Most of the time, when you voluntarily leave your job you forfeit your eligibility for unemployment benefits. However, there are exceptions.

Like millions of Americans, if youve recently considered quitting your job, heres what you need to know about your unemployment rights.

I Did Not Apply For Unemployment Benefits Until A Week Or More After I Lost My Job Will I Get Benefits From The Date I Lost My Job Or The Date I Applied

Because of the unprecedented number of applications for unemployment benefits caused by COVID-19, the TWC will pay benefits starting on the date that a worker lost his or her job as far back as March 8, 2020, not the date the worker applied. It may be necessary to call the TWC to receive backdated benefits.

The Work Search Requirement For Regular Unemployment

If you are required to look for work, you must do one or more of the following activities to be eligible for benefits. We encourage you to document your efforts.

We will notify you to make sure youre aware of the specific requirements for your claim.

Note: If you file a new claim for regular unemployment on July 11 or after, you must register on CalJOBS.

  • You participate in an employer-sponsored Work Sharing program.
  • You have a definite job promise within a reasonable time.
  • You are on a temporary layoff due to inclement weather or another reason and will be returning to work within 30 days.
  • You have a specialized skill with limited job prospects, and youve exhausted your potential job sources.
  • Your labor market has been virtually eliminated because of a trade dispute.
  • Youre unemployed due to a seasonal shutdown in your industry with little chance of finding other work.

We will determine if an exemption applies to you based on the information you provide when you certify for benefits each week.

I Just Quit My Job Will I Be Eligible For Ui Benefits

If you quit your job, we will conduct a phone interview with you and your employer about two weeks after your file your claim to determine if you are eligible for UI benefits.

If you quit your job, you must show that there was good cause for leaving, and that you made all reasonable attempts to keep your job .

Note: Good cause can include unsafe working conditions, a medical doctorâs advice, or protecting yourself or your child from domestic violence.

Do You Qualify for Unemployment in California?

You do not have to search for traditional employment, but you have to take steps to reopen your business. If you do not intend to reopen your business or return to the type of work you previously did you must search for traditional employment.

You must report the number of hours a week you spend taking steps to reopen your business. The TWC has not said what the minimum number of hours is.

These are steps to reopen your business that should qualify to meet the work search requirements:

  • Let your customers or clients know youre reopening by posting on your social media platforms

  • Contact past customers or clients

  • Advertise

  • Pass out business cards and flyers

  • Reach out to potential clients

  • Make sure any required licenses or permits are current and renew them if they arent

  • Obtain required permits or licenses if you dont already have them

  • Review current contracts and research new ones

  • Prepare a bid on contract

  • Submit a bid on a contract

  • Research and prepare for a specific contract

  • Check your inventory

What Disqualifies A Person From Collecting Unemployment

Each state differs but usually the following situations disqualify a worker from claiming unemployment benefits:

  • Fired for failure to follow rules, instructions, orders or other deliberate misconduct on the job. State unemployment offices, however, will allow you to present your case for collecting unemployment after you were fired from your job. You may become eligible for unemployment if you can convince them that the dismissal was due to circumstances beyond your control or that your dismissal from your job was without just cause.
  • resigned without good cause.
  • involved in a labor dispute
  • left due to medical reasons
  • attending school/college
  • failure to make an adequate active search for work
  • failure to accept a suitable job offer
  • on a leave of absence
  • not authorized to work in the Unites States

What are the eligibility requirements in terms of the base period?

Workers will be required to meet unemployment eligibility requirements for wages earned during a designated period of time referred to as a “base period”.

This period differs from state to state but in most states it is the first four of the last five calendar quarters completed at the time you file your claim.

Your claim is usually based on insured wages earned in the base period and you will have to have earned sufficient wages for qualifying for unemployment insurance benefits.

In general, you must not refuse an offer of suitable work without good cause.

How Unemployment Works In New York

Heres a quick overview of how the unemployment insurance process works in New York.

  • Before you apply, make sure you meet all benefit requirements. You must meet all requirements to be eligible to collect unemployment insurance in New York. Among other things, you must have lost your job through no fault of your own, you must be ready, willing and able to accept suitable employment, and you must conduct an ongoing job search.
  • If you meet all benefit requirements, then you can apply for unemployment insurance. To do so, you must log in to the New York Department of Labor website or call the Telephone Claims Center at 209-8124, MF, 8:00 a.m. to 5:00 p.m.
  • Determine the amount of your benefit. This is calculated based on wages earned in either your Basic Base Period or your Alternate Base Period. To find out how much your actual weekly benefits will be, use this calculator.
  • Determine the number of weeks you can draw benefits. Based on your particular circumstances, the New York Department of Labor will send you a notice of how many weeks of eligibility you have. Normally you can draw 26 weeks of benefits in any given Benefit Year.
  • Conduct an ongoing job search. You are required to look for full-time work while drawing benefits, and you must do at least three work search activities each week.

    Which Documents Do I Need To File An Unemployment Claim

    As with other parts of the unemployment program, required documents vary by state, but some may ask for some combination of the following:

    • Drivers license or state-issued ID card
    • Social Security number
    • Mailing address
    • Your previous employers federally issued identification number
    • Your work history over the past two years, which should include each employers business name and address

    Remember that to continue to receive weekly benefits, you may be asked to file a new claim every one or two weeks.

