How To Get Tdiu
TDIU ratings can be awarded as part of the VA disability benefits process. The VA generally refers to a claim as a TDIU claim when two conditions are met: the veteran has one service-connected disability with a 60% or more disability rating, or has two or more service-connected disabilities with a combined rating of 70% or more, and there is medical evidence of unemployability.
If the veteran satisfies these two conditions, then he will be entitled to a 100% disability rating.
A second method of reaching the same TDIU result is called an extra-schedular rating. An extra-schedular rating applies to veterans who are unemployable due to their service-connected disability, but whose disability does not meet the percentage requirements previously discussed.
Medical evidence of unemployability refers to medical findings of conditions or symptoms that would tend to interfere with the maintenance of regular, full-time employment. Examples could be ongoing panic attacks, social anxiety, frequent emotional outbursts as a result of PTSD, etc.
What Are The Vas Criteria For Tdiu Eligibility
TDIU is a total disability rating based on a veterans individual unemployability. When your VA schedular rating is less than 100%, but you can demonstrate that your service-connected impairments obstruct you from getting or maintaining gainful employment, you may be entitled to VA disability compensation at the 100% rate.
Therefore, in order to claim TDIU benefits:
- You must be a recipient of service-connected compensation disability benefits. Of those SC disabilities, you must meet the following minimum requirements :
- One disabling condition is rated at least a 60 percent disability rating, or
- You have two or more disabilities with one rated at least 40 percent and the combined rating for both adding up to at least 70 percent.
- There are cases where your ratings are lower than the above minimums, but you may still qualify for TDIU benefits. Sometimes cases are so exceptional or unusual that the regular rating method used by the VA is insufficient. These cases are known as extra-schedular and require VA to consider various other aspects particular to your case, including your work history, education, periods of hospitalization and your SC disabilities.
- You have medical or vocational proof that your service-connected disability is the factor that precludes you from keeping and earning an adequate living.
- You may also have a claim for increased VA ratings.

Can Tdiu Be Permanent And Total
TDIU benefits are not necessarily permanent, but they can be granted permanent status. Generally, TDIU benefits are intended to provide veterans with enough income to live on when they cant maintain substantially gainful employment due to their service-connected disabilities.
If you believe your circumstances warrant it, youll need to apply for permanent status and prove to the VA that your service-connected condition are unlikely to improve over time, making you permanently unemployable above the federal poverty level.
If your level of disability changes such that you can start earning income above the federal poverty limits, your TDIU benefits will be revoked.
In the past, if you were a veteran receiving TDIU benefits, you had to submit a questionnaire to the VA every year to determine if you still qualified. This process changed in 2019. The VA now uses Social Security Administration data to determine which veterans pay into Social Security. The VA may request you fill out VA Form 21-4140 Employment Questionnaire based on this data.
TDIU benefits can also be granted temporarily for a few different reasons, including:
- Prestabilization: recently medically discharged veterans where employment isnt feasible or advisable
- Extended hospitalization: hospitalizations lasting 21 days or longer due to service-connected disabilities
- Recovery from surgery due to service-connected disabilities where recovery lasts one or more months

How Does The Department Of Veterans Affairs Determine If I Am In Need Of Financial Support
To receive a non-service-connected disability pension you must show a financial need. The Department of Veterans Affairs considers you to have a financial need if you do not have income greater than the maximum annual pension rate which by law is changed annually based on the Cost of Living Adjustment . For 2021 the MAPR for a single veteran with no dependents and who doesnt qualify for Housebound or Aid and Attendance benefits is $13,931.00. The MAPR increases if the veteran is married, has dependents or qualifies for Housebound or Aid and Attendance Benefits.
For example, if you are a single veteran with no dependents who would not qualify for Housebound or Aid and Attendance benefits with countable annual income of $15,000.00 from Social Security Retirement Benefits, you would not qualify for the non-service-connected disability pension because your countable annual income is more than the MAPR of $13,931.00.
For example, if you and your spouse have $100,000.00 in assets and $40,000.00 in annual countable income, you wouldnt qualify for the non-service-connected disability pension because your net worth of $140,000.00 would be more than the net worth limit of $130,773.00.

