Ten months into the coronavirus shutdown, it still takes a stroke of luck to get someone on the phone in the New York state unemployment office, according to many frustrated people who need answers.

Unable to access benefits, thousands of jobless people are relying on each other for advice and insider tricks.

Lenna Bennett said the most popular question on the unemployment Facebook group she moderates is this: What is the contact number for the New York State Department of Labor?

The answer is 888-209-8124.

In a time when most people no longer memorize phone numbers, unemployed New Yorkers can quickly recite that one.

What theyre looking for is an inside number, a short cut to waiting for hours on hold or being disconnected.

Some people call Gov. Andrew Cuomos office directly and hope to be transferred. They call senators and Assembly members.

They pass along magic tricks: Enter your social security number and pin incorrectly three times and you get transferred to a person.

Angela Alaimo, a union laborer from Malone, learned this from the group: Hit the prompt that asks if you need a translator, even if you dont speak another language.

Before I had seen that trick, I did call a few times the normal way and opted for a callback but never got a callback, she said.

People started to panic.

At the end of April, Tyler Grisantis unemployment benefits stopped arriving, even though he was still eligible for payments and certifying for benefits. When the Chautauqua County resident called the state Department of Labor, an automatic menu asked him to enter identifying information before the line hung up. Despite calling the department repeatedly, Grisanti couldnt reach a live representative for a month. First, he was told he needed to verify his identity. When he called back after confirming his identity, he reached an automatic message that said call volume was high and to try again later. After Grisanti spoke with an agent, DOL released the hold on Grisantis account and provided one weeks worth of benefits. He didnt immediately receive back pay and had to call again before obtaining the other weeks hed missed.

I had to go without a lot of things and neglect bills until money came in. I borrowed for the things I had to have, once my savings gone, Grisanti, a former gas station attendant who filed for unemployment in March 2020, wrote to City & State, noting that he never figured out why his benefits stopped. It took over a month of fighting and having no income before I won.

The $193 million total does not include services paid for by other agencies, such as assistance provided by Google, under an existing contract paid for by the Office of General Services.

Overcoming hurdles to get NYS unemployment benefits

On March 11, 2021, President Biden signed into law a $1.9 trillion COVID-19 relief bill known as the American Rescue Plan .

Under ARP, the $300 per week federal unemployment supplement is extended until September 6, 2021.

The law also extends two unemployment programs originally created by the CARES Act in March 2020: Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation .

Under the PUA program, self-employed workersusually excluded from unemployment benefitsare entitled to unemployment if they meet certain criteria. ARP makes PUA benefits available through Labor Day 2021, and increases the maximum duration of these benefits from 50 to 79 weeks.

The PEUC program provides for a federally-funded extension of benefits when state unemployment benefits expire. ARP increases the maximum duration of PEUC benefits from 24 to 53 weeks, with an expiry date of September 4, 2021.

2 On Your Side has heard from a lot of people who say they haven’t gotten their extra $300 they’re supposed to be getting every week in federal benefits. They are also having problems being able to talk to somebody about it.

A viewer who asked that we not use their name emailed saying, “I have called over 300 times in the past two days, and it is impossible to get a rep on the phone. This doesn’t include the hundreds of other calls I have made since my new claim was filed six weeks ago. Processing time says two to three weeks. I know many are in the same boat. How are families supposed to survive?”

So on Thursday, 2 On Your Side asked the NYSDOL what people should do if they can’t get through by , and what they should do if they haven’t gotten the extra $300.

But that doesn’t say what to do if you can’t get through by calling the main number.

We were also told the call center has extended hours during the week, and that it’s important for you to carefully listen to the prompts and choose the correct option to be connected with the correct agent.

And, as we reported last month, they still say they haven’t seen any current issues with the extra $300 going out.

ALBANY, N.Y. – New Yorks unemployed are going back to work after record numbers of unemployed throughout the state in 2020. Two local organizations said people are still reporting problems navigating the world of unemployment.

The organizations said people are still looking for help connecting with someone at the New York State Department of Labor , claim denials, and appeals for overpayments.

To accommodate the large number of New Yorkers that found themselves without a job at the beginning of the COVID-19 pandemic, a year ago, the to help people with claims including expansion of work hours for DOL employees along with extended call center hours.

Local organizations also stepped up to assist people with unemployment claims. The New York State Bar Association began a pro bono partnership with volunteer attorneys to help people navigate through the unemployment system last April.

Are You Out Of Work Through No Fault Of Your Own

You must be out of work through no fault of your own to qualify for unemployment compensation in New York. If you are laid off, lose your job in a reduction-in-force , or get “downsized” for economic reasons, you will meet this requirement. You will also likely be eligible for unemployment benefits if you are fired because you don’t meet the qualifications for the job or you fail to meet the employer’s performance or productivity standards.

In New York, employees who are fired for work-related misconduct may not qualify for unemployment benefits. Examples of work-related misconduct include violating company policy or rules, such as those prohibiting absenteeism or insubordination. If you are fired for conviction of a felony , you also won’t be eligible for benefits.

If you quit your job, you won’t be eligible for unemployment unless you had good cause for quitting.

Its important for people to listen to prompts carefully when calling the DOL to be connected with the right agent, use the chatbot on the DOL website to get answers to frequently asked questions, and reapply for benefits if theyve reached their Benefit Year-End, said, Cohen.

Other Weird Things About Unemployment Benefits This Month

Some of you received a letter from the Department of Labor about overpayments. Heres what to do about that.

Last year, the DOL erroneously sent out duplicate payments to an unknown number of New Yorkers, through no fault of those receiving the benefits. But now, since it was federal money lost in the mixup, the law requires that the DOL try to get it back.

If you are one of these people, the DOL would have notified you about the overpayment through email, text and a letter earlier this month. If you dont take action, the DOL can reduce your weekly benefits by a certain percentage until the money is recovered.

You have two other options:

  • If you dont think the overpayment letter is correct, meaning you did not receive an extra payment from the DOL, then you can request a hearing to dispute the claim.
  • If its correct, meaning you received the payment but it wasnt your fault, then you can apply for waiver for financial hardship. If you request a waiver within 30 days of being notified about the overpayment and are approved, you dont have to pay it, according to DOL officials.

You should have received instructions to request a hearing or a waiver in your email. If you didnt, you can message the DOL through your ny.gov account.
