What If I Was Discharged For Misconduct
If you were fired or discharged from your job because you did something not in the best interests of your employer , you may be disqualified from collecting benefits. This kind of discharge is known as “misconduct.” The disqualification would begin the week the firing or suspension occurs and continue for the next five weeks. After the disqualification period ends, you may be able to collect benefits.
If you were fired for any reason that is serious enough to be considered a crime under the “New Jersey Code of Criminal Justice,” you may be disqualified from collecting benefits indefinitely. This is known as a “gross misconduct” discharge. To remove a “gross misconduct” disqualification, you must return to work for at least 4 weeks, earn 6 times your weekly benefit rate, and become unemployed through no fault of your own. In addition, the wages you earned with the employer who discharged you cannot be used to establish an unemployment claim or to remove a disqualification.
If you were fired, you will be scheduled for a claims examiner interview. The examiner will determine if you are entitled to benefits.

Nj Labor Department Chief Again Criticized For Handling Of Unemployment Claims

Labor Commissioner Robert Asaro-Angelo told lawmakers other states have had the same problems with their unemployment systems as New Jersey.
Labor Commissioner Robert Asaro-Angelo took another beating from lawmakers during a budget hearing Wednesday, with legislators criticizing his department for taking so long to dole out jobless benefits during the pandemic.
Nearly every lawmaker on the Assembly Budget Committee shared a story of someone who has reached out to their office in need of help resolving an unemployment or disability claim. Assemblywoman Eliana Pintor-Marin , the committees chair, mentioned a constituent who is owed 36 weeks of unemployment benefits and has received a shutoff notice from PSE& G.
These are peoples livelihoods, said Pintor-Marin.
Asaro-Angelo, who appeared before the committee to answer questions about his departments budget request, defended the state workers who have processed nearly 2 million claims since April 2020 and explained to lawmakers why some people are still seeking help for their jobless claims more than two years after the pandemic led to massive job losses. The hearing lasted for three hours.
The commissioner discussed modernizations to the unemployment system applications were updated last week to be in plain language and apologized to the thousands of New Jerseyans who had to wait months to be paid.

In order to keep receiving an unemployment check every week you must file a weekly claim or continued claim or weekly certification.
The purpose of filing a weekly certification is to tell the unemployment agency that you:
- Are presently looking for a job
- Did not do any work this week
- Did not make any money this week
- Did not find another job
- Still want to receive an unemployment check or payment this week
Therefore, it is very important to file your weekly certification every week to keep obtaining your unemployment check.
If you delay in filing your weekly claim, you may not get your unemployment check on time.
I try to reopen or file my claim online. It wont let me it says I have a claim already its been all exhaust but its my old claim and Im trying to open a new one which will not allow me too. I file a claim on the phone but it says for my claim to go through I need to speak to a agent which I cant get ahold of. Im getting nowhere and getting no help. I emailed them its been 3 weeks. Some Unemployed In Nj Have Trouble Getting Benefits After State Said Issues Resolved
New Jersey claimants are receiving emails that their claims are not payable at this time after the state Labor Department switched people over from High Extended Benefits to the Pandemic Emergency Unemployment Compensation program.
The Labor Department claimed it would be a seamless transition for claimants switching to the Pandemic Emergency Unemployment Compensation program when the state triggered off of High Extended Benefits.
But John Flynn was one of the people the Labor Departments programming mistakenly excluded from the transition, and he was unable to certify as his claim showed up expired. After a week, the department said the issue had been resolved and claimants should continue certifying during open hours.
And while hes been able to certify, Flynn hasnt gotten his money in over two weeks. When he opens his claim, which is unpayable, it states in red letters that no action is needed on his behalf.
I hope I get backpay, but its more about the not knowing how long this will go, said Flynn, a writer for an ad agency who was laid off in March 2020. Im stuck in this claim not payable loop until Im not sure when.
The Labor Department believes all of these claimants can again certify for benefits without issues, according to spokeswoman Angela Delli-Santi.
Delli-Santi said the department is very sorry when this occurs and that staff tries to resolve the situation as quickly as possible.

