These documents often come through the regular mail, but states can also offer electronic versions through their unemployment websites.

If You Haven’t Filed Your Taxes: Wait

“Hold on and wait” is also the IRS’ message to taxpayers who have yet to file.

The IRS said it “will provide a worksheet for paper filers and work with software industry to update current tax software” to make it easier for people to report unemployment benefits. Tax pros say it will take at least a few days, if not longer, for tax software to reflect recent changes in the law.

“I have two stacks of returns that I can’t file right now,” said Rob Seltzer, a CPA based in Los Angeles. “I have one client that got $15,000 in unemployment. If I filed her return, it wouldn’t work,” he said.

Tax Exemptions And Exclusions In New York

Employers are required by New York tax law to deduct the amount expected to be payable from an employees gross income. There are several special exclusions and exemptions in this section that may affect how you finish payroll.

Income that isnt taxed and is counted separately from taxable income is referred to as exclusions.

Exclusions differ from deductions in that they do not require the taxpayer to incur any costs. The following are certain exclusions that are important to small businesses:

  • Independent contractors
  • Students enrolled in certain work-study programs
  • A sole proprietor, their spouse, or a kid under the age of 21
  • Persons whose employment is subject to the Federal Railroad Unemployment Insurance Act
  • Freelance reporters under certain conditions

Employees who do not have some taxes taken from their paychecks are eligible for exemptions. Here are some examples of situations when an exemption may be granted:

  • Military spouses are exempt from New York State income tax under the service members Civil Relief Act and Veterans Benefits and Transition Act, and full-time students under the age of 25 who had no New York income tax liability in the previous taxable year and expect none in the current year.
  • If your company is a START-UP NY participant and operates in a tax-free zone, some or all of your employees pay may be exempt from income tax withholding in New York State, NYC, and Yonkers.

If unemployment income creates a tax bill you can’t pay right away, here are a few options to keep in mind.

  • Still file your tax return on time. The IRS issues penalties for paying late, but it also issues penalties for filing late. You can help keep the penalties to a minimum by filing your tax return on time, even if you can’t send any money. If you need more time to file your tax return, you can get an extension, but remember that getting an extension only gives you more time to file, not more time to pay.

  • The IRS lets people pay in installments over time. Signing up for an installment plan can let you pay your tax bill over the course of several weeks or months, and you can sign yourself up directly with the IRS. There are a few different plans to choose from depending on how much you owe and how long you need.

How To Pay Taxes On Unemployment

The three most common ways to pay those taxes include: paying them when you file your tax return, making estimated payments during the year, or having them automatically withheld which experts say is often the best option.

If people have the capacity, they have the cash flow, and they think that they can

forgo a little bit of their unemployment check each week, its so much easier to do the small incremental withholding amount than it is to come up with a large payment out of pocket, Rigney said.

When you first apply for unemployment, you should have the option to elect automatic withholding. If you didnt do this, you can do this by filing a W-4V, or Voluntary Withholding Request, to have your state and federal taxes withheld automatically from your unemployment check.

By Jan. 31, youll receive a Form 1099-G, or Certain Government Payment, from your state, listing the amount of payment youve received and the amount withheld, if applicable. You should use that form to fill out your tax returns.

Last, you can wait until tax day to make your full tax payment. But if you received unemployment for much of the year, you may be subject to penalties for not paying enough tax during the year through withholding or estimated payments. You also could face a huge tax bill in April that could create a cash crunch. Its better to plan ahead.

Exclusion Of Up To $10200 Of Unemployment Compensation For Tax Year 2020 Only

If your modified adjusted gross income is less than $150,000, the American Rescue Plan Act enacted on March 11, 2021, allows you to exclude from income up to $10,200 of unemployment compensation paid in 2020. This means you dont have to pay tax on unemployment compensation of up to $10,200 on your 2020 tax return only. If you are married, each spouse receiving unemployment compensation may exclude up to $10,200 of their unemployment compensation. Amounts over $10,200 for each individual are still taxable. If your modified AGI is $150,000 or more, you cant exclude any unemployment compensation. If you file Form 1040-NR, you cant exclude any unemployment compensation for your spouse.

The exclusion should be reported separately from your unemployment compensation. See the updated instructions and the Unemployment Compensation Exclusion Worksheet to figure your exclusion and the amount to enter on Schedule 1, line 8.

When figuring the following deductions or exclusions from income, if you are asked to enter an amount from Schedule 1, line 7 enter the total amount of unemployment compensation reported on line 7 and if you are asked to enter an amount from Schedule 1, line 8, enter the amount from line 3 of the Unemployment Compensation Exclusion Worksheet. For most states, you will receive Form 1099-G in the mail from your state unemployment office. Find out how you can obtain your 1099-G. On Form 1099-G:

  • In Box 1, you will see the total amount of unemployment benefits you received.
  • In Box 4, you will see the amount of federal income tax that was withheld.
  • In Box 11, you will see the amount of state income tax that was withheld.

You dont need to attach Form 1099-G to your Form 1040 or Form 1040-SR.

In certain states, you will not automatically be mailed a Form 1099-G. You will have to access your Form 1099-G online through your unemployment portal or call your state unemployment office to request that they mail your Form 1099-G. In other states, you will only be mailed a Form 1099-G if you selected that as your delivery preference.

Benefit paid on a UI claim are generally charged to the accounts of the claimant’s base-period employers. The most recent base-period employer is charged first with benefits paid until the wage credits are exhausted. Once wage credits are exhausted from the most recent base-period employer, charges go the next most recent employer and so on.

The base-period is a four quarter time frame using the first four of the last five completed calendar quarters at the time an initial UI claim is filed.     There are 3 options to pay your federal income taxes on your unemployment benefits. If you dont expect your benefits to add much to any tax you owe, it may be easiest to pay the full amount at tax time. The following options can help you avoid having a large bill at tax time.

    1. Request your state employment agency to withhold your federal taxes. Withholding your taxes means that a flat 10 percent of each of your unemployment checks will be used to pay federal taxes, similar to withholding taxes on a regular paycheck.

    Usually, you can choose to have your taxes withheld when you first register for unemployment benefits. You can also complete and give Form W-4V, Voluntary Withholding Request to the agency that is disbursing your unemployment benefits to start withholding your taxes. Request Form W-4V, Voluntary Withholding Request from your unemployment office or find it on the IRS website. If your agency has its own withholding form, use that one instead.

    Use the Estimated Tax Payments Calculator to make sure that you are withholding enough taxes from your unemployment benefits. If too little tax is withheld, you may also have to make quarterly estimated tax payments to avoid an underpayment penalty.

    Making Estimated Tax Payments

    You might be required to make payments directly to the IRS as quarterly estimated tax payments if you elect not to have taxes withheld from your unemployment benefits. This works out to a payment once every three months. You can elect to do this instead of having 10% withheld from every unemployment check, giving yourself a little bit of wiggle room when money is tight.

    You might even have to make quarterly payments in addition to withholding from your benefits. You’re obligated to make estimated payments if you expect that you’ll owe at least $1,000 after accounting for all taxes withheld from all your sources of income, and if you expect that your withheld taxes plus any refundable tax credits you’re eligible for will be less than 90% of what you’ll owe, or 100% of the total taxes you paid last year.
