You might be required to make payments directly to the IRS as quarterly estimated tax payments if you elect not to have taxes withheld from your unemployment benefits. This works out to a payment once every three months. You can elect to do this instead of having 10% withheld from every unemployment check, giving yourself a little bit of wiggle room when money is tight.

You might even have to make quarterly payments in addition to withholding from your benefits. You’re obligated to make estimated payments if you expect that you’ll owe at least $1,000 after accounting for all taxes withheld from all your sources of income, and if you expect that your withheld taxes plus any refundable tax credits you’re eligible for will be less than 90% of what you’ll owe, or 100% of the total taxes you paid last year.

You might want to consult with a tax professional because the whole equation can be complicated. You could accrue additional penalties if you don’t pay enough tax, either through withholding or estimated tax payments.

Taxes On Unemployment Benefits

All benefits are considered gross income for federal income tax purposes. This includes benefits paid under the federal CARES Act, Federal Pandemic Unemployment Compensation , state Extended Benefits , Trade Adjustment Assistance , Pandemic Unemployment Assistance , Pandemic Emergency Unemployment Compensation , and Lost Wages Assistance . DES reports these benefits to the Internal Revenue Service for the calendar year in which the benefits were paid.

You may choose to have federal income tax withheld from your unemployment benefit payments at the rate of 10% of your gross weekly benefit rate , plus the allowance for dependents .

The amount deducted for state income tax will be 10% of the amount deducted for federal taxes, which is currently calculated as 1% of the gross weekly benefit amount. Please Note: State income tax cannot be withheld from the $300 additional weekly benefit in Lost Wages Assistance and the $600 additional weekly FPUC benefit for regular UI claims. Claimants who received FPUC and/or LWA in regular UI will be responsible for paying any tax due on those amounts when filing state income taxes for calendar year 2020.

After selecting your tax withholding on the initial Unemployment Insurance application, you can change your withholding preferences by completing the Voluntary Election for Federal/State Income Tax Withholding form . After completing the form, submit it to DES by mail or fax.

Unemployment Taxes At The State Level

If you live in a state that has a state income tax, you may need to pay state income taxes on your unemployment benefits in addition to federal income taxes.

For states that dont have a state income tax or dont consider unemployment benefits taxable income, you wont need to pay state income taxes on your unemployment benefits. These are 17 states that dont tax unemployment benefits:

States that dont have any income taxes Alaska, Florida, Nevada, South Dakota, Texas, Washington, and Wyoming
States that only have income taxes for investment income New Hampshire and Tennessee

What If I Received A 1099

If you received a 1099-G reporting taxable unemployment benefits, but you did not collect unemployment, it could be fraud. In guidance the IRS issued in late January 2021, the IRS advised anyone who receives an inaccurate 1099-G to contact their state agency not the IRS to request a corrected form. If you are a victim of unemployment benefits identity theft, consider opting into the IRS Identity Protection PIN program. An IP PIN is a six-digit number that helps prevent thieves from filing federal tax returns in the names of identity theft victims. Visit irs.gov/identity-theft-central for more information.

What To Do If You Already Filed A Tax Return

The American Rescue Plan’s unemployment tax break is welcome relief but it cropped up in the middle of tax season. Millions of people who already filed and reported unemployment compensation were left wondering whether they missed out on the exclusion all together.

IRS Commissioner Charles Rettig urged taxpayers not to file an amended return. Instead, the agency is aiming to review already processed returns to determine who qualifies for the exclusion and issue refunds for taxes paid on up to $10,200 of benefits.

“We believe we will be able to automatically issue refunds associated with the $10,200,” Rettig told the House Ways and Means Committee on March 18. He expects to make a formal announcement “in the near future.”

Income Tax 1099g Information

Form 1099-G, Statement for Recipients of Certain Government Payments, is issued to any individual who received Maryland Unemployment Insurance benefits for the prior calendar year. The 1099-G reflects Maryland UI benefit payment amounts that were issued within that calendar year. This may be different from the week of unemployment for which the benefits were paid.

1099-Gs are required by law to be mailed by January 31st for the prior calendar year. By January 31, 2021, the Division will deliver the 1099-G for Calendar Year 2020. By January 31, 2021, the Division will send the 1099-G for Calendar Year 2020.

