As in many other states, Georgias unemployment law states an injured worker cannot receive unemployment benefits while also receiving temporary total disability or temporary partial disability .

In other words, an employee currently receiving workers compensation benefits is NOT eligible for unemployment benefits.

However, many injured workers have to fight in order to obtain their workers compensation benefits. While waiting for their court date, the injured worker can apply for unemployment benefits. If the injured worker receives unemployment benefits, he or she will at least obtain some financial assistance while waiting to receive their workers compensation benefits.

If an injured worker is successful in obtaining workers compensation benefits after already receiving unemployment benefits, their employer could receive a credit for the unemployment benefits already paid to the injured worker. However, for their employer to receive this credit, they must follow specific guidelines in the Workers Compensation Act.

Start Receiving Your Benefit Payments

If you are approved for unemployment benefits, you will receive your benefit payment according to the payment preference that you selected upon applying for benefits.

Depending on your state, your payment options will include all or two of the following:

If you select Direct Deposit, you will need the following information:

However, if you do not make a selection for a payment method, you are likely to receive your benefits on an unemployment debit card.

You are allowed to switch payment methods later, once you start receiving benefits.

How To Appeal A Denial Of Unemployment Benefits In Georgia

If your claim for unemployment is denied, you have 15 days to appeal the decision with the Appeals Tribunal. Your request for appeal must be in writing and mailed or faxed to a GDOL Career Center.

After receiving your appeal request, the GDOL will schedule a hearing before the Appeals Tribunal. At your hearing, the Appeals Tribunal will receive evidence from both you and your employer. The Appeals Tribunal will then issue a written decision and send you a copy by mail.

If you disagree with the decision, you may file an appeal with the Board of Review by the date stated in the Appeals Tribunal’s decision. The Board of Review will review the entire record, but will not hold another hearing. If you disagree with the Board of Review’s decision, you may appeal to the Georgia Superior Court in the county in which you worked.

If you have worked or earned wages in the state of Georgia in the past 2 years, you can file a Georgia Internet claim at this site. Information for individuals who cannot file a Georgia claim by Internet:

Like many other states, Georgias state unemployment system was not prepared for the sheer volume of UI applications it received in a month.

We have never seen this kind of volume before, obviously, Cartwright, the DOL spokesperson, told Vox. Before the coronavirus hit, the department processed 5,000 claims per week on average. Last week, it processed 300,000 claims.

During the 2008-2009 recession, we did a million claims in 2009, Cartwright said. Now, we did a million claims in a month.

Georgias Labor Department has fewer than 1,000 employees to process the 1.1 million claims its gotten in the past month. Thats less than half the staffing capacity the department had in 2009, according to Cartwright. And Georgia is not alone in this. The staggering fallout of an economic crisis on a par with the Great Depressionis running into many state programs that were underfunded and out of date to begin with.

The key aspects of UI were weak going into this, Andy Stettner, a senior fellow at the Century Foundation,told Vox recently. The IT infrastructure was weak most states hadnt gotten off these ancient mainframes. The concern is theyve never done anything with this type of volume.

That was part of the reason the state issued the emergency rule to put the burden of filing on many employers it was an attempt to speed things up. But it has also created confusion for some in desperate need of these benefits.

What Are The Requirements To Qualify For Georgia Unemployment Benefits

To be eligible to receive Georgia unemployment compensation, you must meet the following requirements:

  • You must be completely separated from your job or have experienced a significant reduction in the number of hours you are working.
  • If you are working part-time or on a temporary basis, you are earning less than what your weekly benefit amount would be.
  • You must make a reasonable and sustained effort to find meaningful and suitable full-time work. You will be required to document your search efforts when you file for unemployment insurance every week. If you find part-time work, you must keep searching for full-time work. You must make at least three contacts each week.
  • You must be able to prove that you are a lawful US citizen, a permanent resident, or a lawfully present noncitizen.
  • You must have earned wages in at least six months of your base period. The standard base year consists of the first four completed calendar quarters in the 15 months leading up to a Georgia unemployment claim filing. You must also have earned wages that are at least $1,134 in each quarter, and your total amount of wages is 1.5 times or higher than the wages you earned in your highest base period quarter.
  • If you live in another state but want to collect benefits in Georgia, you must register with your new home states workforce agency and follow that states requirements for conducting a job search. If you dont do this in a timely manner, your benefits could be delayed or stopped.
  • Are You Available And Actively Searching For Work

    To maintain your eligibility for unemployment benefits, you must be able to work, available to accept a job, and looking for employment. If you’re offered a suitable position, you must accept it. For the initial unemployment period, whether a position is suitable depends on several factors, including the level of skill and training required, the similarity between the work and your previous employment, how much the position pays, and the distance between the job site and your residence. However, after ten weeks of collecting unemployment, you will be expected to accept a position that pays at least 66% of the average hourly wage you earned during the highest quarter of your base period .

    You must conduct a reasonable search for work, which includes contacting at least three new job contacts each week. You should keep a record of your job search efforts, including the employers you have contacted, the dates you made contact, and the outcome. The Georgia Department of Labor may contact you or your employer contacts to verify your efforts.

    To be able to take this credit, however, the injured workers employer must correctly complete and file a WC-243 form with the State Board of Workers Compensation within 10 days before the workers compensation hearing. The employer also has to send a copy of the form to the injured workers attorney, or the injured worker if he/she is unrepresented.

    In practice, some employers fail to file the correct form in time with the State Board. Even if filed, they may make errors completing the form, or fail to serve a copy to the employee and/or the employees attorney.
