How to Claim Your Weeks of Unemployment Benefits

You might still be able to get your W-2 data electronically if, for whatever reason, it didnt work out with your employer or the IRS. The authorized IRS e-file providers H& R Block and TurboTax provide a free W-2 form finder.

Depending on the availability of these documents from your financial institution and employer, this feature will allow you to find and import your W-2 online.

Information Needed For Your Federal Income Tax Return

Each January, we mail an IRS Form 1099-G to individuals we paid unemployment benefits during the prior calendar year. The 1099-G form provides information you need to report your benefits. Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS. You can file your federal tax return without a 1099-G form, as explained below in Filing Your Return Without Your 1099-G.

A 1099-G form is a federal tax form that lists the total amount of benefits TWC paid you, including:

  • Unemployment benefits
  • Federal income tax withheld from unemployment benefits, if any
  • Alternative Trade Adjustment Assistance and Reemployment Trade Adjustment Assistance payments

What Is Employer Non

The UIAs Field Audit and Employer Compliance Sections are responsible for identifying employer non-compliance. Non-compliance can sometimes be unintentional, honest mistakes made by employers, or intentional schemes.

There can be many types of employer non-compliance including:

  • Misclassification
  • An employer incorrectly classifies a worker as an independent contractor to avoid paying the unemployment insurance tax when legally the worker is an employee.
  • State Unemployment Tax Act Dumping
  • An employer attempts to shift workforce or payroll, between entities to avoid paying established or higher unemployment tax rate or liability.
  • Unreported and Under-reported Employee Wages
  • Fictitious Employer Schemes
  • A fabricated business is registered with the UIA in order to obtain unemployment benefits under false pretenses. The false entity reports fake payroll and wages for non-existent employees and then files benefit claims as if those employees are laid off and collects benefits under those names.
  • Employer Fraud Schemes
  • Misrepresentation or non-disclosure of information by an employer in order to avoid or to reduce the unemployment contribution liability. This can also be collusion between employers and employees to help the individual obtain unemployment benefits to which they are not actually entitled to.

    When Do W2s Come Out

The IRS mandates that employers have to send out or make W2s available to their employees by January 31. Even if you switched jobs, they still have this deadline in place, yet sometimes you can expect to receive it earlier. Your former employer will also include your accumulated vacation, severance, and outstanding bonuses on your W-2 form.

To file your income taxes and get your tax refund, you have to have your W2. This form contains all of the important information that you need for your annual income tax filing.

If you do not have your W-2 form by the end of January, confirm that your employer has your correct mailing address. If you dont receive the W-2 from your employer by Valentines Day, contact the IRS at 800-829-1040 and provide them with your details so they can find your information.

Before calling them, make sure you are prepared to provide them with your name, mailing address, phone number, social security number, employers name and address, and the dates that you were employed

The IRS will accept returns without W2s however, this could delay your refund. The IRS has to make sure that your income is accurate and matches their records before they can issue you a tax refund.

Who Gets A Restitution Waiver Remains Unclear

The state hasnt yet determined when it will resolve the number of restitution waivers it will issue, or how many people will have to repay benefits.

The states accounting shows $8.5 billion in unemployment benefits it shouldnt have paid since the start of the pandemic, including $2.8 billion paid in fraudulent claims, according to a recent audit.

The remaining $5.7 billion represents claims that were later ruled ineligible due to rule changes, UIA error or other reasons. At least 758,000 unemployment claims had to be reconsidered and approved after the state disclosed it hadnt initially followed federal guidance. Roughly half have received waivers of repayment so far.

The agency has not yet made clear how many of those claims have yet to be resolved.

The recent federal labor ruling will allow the state to issue more waivers, but many details remain in flux, including when an individual will learn a waiver has been granted.

UIA spokesperson Nick Assendelft told Bridge this week that the state is reviewing the 40-page federal document on which people who received Pandemic Unemployment Assistance and other temporary programs through last September are waiver eligible. Roughly 70 percent of the 3.46 million residents who filed for unemployment during the pandemic collected temporary benefits.
