What Is A Hostile Workplace Environment

While some may spend more time at work and some less, our jobs are still a deeply important aspect of life. What Is A Constructive Discharge

An employee is constructively discharged when they resign because they can no longer stay on the job due to a hostile work environment. This differs from a typical resignation, firing, or other types of separation of employment, as the employee is leaving because of intolerable working conditions.

Unbearable working conditions might include discrimination or harassment, mistreatment, or receiving a negative change in pay or job duties for reasons that arenât work-related. If you are not able to file your weekly claim certification this week, please check your BEACON portal to see if you have an âApply for Benefitsâ button. If you have this button, there could be several reasons including, but not limited to:

  • You did not apply for benefits last week,
  • Your benefit year has expired , or
  • Your monetary eligibility needs to be redetermined.

Even if your account is active and you have a balance, if you have an âApply for Benefitsâ button, then you need to re-apply for benefits to be able to file your weekly certification as required by Maryland unemployment law and federal program rules.

If determining whether you’re eligible for unemployment, and actually applying for it, seems complex, that’s because it is. Every state determines who qualifies for unemployment aid and what the application process entails.

Recently, unemployment assistance has opened up to include nearly every person who’s lost work, through no fault of their own, due to the coronavirus.

“The biggest question I’ve been getting is, ‘My circumstance is X-Y-Z should I apply?'” says Michele Evermore, senior policy analyst at the National Employment Law Project, a nonprofit research firm. “And the answer to that is almost always ‘yes.'”

Workers will qualify for aid if they were laid off, furloughed or had their hours cut. You can also check with your state’s department of labor to determine additional eligibility, such as if you lost work because you were diagnosed with Covid-19, you’re providing care to a family member with the virus, you have to care for a child due to school closures, you’re unable to get to work due to closures or other qualifying reasons.

People who’ve seen a reduction in work hours and wages due to the virus may qualify for partial unemployment.

“In this particular period in history, getting an unemployment check isn’t good just for you, but it’s good for the local economy, and it’s an important public health measure,” Evermore says. “People need to take these benefits and not be making ends meet by going out to work.”

Im A Gig Worker Do I Qualify

Under the Pandemic Unemployment Assistance part of the CARES Act, gig workers, independent contractors, self-employed workers and workers who dont have a long enough work history to qualify for regular state unemployment insurance now qualify for unemployment income, so long as their job loss is connected to the COVID-19 pandemic. These provisions are modeled on the federal Disaster Unemployment Assistance program.

Even before the CARES Act, experts encouraged such applicants to apply, because even if your company calls you an independent contractor, you may be misclassified.

To be eligible, people have to be employees. Iliana Perez is the director of research and entrepreneurship at the San Francisco-based organization Immigrants Rising, which compiled a resource guide for undocumented immigrants during the coronavirus pandemic. She said DACA recipients should definitely apply.

But if you are undocumented without work authorization, you will be ineligible for UI, Perez said. If thats your situation, she suggests you consider additional ways to generate income through freelancing or entrepreneurship.

Continuing Your Unemployment Benefits

Once you have qualified for unemployment insurance benefits, you are not free to simply sit back and welcome the checks each week. You must continue to comply with the state program’s rules and rituals to keep them coming.

You must visit the unemployment insurance office or complete specific paperwork as frequently as your state requires it. Periodically, you must verify that you remain unemployed but available for work, that you remain physically able to work, and that you are actively looking for work. The documents you sign will typically ask you to certify that you continue to meet these requirements, and it is usually a criminal offense to lie about any of your answers.

In some states, you are also required to list a minimum number of potential employers to whom you have applied for work since the last time you signed for benefits. This requirement may vary according to economic conditions.

The unemployment insurance program cannot require you to take a job that varies much from your normal field of work and your normal wage level. But these ranges are subject to interpretation, so exercise care in deciding where to apply for a new job. Some unemployment insurance offices maintain and post listings of jobs that are available locally. Apply only for jobs that are similar to your normal type of work and wage levels so that you will not run the risk of having your unemployment insurance claim discontinued because you refused to accept substitute employment.

What To Expect With Partial Unemployment

With partial unemployment, claimants still need to certify their benefits each week with their states unemployment office, including reporting the number of days/hours worked in the previous week, Tayne said.

Your unemployment benefit amount is determined by the state you live in and is typically based on how much you earn or have earned and how many hours you work. The state will typically determine a reasonable weekly value and then subtract the amount you make from work each week.

Each state is different, and in New York, for example, the individual working part time must make $504 or less and work no more than 30 hours to be eligible for partial benefits, Tayne said. Benefits are reduced by how many hours the individual worked in a week. So a person working 11 to 20 hours in a week will have benefits decreased by 50%.

If you fail to certify your gross weekly pay, the benefits will be discontinued. Also, you cant certify in advance because your certification is for the previous week. For the week of Sunday, March 7 through Saturday, March 13, for example, the earliest you could certify is on Sunday, March 14. If you end up collecting more unemployment benefits than you are eligible for because you did not report earnings, there are severe penalties, as you could be committing fraud.

The fine print: Because of unprecedented numbers of claims, Maryland is asking people to file online during off-peak hours and to do so on specific days, based on last name. If your last name starts with A through F, file your claim on Mondays. If your last name starts with G through N, file your claim on Tuesdays. If your last name starts with O through Z, file your claim on Wednesdays.

What youll need: Be sure to have the following on hand before you start your application:
