How To Fill Out Unemployment

Don't Miss

Before You Apply: Gather Your Documents And Information

How to Fill out IRS Form 940 (FUTA Tax Return)

For regular unemployment insurance benefits, you will need:

  • Your name, Social Security number, birthdate and contact information.
  • Your complete work history for the past 18 months including:
  • employer name
  • start and end dates of employment for each employer
  • Your bank account and routing number, if you want to sign up for direct deposit.
  • Tax Implications Of Unemployment Benefits

Unlike workers compensation benefits, unemployment insurance benefits are taxed as income. Because the benefit amounts paid are often below the taxable annual earning level, however, many states will not take the automatic step of deducting any taxes from your unemployment benefit check.

However, the state will report the unemployment benefit amount you were paid to the Internal Revenue Service and to your state taxing authority.

If you receive unemployment benefits during a year in which you get a new job, you may want to increase the amount your employer withholds in taxes from your paycheck. Otherwise, you may be unpleasantly surprised at tax time when you either owe more tax or receive less of a refund than anticipated.

    Unemployment Appeal Board Hearings

If you do file an appeal, then youll need to prepare for an unemployment hearing. A hearing is an informal trial held before an unemployment appeals board and/or an administrative law judge. Based on the evidence presented, a decision will be made on whether you are entitled to unemployment insurance benefits.

At the hearing, you, your employer, and witnesses for both sides may testify. Both you and your employer will have the opportunity to present evidence.

What To Say And What Not To Say

When completing your unemployment forms, one of the first questions you see will be something like: Explain in your own words why you left your last job. The form won’t leave much room for long-winded explanations. Take the clue and keep your responses simple and noncommittal.

Unless you were clearly dismissed from your job because of something you did wrong, avoid using the word “fired” in filling out any forms or answering any interview questions at the unemployment insurance office. There are many unspecified words thrown around concerning the end of employment, but fired is the one most often taken to mean that you did something wrong and were dismissed because of it.

If you lost your job because business was slow, note that you were laid off. “Laid off” is an equally vague term, but it is less likely to raise questions about the validity of your claim.

If you were discharged by your employer, take pains to note: “Discharged without any misconduct” or “Quit for good cause.” Leave out any qualifying details, such as: “My supervisor never liked me from the first day I walked in, so naturally I was the first to be laid off.”

    Avoid Unemployment Filing Scams

Unemployment benefit scams typically involve websites offering to file for unemployment benefits for you. The sites provide a form for unemployed workers to fill out to supposedly collect unemployment compensation. In other cases, phone calls or email may be used to solicit personal information from unemployed workers.

    Know What You Made Monthly

*UPDATED FORM* HOW TO APPLY For Unemployment NY // Step by Step for Freelancers

Interestingly, the burb from the email above states that you want to have your 2019 tax return handy. When I ran through the application, there wasnt anything that required info from my tax return.

However, they did ask for my monthly income from 2019 on.

To be fair, the part of the email that tells about qualifications says you will need this. It says you must have:

Suffered economic loss greater than 30 percent as demonstrated by an 8-week period beginning on March 2, 2020, or later, compared to the previous year. You will be required to provide the total amount of monthly gross receipts from January 2019 to the current month-to-date.

SBAs invitation to apply email, section on criteria for the targeted EIDL advance.

Im curious. Will they follow up with a request for weekly totals? Or are they going to stick with the broadest possible scope where they look at 8 weeks as two months.

What if your period of economic loss begins in the middle of a month? Will that disqualify some who should otherwise be qualified?

Understand what they mean by gross receipts.

The terminology really throws people off.

Gross receipts does not refer to those restaurant receipts that are covered in grease and food stains. While those are indeed gross, thats not it.

In accounting terms, thats your money received after cost of goods sold.

If you do other work, such as flipping merchandise on eBay or Amazon, gross receipts is what you received for your sales minus the cost of buying the items.

Notice To Base Year Employer Forms

Many employers are unaware that they need to pay attention to the Notice to Base Year Employer forms they receive from ESD.

These forms arrive when a former employee has been separated from their next employer. The form appears to be informational in nature, and can list one or more former employees on it. Sometimes employers read it, and file it away, or toss it out.

In actuality, this form is notifying you that a former employee has filed for unemployment benefits and that your account will be charged, unless you respond within 30 days.

The Notice to Base Year Employer form shows:

    • When someone worked for your company
    • Wages reported
    • The percentage of their unemployment that youll be charged, which could be as high as 100%

Even though it comes with no form to fill out or questions to answer, you need to provide the same information that you would on a Separation Statement questionnaire. You can do this via a letter, a fax, or by writing on the form and returning it.

If you dont respond, your account will automatically be charged.

What If I Miss The Filing Deadline

Step By Step To Complete The Weekly Unemployment Continued Claim Form

It depends on whether or not you owe money. If you dont owe money, then theres no penalty for missing the tax-filing deadline, but you need to file a return to get your refund. Theres technically no penalty, says Hamilton. But you have to file within three years of the due date on the return or you lose out on your refund.

Video: Heres how you can earn a tax break on medical expenses

The situation is very different if you owe the IRS. In that case, you could face two penalties. The penalty for not filing a tax return is potentially 10 times greater per month than the penalty for not paying in full, says Brittany Benson, senior tax research analyst at the Tax Institute at H& R Block.

The late-filing penalty is up to 5% of the unpaid balance each month, up to a maximum of 25%, and the monthly penalty for failure to pay on time is 0.5% of the unpaid taxes. For example, for someone who owes $1,000, the failure-to-pay penalty starts at $5 per month, but the penalty for failing to file a return starts at $50 per month, she says.

Unemployment Benefits In Florida: A Step

You are eligible for unemployment compensation if you have been laid off from your job through no fault of your own. It is understandable that you probably have a lot of questions on how unemployment compensation works. Florida has specific rules about eligibility, benefit amounts, and earnings requirements. You may be eligible for unemployment benefits if you meet the states requirements and are actively looking for a new job.

Is There An Unemployment Waiting Period

Unemployment insurance waiting periods are 100% state-driven. Many states have what is known as a “waiting period,” otherwise referred to as a “waiting week” as part of their unemployment insurance laws.

For example, in New York State, you must serve an unpaid waiting period equivalent to one full week of unemployment benefits before you receive payments. Minnesota has a non-payable waiting week before benefits can be collected. In some locations, the waiting week benefits will be paid, but you will have to wait until the end of the claim period in order to collect those funds.

Based on the state-by-state differential, it’s best to check with your state unemployment office website as soon as you lose your job for information regarding the unemployment waiting period in your location.

Do You Need To Look For Work

If youve filed your claim, gotten it approved and start receiving unemployment benefits, there are additional rules you need to be aware of to make sure you dont lose your benefits before you get a new job.

Most states require people who are receiving unemployment benefits be not only willing to work but actively looking for work. That requirement was waived by essentially every state at the start of the pandemic, but a number of them have now reimposed it.

However, as weve noted many times, every state is different, and also the definitions of actively looking for work vary from state to state. So if you arent sure if your state requires you to be currently looking for work, or what you need to do to prove that youre looking for work, double-check its unemployment website to find out.