What Exactly Is Va Individual Unemployability Back Pay
Total Disability Individual Unemployability Benefits, also known as Individual Unemployability Benefits, are for veterans who cannot work from service-connected disabilities.
Back pay is the money you should have been receiving while you were waiting on the VA to approve or deny your claim. Veterans who are eligible for Individual Unemployability Benefits often receive a lump-sum check from the Veterans Administration, known as back pay. Too often, veterans only receive their VA Individual Unemployability back pay to the date they applied that is not the date you should have started receiving VA Individual Unemployability Benefits.
Your back pay should go all the way back to your effective date this could be years before you started applying. The problem is that effective dates can be hard to determine. The Veterans Administration often gets effective dates wrong and many veterans dont know the VA got their effective date wrong. This simple mistake can cost veterans thousands of dollars.

What To Do If Your Unemployability Is Questioned
First, you need to understand what substantially gainful employment entails. It means working full-time and earning more than the poverty level in your area. The national averages vary based on family size and geographic location. Examples include the following national averages in 2021:
- Family of 1: $12,880
- Family of 3: $21,960
- Family of 4: $26,500
If the VA does decide to investigate you for employability based on your income, the first thing the agency does is sending you a letter and an Employment Questionnaire for you to describe your work life. The VA used to require TDIU recipients to file Form 21-4140, a yearly employment questionnaire, but that was abolished in February 2019 because the VA now matches your wages against W-2 forms.
Veterans dont automatically lose their benefits just because they received a letter from the VA. But if you dont reply, your benefits might get canceled.
How Long Does It Take To Get Approved For Tdiu
The basic requirement states that to qualify for TDIU, a veteran must have at least a 60 percent rating for one service-connected condition, or a combined 70 percent rating for several service-connected conditions.

Veterans who are eligible for Individual Unemployability Benefits often receive a lump-sum check from the Veterans Administration, known as back pay. Your back pay should go all the way back to your effective date this can be years before you started applying.

Many veterans find that it is incredibly difficult to qualify for a 100% rating based on the VAs rating schedule. As an initial matter, to qualify for TDIU, a veteran must be unemployable solely on the basis of his service-connected disabilities.
Can TDIU be taken away?
TDIU rating can be taken away, but only if the VA determines that the veteran is able to maintain sustained gainful employment.

How To File A Disability Claim
The process of filing a VA disability claim starts with filling out an application, which you can download from the VAs website. After filling out your application, you can either drop it off in person or mail it to your regional VA office to file your claim. You can also apply online at the VAs eBenefits website.
The VA asks for a few specific documents to be attached to any VA claim. These include your military personnel records, your military medical records, and any medical evidence that can support your claim. The medical evidence attached to your claim can include X-rays, lab reports, test results, and notes from your doctor. The VA will consider any submitted evidence when reviewing your claim and deciding whether it should be approved or denied.
The VA will ask you to visit your regional VA office for a Compensation & Pension exam to further investigate your claim. During this exam, you will be evaluated by a VA doctor, who will assess your condition to determine whether your disability is diagnosable. The C& P exam also helps the VA determine whether there is a verifiable connection between your military service and your disability.
Getting Assigned A Permanent Va Disability Rating
First off, a permanent rating may be assigned when medical evidence strongly suggests your condition will not improve over time. The severity of your condition, or multiple conditions, will factor into this, as will your age at the time of your claim. Now, a permanent status doesnt necessarily mean your rating is 100%. It only refers to the likelihood of your condition, whatever its rating, to not improve over time. A 100% disability rating is instead considered total, and likewise, it doesnt necessarily mean your rating is permanent. Having a permanent and total rating will, in fact, protect you from reexamination and rating reduction later in life, but both conditions must be satisfied in your initial exam, or later exam down the line.
You may always request a reexamination to determine if your condition is consistently severe or worsening in an effort to get assigned a total and/or permanent rating.

The Difference Between Tdiu Permanent And Total And A 100 Percent Disability Rating
At first glance, it may seem like the qualifications for schedular TDIU benefits are the same as a 100% disability rating. However, this is not the case. The goal of TDIU permanent and total benefits is to compensate veterans with a lower rating at the same level as veterans who receive 100% disability payments.
To qualify for schedular TDIU benefits, one of the following must be true:
- You have one service-connected disability rated at 60% or higher or
- You have two or more service-connected disabilities, with One disability rated at least 40%, and A combined disability rating of 70% or more
In special cases, if you have a disability rating lower than the above requirements but your service-connected disability or disabilities still prevent you from maintaining substantially gainful employment, you may be approved for TDIU permanent and total benefits on an extraschedular basis. These cases are exceptional in nature and require special review by the Director of Compensation Service. However, its important to keep in mind that if the Director of Compensation Service denies extraschedular TDIU, the Board of Veterans Appeals can overturn that decision on appeal.
