Employment Protection For Foreign Nationals Act Claims
A claim may be made when you believe your employer or a recruiter has violated your rights under the EPFNA.
The EPFNA applies to foreign nationals who work or are seeking work in Ontario through an immigration or foreign temporary employee program. For example, if you are working or looking for work in Ontario through the federal Temporary Foreign Worker Program, or the Seasonal Agricultural Worker Program, the EPFNA would likely apply to you.
Examples of EPFNA violations include:
- a recruiter charging you any fees
- an employer charging you for hiring costs
- a recruiter or employer holding onto your property
- a recruiter or employer punishing you for asking about or exercising your EPFNA rights
Foreign nationals employed in Ontario also have rights under the ESA. For example, if you are not being paid all wages owed, you may be able to file a claim under the ESA.

Guidelines For Qualifying For Unemployment Benefits
How can you tell if you’re eligible to receive unemployment? Each state sets guidelines that determine whether an individual will be eligible for unemployment benefits, and how much compensation they will receive.
There are eligibility requirements to qualify for unemployment benefits, including having worked a certain number of weeks for a certain number of hours each week. Those guidelines also determine how many weeks of benefits an unemployed worker can collect.
You’ll find detailed information regarding eligibility criteria on your state unemployment website. In most states, you will need to have worked for a certain period of time, met minimum earnings requirements, and have lost your job through no fault of your own. If your claim is denied or contested by your employer, you can appeal the denial.
But even if youve been terminated for cause, dont assume youre out of luck. You may be able to collect, depending on the circumstances, and whether or not the termination was justified. Its worth it to learn about your rightsincluding your right to appeal a denial of your unemployment claimsbefore you give up on the idea of filing for benefits.
Check with your state unemployment department for information on qualifying for and collecting unemployment compensation in your location.

What To Do If You Owe Taxes On Unemployment Benefits
After going through these steps, you may find that you owe taxes to the IRS. If you do, dont panic. You have options.
However, not paying that tax bill is not one of those options. You should make every effort to pay as much of your tax bill as possible. Not paying your tax bill means that youll immediately face additional penalties for late payment, as well as interest that accrues on your unpaid taxes. File Your Weekly Claims
*** IMPORTANT: to get any money, you must file weekly claims. ***
To start getting unemployment benefits, you need to file a weekly claim. This is different than the initial claim. You have to file both to get your money.
A weekly claim is how we figure out how much money to send you for that week. A week is Sunday through Saturday. You cant submit a weekly claim until the week is over.
To keep getting benefits, you need to file a weekly claim every week. File a weekly claim even if you worked that week. You need to report your hours and earnings for any work you did that week.
File your weekly claims even if you dont know if your application has been approved yet. It can take at least four weeks for us to process your application. If your application is approved, we will send you money for all the past weeks you were eligible for, as long as you filed your weekly claims.