1099-Gs are not available until mid-January 2021. 1099-Gs are only issued to the individual to whom benefits were paid. If you have moved since filing for UI benefits, your 1099-G may NOT be forwarded by the United States Postal Service. The BPC unit cannot update your mailing address. You must update your mailing address by updating your personal information in the BEACON portal, on the Maryland Unemployment Insurance for Claimants mobile app, or by contacting a Claims Agent at 667-207-6520.

    Some May Qualify For Tax Credits Now

    The IRS has stressed that taxpayers shouldnt file an amended return unless the calculations make the taxpayer newly eligible for additional federal credits and deductions not already included on the original tax return.

    The IRS, for instance, can adjust returns for taxpayers who claimed the EITC. Because the exclusion changed the income level, those people may now be eligible for an increase in the EITC amount which may result in a larger refund.

    Taxpayers, however, would have to file an amended return if they didn’t originally claim the EITC or other credits but now are eligible because the exclusion changed their income. These taxpayers should review their state returns as well, tax experts say.

    Others may qualify for the American Opportunity Tax Credit, which is a credit for qualified education expenses paid for an eligible student for the first four years of higher education.

    If youre still collecting unemployment benefits in 2021 you should consider taking action. Withholding on unemployment is voluntary. Federal law allows any recipient to choose to have a flat 10% withheld from benefits to cover part or all their tax liability. Each state has different processes for this.

    If you would like to have withholding deducted from your benefits going forward, contact your state unemployment office by phone or visit your states unemployment website.

    A second option is to make estimated tax payments to the IRS by filing Form 1040-ES either online or on paper with a check.

    Another alternative if you collected unemployment for part of 2021 but are now employed, you could consider increasing the withholding on your current wages to make up the shortfall by filing Form W-4 with your new employer.

    For example, if you qualify for the $10,200 tax break, youre single and are in the 22% tax bracket, you may qualify for a tax savings of $2,244. And if you are married and both you and your spouse qualify for the tax break, you may be able to save $4,488.

    If you have already filed your return, you’ll need to wait for your tax return to either be rejected or accepted, if it is rejected you can add your Form 1099-G, correct any other errors on the return and resubmit it. If it is accepted, you will need to amend your return to include the Form 1099-G.

    I Received Unemployment Benefits In 2020 How Are They Taxed

    If your modified adjusted gross income is less than $150,000, for singles or married people filing separately, you dont have to pay taxes on the first $10,200 of 2020 unemployment benefits you earned. For married people filing jointly, if each spouse received unemployment, this exemption applies to the first $10,200 worth of benefits for both individuals. If your modified AGI is $150,000 or more, this exemption does not apply to you. And the threshold stays the same for all statuses it will not double to $300, 000 if you are married and filing a joint return, for example.

    If you file a Form 1040-NR , the IRS says your spouse isnt eligible for the tax break on the first $10,200 worth of benefits.

    According to the Employment Development Department , Pandemic Additional Compensation that extra $600 federal benefit bump people got from March until late July, and the extra $300 federal benefit bump people started getting in late December is taxable and must be included in your gross income. However, dont confuse this money with one-off stimulus checks from the U.S. government , which are not taxable.     Should I File My Taxes If The 1099

    Maybe. If the issue is corrected before the filing deadline then you will want to wait until your receive your corrected 1099-G form.

    But if the problem has not been corrected, the IRS advises that you may still file your federal income tax return, but to NOT place the amount that is listed in your 1099-G form. You will simply file your return without reporting your 1099-G information and you will need attach a statement to your tax return.

    The statement will need to include why you are not reporting the 1099-G income. A copy of the confirmation you will receive from the LWCs online fraud reporting form can serve as the written statement.

    Reporting Unemployment Benefits At The State And Local Level

    If your state, county, or city collects income tax on your unemployment benefits, keep your Form 1099-G for reference. You may have to attach it to your state, county, or local income tax return. If so, keep a copy for yourself.

    Check with your states Department of Revenue and relevant county and local government tax agency for instructions on how to report your unemployment benefits at the state and local level.

    Should I Just Submit For An Extension On Filing My Taxes

    Spivey said she anticipates “a significant number of people that will not do this year, and then get charged penalties and interest.” Sometimes people then experience a “snowball effect,” she said. “They don’t do one year and then it causes anxiety, and then they just don’t do them for a couple of years.”
