Applying For Disability While Collecting Unemployment
With the Coronavirus having a giant impact on the American and world economy, many new people are applying for unemployment. According to the Washington Post, already 3.3 new Americans filed for unemployment benefits last week.
With no end in sight, nobody is quite sure the ultimate impact the Coronavirus will have on job losses or the Unemployment numbers. This economic volatility has led to questions from current or perspective clients regarding whether they are actually able to apply for Social Security Disability benefits while receiving Unemployment at the same time. That question and further analysis will be discussed below.
In short, YES you can apply for Social Security Disability benefits while also receiving Unemployment. Although there have been legislative proposals to ban the receipt of Unemployment while applying for Disability, none have been passed.
Although the short answer is YES, the long answer is that it can be problematic to receive Unemployment while applying for Disability. With Unemployment, you are telling the state government that you are ready, willing, and able to work on a full-time basis. With Disability, you are telling the federal government that you are unable to maintain full-time employment for a minimum of 12 months due to an impairment or combination of impairments.
Eligibility: Social Security Disability And Unemployment
The Social Security Administration does not explicitly deny Social Security Disability Insurance or Supplemental Security Income claims by those already receiving unemployment benefits. However, you can see by looking at the eligibility requirements why Social Security and unemployment claims often don’t mix:
- Unemployment: Must be ready, willing and able to work on a full-time basis
- Disability: Must be unable to work a full-time job for 12 months because of a disabling medical condition. If a person is expected to be unable to work for 12 months, this qualifies as well.
A 1999 U.S. Supreme Court case held that Social Security disability claims “did not inherently conflict” with other types of benefits. However, it is up to the claimant to prove that his eligibility for unemployment benefits is not in conflict with a disability claim.
What Are Employment Insurance Sickness Benefits

Giving Up On Edd Because They Are Difficult To Reach
It can be frustrating trying to contact the California Employment Development Department about State Disability Insurance or Paid Family Leave because EDD staff are often extremely busy and hard to reach, but it is important to keep trying, especially if you have questions about your application or what’s happening with your benefits. Tip: If you are contacting them by phone, the main English phone line is often busy, and you might want to call one of the non-English phone numbers — the people who answer those lines are knowledgeable about SDI and speak English in addition to the other language.Note: DB101 cannot answer questions about your SDI claim. Can I Receive Unemployment Compensation Benefits And Disability Benefits
After losing a job due to a disability, many people apply for and receive state unemployment compensation benefits. Unemployment compensation benefits provide temporary income to unemployed workers. In order to receive weekly unemployment compensation benefits, one must affirm, to the GA Department of Labor, that he or she is actively seeking employment and is available for work. Each state has different requirements to collect unemployment compensation benefits.
Receiving unemployment compensation benefits can have an effect on your social security disability claim. But, you cannot be denied social security disability benefits only because you received unemployment compensation benefits. The Supreme Court held that a claim for social security disability benefits is often consistent with a claim for relief under the Americans with Disabilities Act. The Supreme Court reasoned as follows:

Can You Get Unemployment And Disability At The Same Time
As the end of their unemployment benefits nears and debate over unemployment extensions continues, some people may wonder if other options are available. Also, because the application process for Social Security Disability Insurance benefits can take many months, some people ask whether it is possible to get unemployment benefits and apply for or receive SSDI benefits at the same time.
In short, the answer is yes. However, an apparent contradiction exists in applying for or receiving both unemployment benefits and SSDI benefits concurrently because, to qualify for unemployment benefits, a person must be seeking work, while to qualify for SSDI benefits, an applicant must usually prove that he or she is not able to work.
Exceptions exist, though, for people who attempted to re-enter the workforce through the Social Security Administrations Ticket to Work Program or for people who previously worked full time but now have verifiable medical restrictions that require them to work only part time.

What Disability Judges Think About Collecting Unemployment
Disability judges usually know when youre collecting unemployment benefits because Social Security has access to unemployment benefit information and usually includes it in your claims file. Some judges do not like to see that disability applicants are collecting unemployment benefits no matter what the circumstance. Other judges will deny your disability claim only if you received unemployment after you applied for disability benefits, unless you can prove your condition medically worsened since you applied for unemployment benefits. Other judges simply will not pay you disability benefits for the time period that you were receiving unemployment . Still others dont care even if youre receiving unemployment benefits at the time of your hearing. These judges realize that people need income to live on, and that there is no guarantee that disability benefits will be granted after the long process of applying for benefits.
In addition, in many states, you can collect unemployment even if you are ony looking for part-time work. Disability applicants are allowed to work a limited amount of time, and in these states, you are you are not necessarily telling the employment department that you are available to work full time.

Applying For Disability While Receiving Unemployment
One of the most commonly asked questions among those who are out of work and disabled is whether or not they can receive both unemployment benefits and Social Security disability benefits. While there is not a specific regulation with the Social Security Administration regarding receiving unemployment benefits while applying for Social Security disability benefits, its generally not a good idea.
Social Security disability benefits are overseen by the SSA, a department of the federal government. Unemployment benefits, while they are mandated by federal law, are overseen by state governments. The laws regarding unemployment benefits and who can receive them vary from state to state.
Most states require a person to be available for full time work and capable of performing full time work in order to qualify for unemployment benefits. Typically, before you can be approved for unemployment benefits, you will need to attest that you are capable of working full time.
The problem becomes readily apparent to most. Obviously, you cant be ready, willing, and able to accept full time work and completely unable to perform any work for which you are qualified due to a disability at the same time. Making conflicting claims like this is unlikely to gain you disability benefits. If anything, you might lose your unemployment benefits and face legal trouble and the possibility of having to reimburse the government what it has paid you.

Can I Collect Disability Insurance Benefits If I Am Collecting Unemployment Benefits
It is challenging for a disabled claimant to obtain either short or long term disability benefits when they are receiving or have received unemployment benefits. It is not impossible to get STD or LTD benefits, but a claimant would be much better off not seeking unemployment. One of the criteria to be eligible for unemployment benefits is that the employee must be able to work, available to work and actively seeking work. In a situation where a person has an own occupation policy, then it could be possible to receive unemployment and disability benefits. The other important reason to not seek unemployment is that in most ERISA / GROUP disability policies, any unemployment benefits received will offset any disability benefits which are owed.
Fraudulent Disability Claim Or Unemployment Claim
Government agencies like the Department of Labor, the Social Security Administration, and state unemployment agencies watch for potentially fraudulent behavior.
For example, unemployment beneficiaries may be asked if they are actively seeking work, but also be asked if they have filed a disability claim. Personnel reviewing an unemployment application claim may red flag someone who says they have filed for disability. If the agency determines that the individual has received benefits in error, the individual typically has to repay the benefits.
