions preventing you from taking a job immediately, if one is offered. For example, you must be able to make arrangements for childcare and transportation.

You must engage in a good faith search for work, of the sort that a reasonable and prudent person who is anxious to find a job would conduct. You should keep records of the employers you contact, the dates you made contact, and the outcome. The ESD may ask you to provide contact information for employers you’ve contacted at any point during your claim.

What Is Voluntary Quit

An individual who voluntarily leaves his employment or who is determined to be the moving party in the separation, even if the individual felt they had no alternative, or the employer was trying to force them out. In addition, persons who retire from employment, voluntarily or involuntarily, are considered to have quit.

Weekly Certification And Maintaining Eligibility

Once your unemployment claim has been approved, you must certify your status on a weekly basis in order to continue to receive benefits. This is to prevent people from receiving benefits even after theyve found new work.

The process of certifying the claim is also known as filing a weekly claim. You can file by telephone or online. You may request permission to file a weekly claim by mail. You must show a compelling reason why you need to file by mail.

If you dont, your unemployment benefits payments may be delayed. The weekly certification process requires you to answer questions meant to determine if you have maintained your eligibility status. The DETR will want to know whether:

  • You are looking for work
  • You are able and available to work
  • You started or quit a job
  • You refused an offer of suitable employment
  • You earned any wages during the week youre certifying

If you earned any money, you should report it for the week in which you earned the money, not when you received a payment. There are a variety of forms of payment that the state requires you to report including commissions, tips or pensions paid by a base period employer. Some forms of income are exempt from the reporting requirement, like Social Security income.

If you are unsure about whether you are required to report it, refer to the unemployment handbook or call a claims center. The wages you earn may affect the amount of WBA you receive when after certifying.

When Do Unemployment Benefits Get Deposited

Unemployment Las Vegas

In most cases, once you complete your initial application and its approved, youll receive your first benefits in about two to three weeks if you use direct deposit, sometimes a bit longer if you have your check mailed to you. After that you can often expect to receive pay once a week if you correctly applied the week before. In some states or some circumstances that may vary, however, so no need to panic if your payments come a bit later. If youre concerned that its been too long, reach out to your local unemployment office.

Overpayment Of Unemployment Benefits

Overpayments can be caused by a number of factors, including simple Division error, failure to provide accurate facts about the separation, a reversal by an Appeals Referee or the Board of Review, or information being provided late by the employer that causes the Division to reverse or make changes to a determination.

The Employment Security Division will seek repayment of all overpayments, regardless of who is at fault, but overpayments can be appealed like any other issue.

Pursuant to NRS 612.365, the Division has discretion to waive the unemployment if:

  • The overpayment was not due to fraud, misrepresentation or willful nondisclosure on the part of the recipient and
  • The overpayment was received without fault on the part of the recipient, and its recovery would be against equity and good conscience.
  • Pursuant to NRS 612.445, Overpayments caused by misrepresentation require repayment and result in a period of disqualification of up to 52 weeks.

If you want to dispute your overpayment, file an appeal with the Employment Security Division.

What Is The Base Period For Unemployment In Las Vegas

59K file for unemployment in NV

Almost every state determines your eligibility for unemployment insurance by looking at your work history and earnings during a âbase periodâ.

As we mentioned above, you must have been employed in Nevada during the previous 12 months to be eligible.

But it gets a bit more specific than that with the base period.

Whenever you apply for unemployment, the state will look at your earnings during the previous five calendar quarters .

And then they will count only the earliest four out of those five quarters. So, if you apply for benefits on May 1, 2022, they will look at your income during Jan 1 to Dec 31, 2021.

During those four quarters, you must have earned at least $400 during your biggest income quarter.

You must also meet one of the following two base period requirements to be eligible for unemployment.

Highest income quarter vs. total income

Whatever you earned during your biggest income quarter, your total income during the base period must be one-and-a-half times more.

Letâs say you earned $6,000.00 during Jan 1 – Mar 31, 2021, and thatâs your highest income quarter in 2021. And your base period is all of 2021.

That means that during your entire base period , must earn at least $9,000.

At least three quarters of income

If you didnât earn one-and-a-half times your highest quarter, then you can show that you earned income during at least three of the four quarters in your base period.

What If I Quit My Job Or Got Fired

One of the requirements of unemployment insurance is that you must be out of a job through no fault of your own.

That doesnât mean youâre automatically disqualified if you got fired or if you quit. But there are certain factors to consider.

If you were fired because you were no longer a good fit for the job due to lack of skills or training, then you might still be eligible for benefits.

However, if you were fired because of some sort of misconduct, then you won’t be able to collect unemployment.

If you quit your job, generally you would not be eligible for unemployment.

But if it was a situation where you had no choice but to quit, then it’s a different consideration.

For example, if you had to quit because of a hostile or dangerous work environment, or you were subject to sexual harassment, then you could still be eligible.

For all the details about eligibility under specific circumstances, check out the NV Unemployment Claimantâs Guide.

Looking For A Job While Collecting Unemployment Benefits

One of the requirements of collecting unemployment insurance in Nevada is that you must conduct an ongoing effort to find another job. In addition to your own efforts, you must register with a Nevada JobConnect office. Failing to do so could delay or deny your benefits. If you have any questions about job hunting, filing a claim or other inquiries regarding Nevada unemployment, contact a Nevada unemployment office as soon as possible.

When you meet with a Job Connect representative, you will be advised of the specific job search requirements for the type of work you are seeking, as well as providing you with labor market information, prevailing wages and distances you may need to travel. You will also be advised if there is an issue that may affect your benefits eligibility, so that you have a chance to correct it. Some of these might be related to transportation, childcare or the refusal of suitable work.

During the meeting, you will also be given eligibility assessments by reviewing work search activities and techniques, discussing and developing a work search plan and a reemployment plan and working on your resume, if needed. You will also be able to take advantage of job matching services, referrals to open job orders and practicing interviewing techniques.

If you refuse to take part in reemployment services and do not have a justifiable reason for the refusal, it could result in a delay or denial of benefits.
