Unemployment Benefits In Tennessee During The Covid

On March 11, 2021, President Biden signed into law a $1.9 trillion COVID-19 relief bill known as the American Rescue Plan . The law extended a $300 per week federal unemployment supplement until September 6, 2021. However, in response to apparent labor shortages, the state of Tennessee decided to end this supplement early on July 3, 2021. That means the unemployment supplement is no longer available in Tennessee.

The law also extended two unemployment programs originally created by the CARES Act in March 2020: Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation .

Under the PUA program, self-employed workersusually excluded from unemployment benefitsare entitled to unemployment if they meet certain criteria. ARP makes PUA benefits available through Labor Day 2021, and increases the maximum duration of these benefits from 50 to 79 weeks.

The PEUC program provides for a federally-funded extension of benefits when state unemployment benefits expire. ARP increases the maximum duration of PEUC benefits from 24 to 53 weeks, with an expiry date of September 4, 2021.

Here are the basic rules for collecting unemployment compensation in Tennessee.

Can I Appeal If My Claim Is Denied

Once youve logged your claim, the first thing you can expect to receive from the Department of Labor and Workforce Development is a Monetary Determination. If you chose to receive this by internal message or email, this should be sent immediately. If you chose to receive it by mail, expect to receive it within 2 weeks. The Determination will confirm how much youll receive in weekly benefits if your claim is approved however, note that it doesnt constitute approval in itself.

The department will then assess your eligibility if any further information is needed to support their review, theyll contact you directly. If the claim is simple, a decision can sometimes be made within 24 hours. More complex claims may take up to three weeks to review. Once a decision has been reached, the department will issue a second determination letter confirming whether or not your claim has been accepted. It will also reconfirm your weekly benefits amount, along with the number of weeks you can collect.

If your claim has been approved, your first payment should usually follow within 72 hours. If your claim has been denied, you may wish to file an appeal. Appeals can be made at Jobs4TN: once youve logged in, select the determination you want to appeal, select File Appeal under Services for Individuals, then Unemployment Services. Once your appeal request has been received, the department will contact you with details of the next steps.

There are things you need to know before you apply, and steps you must take after filing your claim for unemployment insurance benefits.

Unemployed Through No Fault of Your Own

The Unemployment Insurance program provides benefits to workers who are unemployed through no fault of their own and who are able, available, and looking for work. You may file a claim for benefits the first day after becoming separated from employment or after your employer has significantly reduced your work hours. Information will be gathered from you as well as your separating employer and an agency determination will be based on whether you meet the eligibility requirements under state law.

You Must Have Qualifying Base Period Wages

You must have earned an average of $780.01 in each of 2 quarters of a time frame called the Base Period and the second highest quarter must be over $900 or 6 times the weekly benefit amount. If youve earned sufficient wages during this time frame, the wages earned will then be used to calculate your weekly benefit amount and the number of weeks you may receive benefits. The Base Period is the first four of the last five completed calendar quarters prior to the quarter in which your initial claim is filed. A calendar quarter is three months of either January – March, April – June, July – September or October – December.

    ATTENTION CLAIMANTS

TN has had a long-standing problem with lengthy delays in processing claims, with many claimants experiencing a 2 to 4 month delay before payment of benefits. In addition, TN does not answer its customer service line and often does not respond to call tickets submitted online. Both issues are chronic and have existed for many years, well before the current computer upgrade.

TN is, however, very responsive when it hears from an elected representative.

If you have been waiting more than 3 to 4 weeks for a response/approval and/or benefits, we STRONGLY RECOMMEND you send an EMAIL to your elected state representative, describing your issue. The elected representative will respond quickly and TN will contact you.

    Find your elected representative here:

Remember, your elected officials work for YOU. The unemployment insurance benefit program exists to provide financial assistance until you can find work.

BE PROACTIVE do not allow TNs inability to process claims in a timely manner impact your ability to pay your mortgage/rent, car payment and other bills. Contact your state legislator. You will get a response.
