How Are Benefits Calculated

The formula and method to calculate benefits are very state-specific. About half of the states use the highest quarter method in which the calendar quarter in which your earnings are the highest is taken into consideration. In other states, your income throughout the base period is summed up to check whether or not youre eligible.Unemployment is computed and can range from one-half of what was your weekly pay at the time of the discharge up to your states maximum benefit. You will have to verify with your states unemployment office to see the highest payout for your state. For further details refer to the unemployment benefits article.

To calculate your weekly benefits amount, you should:

  • Work out your base period for calculating unemployment.
  • Take a look at the base period where you received the highest pay.
  • Calculate the highest quarter earnings with a calculator.
  • Calculate what your weekly benefits would be if you have another job.
  • Calculate your unemployment benefits for every week if the partial gross income is different.

South Carolina Supreme Court Upholds Governors Early Termination Of Federal Unemployment Benefits

In a recent opinion, the South Carolina Supreme Court unanimously agreed with the lower courts dismissal of a lawsuit brought by four individuals to challenge Governor Henry McMasters decision to end federal unemployment programs early.

In May, Governor McMaster issued a directive to South Carolinas Department of Employment and Workforce to opt out of participating in the federal unemployment programs that were implemented in response to the pandemic. Specifically, programs including the Pandemic Emergency Unemployment Compensation and the Pandemic Unemployment Compensation established by the CARES Act provided additional weeks of benefits for workers who had exhausted their regular benefits, as well as an increase in the amount of regular unemployment benefits.

While South Carolinas participation in the federal unemployment programs was set to run through early September, Gov. McMaster determined that the state should opt out of the additional benefits by the end of June 2021. Citing workforce shortages and concerns that the expanded federal programs disincentivized workers from going back to work, Gov. McMaster issued this plan with the stated goal of accelerating the economy by transitioning individuals from unemployment to employment.

How Much Money Will I Receive In Unemployment Benefits

The maximum weekly unemployment benefit in South Carolina is $326 and the minimum is $42. It’s important to mention that unemployment benefits can be considered taxable income, so these are pre-tax amounts.

To determine your benefit, DEW uses a somewhat complex formula based on your recent earnings, but the goal is to replace about 50% of the average worker’s weekly wage, up to the maximum. In other words, if you earned $600 per week before becoming unemployed, you should get about $300 per week from unemployment benefits.

However, the recent economic stimulus bill added $600 to every state’s maximum unemployment benefit from AprilJuly 2020, so your benefit could be much higher than the standard maximum during this time. And since the stimulus is designed to replace as much as 100% of workers’ lost income, it’s likely that a different benefit formula will be used during that time.

Are You Available And Actively Searching For Work

To maintain your eligibility for unemployment benefits, you must be able to work, available to accept a job, and looking for employment. If you’re offered a suitable position, you must accept it. For the initial unemployment period, whether a position is suitable depends on several factors, including the level of skill and training required, the similarity between the work and your previous employment, how much the position pays, and the distance between the job site and your residence. However, as time goes on, you will be expected to modify your standards and consider accepting work that requires less skill or that pays lower wages.

You must conduct a reasonable search for work, which means contacting at least four employers each week. You should keep a record of your job search efforts, including the employers you have contacted, the dates you made contact, and the outcome. The DEW may contact you or your employer contacts to verify your efforts.

How Long Will I Receive Benefits

Usually, most states permit an individual to obtain unemployment for a maximum of 26 weeks or half the benefit year. A benefit year is a period when your claim is established, and it will remain open for one year .

A few states have standardized benefit duration, while most have different durations depending the worker. In a state with varied duration, the benefit year may probably include less than 26 payable weeks. The calculation is done using this formula 26 x WBA or 1/3 BPW. Generally, the smallest amount is considered. WBA is the Weekly Benefit Amount, so 26 x WBA would be the regular weekly program. 1/3 BPW refers to the Base Period Wages, so if a person did not succeed to earn more than three times the standard benefit amount, they will be suitable for fewer weeks of coverage.
