Are School Employees Eligible For Disability Insurance Benefits During School Breaks
School employees are not eligible for Disability Insurance benefits if:
- Full wages were or will be paid to the employee during the contract period when services were performed.
- A period of disability overlaps with a school break and the employee is not scheduled to work, does not have a history of working during the break, or does not have an additional employer.
- The disability period extends through the school break period.
However, if the employee is not receiving wages but would have been working for extra income if not disabled , then the employee may be eligible for benefits to replace the additional income.

Can I Apply For Unemployment & Long Term Disability

Can I Collect Unemployment If I Am Terminated While On Disability
If you are terminated while on disability, you may be able to collect unemployment. However, as long as you are unable to perform your job duties, you will be unable to collect unemployment benefits. All 50 states have the same requirements for a person to be eligible for unemployment compensation. First, the individual must be physically able to work. Second, the person must available for duty. Third, the person must be actively interviewing for jobs.
In most cases, those who are terminated from employment while out on short term disability will be able to go on and receive unemployment benefits. This is because they are likely to recover from their disabling condition sooner rather than later and, therefore, be able to perform their job duties. Those who are terminated while on long term disability, however, may remain unable to work. Because of this inability to retain substantially gainful employment due to disability, a person would be unable to collect unemployment.
Should you be terminated while on disability and be eligible for unemployment benefits, you should file for these benefits as soon as you recover. Because the amount of wages you earned in the year you seek to collect benefits may be affected by your disability leave, you may be able to use an alternate base year. The alternate base year set by your date of disability will allow you to qualify for unemployment benefits based on what you made in a normal year that was not affected by your disability.
Getting Unemployment Insurance When You Could Be Getting Sdi Instead
If you got laid off, but you can’t actually work because of a non-work-related disability, it can be a mistake to apply for Unemployment Insurance .
Many people don’t know about the State Disability Insurance program, and apply for UI instead. However, SDI can give you a larger benefit for a longer period of time than UI, and you won’t get UI benefits if you’re not able to look for work and accept work if it’s offered. Plus, you can’t get UI and SDI at the same time. So even if you are unemployed, it’s better to apply for SDI if you have a non-work-related injury or illness that keeps you from being able to work. The decision to file for disability is yours, but you need to consider the potential pitfalls of taking unemployment benefits while you wait for a disability decision. In some states, you might have to repay unemployment benefits you weren’t eligible for, if Social Security later finds you were disabled during a period you collected those unemployment benefits.
Another thing to remember is that only those who are actively seeking work are entitled to unemployment benefits. If your state unemployment agency finds you aren’t genuinely trying to find work but are instead just trying to draw a check while you wait for disability benefits, you have a problem. The agency will stop your unemployment payments and force you to pay back any money you received.
In some rare cases, people can even be charged with fraud. Individuals receiving both unemployment insurance and SSDI face possible repercussions for double dipping. It is possible for an individual to erroneously receive unemployment insurance despite being ineligible for unemployment due to his ability to qualify for SSDI. In some states, an individual who erroneously receives unemployment insurance must pay back the state.
This can occur while a recipient of unemployment insurance awaits a decision on his application for disability insurance. In applying for disability insurance, new circumstances may disqualify the recipient for unemployment insurance. Withholding information from a state employment insurance office can constitute fraud, potentially resulting in criminal prosecution as well as a hefty fine.
Disability Vs Unemployment Claims
When you file for SSDI or SSI disability benefits, you’re stating that, due to a physical and/or mental impairment, either you’ve been unable to perform substantial work activity for 12 months or you expect you’ll be unable to work for at least 12 months. But when filing for unemployment benefits, you’re stating you are ready and available to perform work if you can find a job that fits your work skills. Some states even require that you’re ready and able to perform full-time work to be eligible to collect unemployment benefits.
In some states, you might have to repay unemployment benefits you weren’t actually eligible for, if Social Security later finds you were disabled during a period you collected those unemployment benefits.

Employers In Texas Dont Have To Carry Workers Comp
Unlike most other states, employers in Texas are not required to carry workers compensation insurance for their employees. Even so, the majority of employers in the state carry it. If youve been injured on the job, ask your supervisor or human resources department whether the company provides workers comp. When an employer provides workers comp, employees cannot sue their employer for on-the-job injuries. Workers compensation insurance is the exclusive remedy.
