On March 11, 2021, President Biden signed into law a $1.9 trillion COVID-19 relief bill known as the American Rescue Plan . The law extended a $300 per week federal unemployment supplement until September 6, 2021. However, in response to apparent labor shortages, the state of Texas decided to end this supplement early on June 26, 2021. That means the unemployment supplement is no longer available in Texas.

The law also extended two unemployment programs originally created by the CARES Act in March 2020: Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation .

Under the PUA program, self-employed workersusually excluded from unemployment benefitsare entitled to unemployment if they meet certain criteria. ARP makes PUA benefits available through Labor Day 2021, and increases the maximum duration of these benefits from 50 to 79 weeks.

The PEUC program provides for a federally-funded extension of benefits when state unemployment benefits expire. ARP increases the maximum duration of PEUC benefits from 24 to 53 weeks, with an expiry date of September 4, 2021.

What Are Extended Benefits

In fact, the Texas Workforce Commission specifically states that you if you are given the choice of being fired or resigning and you choose to quit your job you are still entitled to unemployment as long as you meet all other requirements. What is my advice? First and foremost, it is important to know that resigning in lieu of termination does not automatically disqualify you from receiving unemployment benefits. But you cant always trust your employer to tell Texas Unemployment Commission that if you had not resigned you would have been terminated. So my advice is to make sure that you put something in writing stating that you have been given the choice of resigning instead of being terminated and that facing those two choice you choose to resign. Make sure you keep a copy of this written statement. An email to this effect to your employer blind copied to your own personal email is a great way to prove up the truth of your resignation.

What Happens When I Run Out Of My Benefits

You may not qualify for more benefits.

If you have exhausted your regular unemployment claim, the TWC will no longer consider you for an extension. There are two temporary extension programs currently active in Texas that most people* on regular unemployment qualify for: Pandemic Emergency Unemployment Compensation, or PEUC, and Extended Benefits, or EB.

*If you are eligible for unemployment in another state because you also earned wages there, you may have to exhaust your regular benefits in that state before qualifying for EB in Texas.

A disqualification for refusal of suitable work begins the week in which the disqualifying act occurred if the claimant was registered for work with the Job Service or filed a claim that week. Otherwise, the disqualification begins the first day of the week in which the claimant registered for work or filed a claim.

End Of Pandemic Unemployment Benefit Programs

With the expiry of the pandemic unemployment programs only traditional state unemployment benefits will be available in 2022, up to a maximum of 26 weeks, with a weekly payment ranging from $71 to $549 depending on your earned income over the prior base period which is the first four of the last five completed calendar quarters before the effective date of your initial claim.

Note that to qualify for unemployment, your job or income loss will generally need to be involuntary. I.e. job loss through no fault of your own. You also need to certify and demonstrate ongoing work search requirements to keep getting payments.