Unemployment Program Extensions Under Covid Relief Bill
The $900 billion COVID-19 relief package was passed into law on Dec. 27, 2020, which among several other pandemic relief measures extends and provides additional federal funding for enhanced unemployment benefits. This includes the Pandemic Unemployment Assistance , Pandemic Emergency Unemployment Compensation and a reinstatement, but halving of the Federal Pandemic Unemployment Compensation Program which provides a $300 supplemental weekly unemployment payment. These programs have been funded and extended for 11 weeks , covering the weeks of December 27th, 2020 to March 14th, 2021. To receive FPUC benefits, you must be receiving regular UI, PEUC, EB, or PUA.
NJ DOL 2021 11-week Extension Payment Details and Updates on $300 FPUC, PUA and PEUC
NJDOL has successfully completed programming for the 11-week benefit extension for the over 75,000 expired PUA and PEUC claims. Claimants who had been waiting and are eligible to claim these 11-weeks should have been notified by email and can certify during their regular schedule once the extended weeks are added to their claim balance. If you have not received your notification AND cannot certify in the next few days your claim is likely held up due to additional manual processing/verification or you were deemed ineligible. Am I Eligible For Unemployment Benefits In New Jersey
To qualify for unemployment assistance in New Jersey, you must meet all applicable eligibility requirements as defined by New Jersey Unemployment Compensation Law. Those requirements include the following:
- The claimant is unemployed through no fault of his or her own
- The claimant is able and willing to accept suitable work when its offered
- The claimant shows documented sufficient recent earnings that meet the minimum required by New Jersey law
- The claimant worked in New Jersey during the past 12 months
- The claimant is actively seeking work during each week a UI benefit check is collected
No determination of eligibility can be made until you apply, so if you think you meet the criteria outlined above, submit your UI benefits application as soon as you become unemployed.

How To Change Payment Method
If you decide that youd prefer to have your benefits delivered via direct deposit, you may log into your account and change your payment method within your dashboard. Please note that this type of change is processed only once each week, so the change may not take effect until the Tuesday after you initiate the change through your account.
When you submit your application, its important to apply for every state program that might prove helpful for example, New Jersey disability benefits, state unemployment benefits, workers’ compensation, or Temporary Disability Insurance.

How Do I Meet New Jersey Unemployment Eligibility Requirements
To qualify for unemployment benefits, you must meet the following initial New Jersey unemployment requirements:
How much money you earned in your base period.
Your base period is defined as the first four quarters out of the past five quarters before you file your initial New Jersey unemployment weekly claim. Your maximum benefit amount depends on how much money you earned in your base period. The maximum New Jersey unemployment amount in 2020 is $713. In your base period, you must have 20 weeks where you earned gross wages totaling at least $10,000. A base week is defined as one where you earned at least $200.

If you dont qualify for benefits using your base period wages, you may be able to qualify using an alternate base period. New Jersey has two possible alternate base periods. The first includes wages earned in the four most recently completed quarters before you file your claim. State senators grilled Labor Commissioner Robert Asaro-Angelo during a contentious three-hour hearing Thursday, criticizing him over the states handling of the unemployment crisis at the height of the pandemic and questioning him about why they still hear from residents who say they havent received benefits they should have received long ago.
Senators relayed heartbreaking stories of the constituents theyve helped over the last two years. One listed the number of days residents said theyve been waiting for benefits 174 days, 203 days, 286 days. Another relayed the story of a woman who has waited so long, she has been married and had her name changed since she applied.
And they all expressed frustration and disappointment to the commissioner over the lack of in-person unemployment services nearly two years after COVID-19 led to a surge in jobless claims and a raft of complaints about the difficulty getting state employees on the phone to help.
I have someone whos still waiting for an appeals process a year later. I dont understand why it has to take 365 days, said state Sen. Teresa Ruiz . My community wants to go somewhere and see someone. Theyve been shut out of the process for two years I am asking you to please step up your game.
Having two people at a site wont cut it, Ruiz said.
