You can file your first claim for New York unemployment benefits on the New York Department of Labor website. Youll need to make an NY.gov ID if you dont already have one and create a PIN. You can use your ID and PIN to sign in securely and complete your application. Alternatively, you can file over the phone by calling 1-888-209-8124 between 8 a.m. and 6 p.m.

Youll need to supply the following information to allow the Department of Labor to verify your eligibility:

In order to collect insurance benefits in New York, you have to be ready to work and willing to work. And you also have to be able to do some kind of work. When filling out your application, be sure to answer âYESâ if all of these stipulations apply to you. During the period of time that you are unemployed, you will need to certify that you are actively looking for work each week after you begin receiving benefits.

Applicants should file their claim within the first week after they become unemployed to begin receiving benefits within 2 to 3 weeks after their claim is processed. The claim will then be backdated to the date of your unemployment and youâll be paid all of the benefits that are owed to you dating back to this time. If you file late, youâll need to make a special request for compensation of the weeks that passed after your official date of unemployment.

Do You Meet The Minimum Earnings Requirement

Virtually all states look at your recent work history and earnings during a one-year base period to determine your eligibility for unemployment compensation. In New York, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you filed your claim in October of 2020, the base period would be from June 1, 2019, through May 31, 2020.

New York recognizes an alternate base period for those who cant meet the earnings requirements in the regular base period. The alternate base period is the last four completed quarters before the person files for unemployment. This alternate period takes more recent employment into account. Even filers who qualify using the regular base period can ask the agency to instead use the alternate base period to calculate their benefits, if that would result in a higher weekly amount.

Expanded Unemployment In New York During The Covid

On March 11, 2021, President Biden signed into law a $1.9 trillion COVID-19 relief bill known as the American Rescue Plan .

Under ARP, the $300 per week federal unemployment supplement is extended until September 6, 2021.

The law also extends two unemployment programs originally created by the CARES Act in March 2020: Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation .

Under the PUA program, self-employed workersusually excluded from unemployment benefitsare entitled to unemployment if they meet certain criteria. ARP makes PUA benefits available through Labor Day 2021, and increases the maximum duration of these benefits from 50 to 79 weeks.

The PEUC program provides for a federally-funded extension of benefits when state unemployment benefits expire. ARP increases the maximum duration of PEUC benefits from 24 to 53 weeks, with an expiry date of September 4, 2021.

How Will Your Benefits Be Calculated

Your weekly benefits will be calculated on the basis of how much you were being paid during a âBase Periodâ. According to the unemployment algorithm, your weekly benefits will be calculated using a Base Period along with the wages that you would earn if you worked for any length of time during one year or four calendar quarters . Your benefit rate is the weekly payment amount that youâll receive if you are indeed eligible to receive benefits.

There are two different ways to calculate the weekly unemployment payment: the Basic Base Period and the Alternate Base Period. If you did not have enough wages to calculate your benefits using the Basic Base Period, then the Alternate Base Period is used to determine the correct amount. Unemployment workers donât always check to see if the benefit rate would be higher using the Alternate Base Period to calculate the weekly payment, but if you believe that your benefit payment would be higher using the Alternate Base Period, you can request that it be used instead of the Basic Base Period to process your claim. Just be aware that if you opt to use the Alternate Base Period to calculate your weekly benefit rate, it could affect your ability to qualify for a future unemployment claim. In some cases, the Basic Base Period may be extended back up to two calendar quarters.

The state will completely reboot the system Thursday from 5:00 p.m. to 7:00 p.m. in an effort to restart the system with a smoother application process.

General Business

General business employers are liable on:

  • The first day of the calendar quarter you pay remuneration of $300 or more, – or –
  • The day you obtain any or all of the business of a liable employer

Non-Profit Employers

Non-profit employers are liable:

  • On the first day of the calendar quarter you pay remuneration of $1,000 or more, – or –
  • As of the first day of the calendar year you employ four or more workers on at least one day in each of 20 different weeks during that year or the prior calendar year

Household Employers

Employers of household help are liable the first day of any calendar quarter you pay remuneration of $500 or more.

Agricultural Employers

Effective January 1, 2020, employers of agricultural labor are liable as of:

  • The first day of any calendar quarter after January 1, 2020 in which you pay remuneration of $300 or more, – or –
  • The day you obtain any or all of the business of a liable employer