    I Was Paid In Cash Do I Qualify

    Yes. If you were paid only in cash, you may still be eligible. But you could have issues proving you were previously employed and how much you earned. Be prepared to provide tax documents and any other documents showing your earnings. Normally your employer has to report your wages to the Texas Workforce Commission for you to qualify, but since the federal stimulus bill does not require wage history, you should still qualify if you can prove you were working and stopped working because of COVID-19. If you cannot prove how much you earned, the TWC will give you a minimum benefit amount.

  • As soon as youve lost your job, it is important to file a Maryland unemployment application with the Department of Labor, Licensing and Regulation. This can be done through the Maryland unemployment website, over the phone, or in-person at a Maryland unemployment office.
  • After your Maryland unemployment application has been filed and approved, you will receive either an approval or rejection from the Maryland unemployment department. If approved, you must wait one week before beginning to receive benefits.

    Note All Work And Earnings

    When you claim your benefits, you will have to report any work you have done in the weeks being claimed as well as the gross earnings . Even if you have not received payment from the employer yet, the earnings must still be reported over the time worked. Failure to report work and earnings is a crime and can carry severe penalties.

    Generally, you should file your claim with the state where you worked. If you worked in a state other than the one where you now live or if you worked in multiple states, the state unemployment insurance agency where you now live can provide information about how to file your claim with other states.

    I Was Already Receiving Benefits Before Covid

    Yes. The federal stimulus bill will give you 13 additional weeks of unemployment. This is called Pandemic Emergency Unemployment Compensation . You do not need to reapply if you ran out of benefits on or after July 1, 2019. Just keep requesting payments every two weeks. You are probably eligible if:

    • Your original claim was dated on or after July 8, 2018

    • You exhausted all entitlement to regularUIbenefits

    • You are not eligible for benefits in any other state or territory

    • You will run out of your current benefits at any point before December 20, 2020

    • You are not receiving compensation under the UC laws of Canada and

    • You are able to work and available for work.

    If you meet the above criteria, the TWC will notify you by mail or electronic correspondence, and you should not attempt to apply for benefits again. If you submit another application, you may delay TWCs processing of your application.

    After you exhaust those 13 weeks under the federal stimulus bill, you may then qualify for another 13 weeks under Texas law. This is called Extended Benefits. You do not need to reapply. Just keep requesting payments very two weeks. The TWC should automatically review your claim to see if you are eligible for additional weeks of benefits. But if they do not or say you cannot keep receiving benefits, you may need to call them to ask them to review your claim for Extended Benefits.

    On December 27, 2020, a new pandemic relief bill was signed into law.

    Earnings And Tenure Requirements

    To collect unemployment benefits, you must have some connection to the workforce. Benefits aren’t available to those who have been out of work for a long time or have only held very limited jobs . In other words, your unemployment must be temporary.

    States determine whether you’ve met this requirement by looking at your earnings, hours worked, or both, during the “base period.” In almost every state, the base period is a one-year period, consisting of the earlier four of the last five complete calendar quarters before you applied for unemployment. If, for example, you apply for unemployment benefits in August of 2011, the base period would be April 1, 2010, through March 31, 2011.

    Some states require applicants to have worked at least a minimum amount of time during the base period to collect benefits. Most states require applicants to have earned a minimum amount during the base period to qualify. States measure this earnings requirement in different ways: Some look at an applicant’s total wages during the base period others look at the applicant’s earnings during the highest paid quarter of the base period, and other require applicants to have earned at least a certain multiple of the weekly unemployment benefit to qualify.

    Some states require a one-week waiting period for people who become unemployed before they start collecting benefits. Under this bill, Washington will pick up the full cost for states that want to provide those benefits immediately, instead of waiting one week. But ultimately, its up to the state you live in to decide whether to provide benefits during that first week.

    If you knowingly misrepresented your situation, you could be cut off from receiving any further pandemic unemployment compensation and face a fine and jail time under the law.

    How Do I Qualify For Unemployment Benefits

    To qualify for unemployment benefits, we look at the wages you were paid in the first four of the last five calendar quarters the standard base period.

    A person must earn at least one and a half times the highest amount of wages paid in any quarter of the base period. A person can also qualify using the Alternate Earnings Qualifier. This means you must have total base period wages of at least $20,458.00, and you must have wages in at least two calendar quarters in the base period.

    If you file a new claim for benefits and your last benefit year expired within the last six calendar quarters, you must additionally satisfy the following earnings requirement:

    • Worked after your prior benefit year began and
    • Been paid, by a liable employer, at least five times the last weekly benefit amount that was in effect on your prior benefit year.

    If you meet the requirements to establish a claim, for each week you claim benefits you must also be:

    What You Need To Know

    • Update 12/29/20: The federal government has extended the federal unemployment benefit programs available through the CARES Act for an additional 11 weeks. Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation will be available through March 14, 2021, with qualified claimants benefits fully phasing out by April 5, 2021. Federal Pandemic Unemployment Compensation benefits will resume with $300 weekly payments until March 14, 2021.

    • To receive these extended federal benefits, continue to certify weekly while unemployed.     • Waiting weeks for unemployment benefits have been waived during this crisis. If youve seen the term waiting week on your payment history, it is a relic of our existing system and does NOT impact your benefits.
    • To collect regular unemployment insurance benefits, you must be ready, willing, and able to work. We understand that many of you are unable to work due to the COVID-19 pandemic and the impact of NYS on PAUSE. If you would otherwise be able to work, you should answer ‘YES’ in order to receive your benefits.
