Proof of Wages and/or Work are documents that you must provide to close a disqualification. You may substitute any of the documents listed below only if your name, Social Security Number and the employer’s name, address, and phone number are on the documents:

  • Name and Social Security Number
  • Beginning date of employment

If You Are On Regular Unemployment Or Were On Pandemic Unemployment Assistance Or Pandemic Emergency Unemployment Compensation :

  • Your search activities can include registering on an online job board such as workintexas.com a job interview, attending a virtual networking event or other activities.
  • The TWC will not ask you for documentation of your work search activities every time you request payment. Instead, you will check a box that confirms you performed a search. Someone may, however, randomly ask you to prove your work search activities. Keeping a log of your searches for your own records is a good idea. Here is a log template from the TWC.

I Returned To Work After Filing For Benefits But Im Out Of Work Again What Do I Do

According to the workforce commission, if three weeks or less have passed since you last requested payment, you should go ahead and request payment again as normal. You should report any hours you worked or income you received during the time period for which you request unemployment benefits.

If it has been more than three weeks since you last requested payment, you should reapply for benefits. To help the TWC activate your claim quickly, the agency says, select layoff as the reason you lost your job. Choose layoff even if you were furloughed or the business where you were most recently working closed.

If your small business has employees working in Texas, youll need to pay Texas unemployment insurance tax. The UI tax funds unemployment compensation programs for eligible employees. In Texas, state UI tax is one of the primary taxes that employers must pay. Unlike most other states, Texas does not have state withholding taxes. However, other important employer taxes, not covered here, include federal UI and withholding taxes.

Different states have different rules and rates for UI taxes. Here are the basic rules for Texass UI tax.

Claiming Retroactive Back Payments

Retroactive benefits for covered weeks during when the pandemic unemployment programs can be claimed via the TWC through their online portal or via calling a customer service agent at their Tele-Center at 800-939-6631.

Most backdated claims will have to be manually processed and require evidence to support the claim.

For most PUA/DUA claims, the TWC has stated that you must submit proof of employment using their UI Submission Portal or via mail that shows evidence of employment or self-employment and planned commencement dates. You must provide the proof within 21 days of the date you filed your claim.

Extended State Benefits in Texas

TWC is not paying out State Extended Benefits since the required unemployment thresholds are no longer being met.

According to the TWC page the EB program extends regular unemployment benefits during high periods of unemployment. TWC can pay EB in periods of full federal funding when the total unemployment rate is at least 6.5% and in periods of less than full federal funding when the insured unemployment rate is 5% or more.

TWC will notify claimants and auto-enroll them to receive benefits if they are eligible. But note that the maximum number of weeks you can receive under the EB program is 13 weeks or up to 50% of the total amount of benefits you had on your most recent regular unemployment claim.

Work Search Requirements In Texas

Texas Unemployment Rate Holds Steady at All

To remain eligible for benefits in Texas, you must be able and available to work, and you must be actively seeking work. Within three business days of applying for benefits, you will need to register for WorkInTexas, the states work search program. After you apply, the TWC will tell you how many work search activities you must complete each week to keep getting benefits. Although you dont necessarily have to hand in documentation of your job search, the TWC can require you to provide the information at any timeand if you dont have it, you will lose your benefits. The TWCs website has detailed information about the states work search rules.

Once you file your initial claim, you will have to request benefits every two weeks, either online or by phone. You will have to provide information regarding your availability to work, your job search, and any work you did during the two-week period covered by the claim.

Make A Payment On Your Overpayment

An overpayment is caused when TWC pays you unemployment benefits that you are later found not eligible to receive. Overpayments stay on your record until they are repaid. We cannot pay you benefits if you have an overpayment.

You can now repay your overpayment online by e-check:

  • Log on to Unemployment Benefits Services
  • Select Make a Payment on Your Overpayment from the Quick Links menu and select the www.repay.twc.texas.gov link
  • Log in with your UBS user ID and password
  • Select the Bank Account payment method
  • Enter the payment amount and review payment summary
  • Complete the Customer Information and Payment Information
  • Print the Payment Receipt Confirmation for your records

There is no service fee for submitting your payment online using e-check.

Individuals affected by COVID-19 can apply for PUA benefits online through Unemployment Benefit Services 24 hours a day, seven days a week, or by calling a TWC Tele-Center any day between 7 a.m. and 7 p.m. at 800-939-6631.When applying, individuals affected by the pandemic should indicate that as the reason they lost their job.

What do I do if I was previously denied benefits due to my base period?

You may reapply. Unemployment benefit eligibility is based on past wages, job separation and ongoing eligibility requirements. Prior to April 5, past wages are calculated on a base period of October 2018-September 2019. However, starting on April 5, 2020, the base period changes to January 2019-December 2019. If you were previously denied unemployment benefits due to monetary ineligibility and worked during the January 2019-December 2019 base period, TWC encourages you to visit the unemployment benefit services portal on April 5 to reapply online.

Are UI benefits taxable?

Unemployment benefits are taxable. Individuals can sign up for withholding and the Texas Workforce Commission will deduct 10% for income tax withholding.

Requesting Payment and Certifying for Benefits

What Happens During The Appeals Hearing

Upon receiving the appeal, the agency sends a notice of a telephone hearing. That lists your hearing officer who amounts to the judge in the case. Legal representation is optional. You can have someone represent you, but the TWC does not provide a lawyer. You also may call witnesses, and your most recent employer may also appeal and participate in the hearing. The hearing officer has your documents in front of them and asks a series of questions, and you are provided an opportunity to lay out your case. Ahead of your hearing, the TWC recommends gathering the following materials to have on hand:

  • Letters and memos.
  • Maps, charts and diagrams.
  • Performance record.

Any of the relevant documents you want to present during the hearing must be provided to the hearing officer listed on your appeal hearing notice. The agency recommends sending relevant documents as far in advance as possible. You should not include documents already included in the hearing information packet.

The outbreak of COVID-19 has caused unprecedented changes to the lives of individuals all across Texas and across the globe. Since March 14, the Texas Workforce commission helped over 1 million Texans file unemployment claims which is equivalent to around 75 weeks of claims in a months time.

The Governor declared the COVID-19 Pandemic a disaster March 13, 2020 therefore, the TWC can backdate a claim to the prior Sunday which is March 8, 2020 if an individual was unemployed and has been trying to file but has not yet been successful. If the individual became unemployed subsequent to March 13, 2020 and has been attempting file but not yet successful then their claim will be effective the Sunday prior to the date they were separated from work.

  • They live with someone who is at a higher risk of getting very sick from COVID-19 .

  • They have tested positive for COVID-19 by a source authorized by the State of Texas and have not recovered.
