Generally, you can set up withholding when you file for unemployment, just the same way you would set up withholding from your paycheck when you start a new job. That way, you dont ever see the money, and you dont have to worry about coming up with the cash when tax time arrives.

However, 2020 was different. One of the provisions of the American Rescue Plan, enacted on March 11, 2021 to help stimulate the economy after the COVID-19-induced economic disruption, excluded federal income taxes on unemployment insurance benefits paid out in 2020. That includes all the various extended unemployment insurance packages that Congress passed to help people whod lost their jobs due to COVID-19, such as the Pandemic Unemployment Assistance , Pandemic Emergency Unemployment Compensation , or Extended Benefits , .

Whats more, if your spouse also received unemployment insurance benefits, they were eligible for the $10,200 exclusion as well, according to the Internal Revenue Service .

There were a couple of provisos. If your adjusted gross income for 2020 was over $150,000, the unemployment insurance tax exclusion didnt apply. And you and your spouse, if you have one, did need to pay taxes on your unemployment benefits for amounts over $10,200.

Do not include your Social Security number in an email. Email may not be secure. Instead, you should use your Customer Identification Number or claim ID.

Special Rule For Unemployment Compensation Received In Tax Year 2020 Only

The American Rescue Plan Act of 2021 authorizes individual taxpayers to exclude up to $10,200 of unemployment compensation they received in tax year 2020 only. In the case of married individuals filing a joint Form 1040 or 1040-SR, this exclusion is up to $10,200 per spouse. To qualify for this exclusion, your tax year 2020 adjusted gross income must be less than $150,000. This threshold applies to all filing statuses and it doesn’t double to $300,000 if you were married and file a joint return. Any unemployment compensation in excess of $10,200 is taxable income that must be included on your 2020 tax return.

Unemployment Taxes At The State Level

If you live in a state that has a state income tax, you may need to pay state income taxes on your unemployment benefits in addition to federal income taxes.

For states that dont have a state income tax or dont consider unemployment benefits taxable income, you wont need to pay state income taxes on your unemployment benefits. These are 17 states that dont tax unemployment benefits:

States that dont have any income taxes Alaska, Florida, Nevada, South Dakota, Texas, Washington, and Wyoming
States that only have income taxes for investment income New Hampshire and Tennessee

Already Filed A Tax Year 2020 Tax Return

In most cases, if you already filed a 2020 tax return that includes the full amount of your unemployment compensation, the IRS will automatically determine the correct taxable amount of unemployment compensation and the correct tax. If you paid more than the correct tax amount, the IRS will either refund the overpayment or apply it to other outstanding taxes owed or other debts. The IRS began performing the corrections starting in May 2021 and continues to review tax year 2020 returns and process corrections to issue any applicable refund that is due. If the exclusion of unemployment compensation now qualifies you for deductions or credits not claimed on your original return, you should file an amended return. For example, if you did not claim the Earned Income Tax Credit on your originally filed return because your AGI was too high, and the special exclusion allowed for unemployment compensation received in tax year 2020 reduced your AGI, you should file an amended return to claim the EITC if now eligible.

Exception: If you have qualifying children and received a CP08 or CP09 notice stating you may be eligible for the Additional Child Tax Credit or Earned Income Tax Credit, you do not need to file an amended return. Instead, you can simply respond to the notice if you are eligible for the credit.

Options For Paying Taxes

States that offer to withhold taxes can only do so at a flat, fixed rate of 10 percent according to federal law. This could be just a drop in the bucket if your top tax bracket for the year is 22 percent. You could still end up owing the IRS at tax time if you only had 10 percent withheld from your benefits.

You can avoid this by calculating the top tax rate you would have to pay, such as 22 percent of your benefits, and paying this amount to the IRS quarterly as estimated tax payments. The estimated quarterly tax dates are April 15 for income earned from Jan. 1 through March 31, then June 15 for income earned between April 1 and May 31, Sept. 15 for income earned June 1 through Aug. 31, and Jan. 15 of the following year for income earned from Sept. 1 through Dec. 31.

Some May Qualify For Tax Credits Now

The IRS has stressed that taxpayers shouldnt file an amended return unless the calculations make the taxpayer newly eligible for additional federal credits and deductions not already included on the original tax return.

The IRS, for instance, can adjust returns for taxpayers who claimed the EITC. Because the exclusion changed the income level, those people may now be eligible for an increase in the EITC amount which may result in a larger refund.

Taxpayers, however, would have to file an amended return if they didnt originally claim the EITC or other credits but now are eligible because the exclusion changed their income. These taxpayers should review their state returns as well, tax experts say.

Others may qualify for the American Opportunity Tax Credit, which is a credit for qualified education expenses paid for an eligible student for the first four years of higher education.

Requesting A Duplicate 1099

If you do not receive your Form 1099-G by February 1, and you received unemployment benefits during the prior calendar year, you may request a duplicate 1099-G form by phone:

  • Call Tele-Serv at 800-558-8321.
  • Select option 2 and follow the prompts.
  • We cannot process requests for duplicate 1099-G forms until after February 1 because throughout January we are still mailing the original forms.

    You do not need a paper copy of Form 1099-G to file your federal tax return the IRS only needs the total amount of benefits TWC paid you during the previous calendar year and the amount of taxes withheld.

    When Will I Get The Refund

    Unemployment tax refunds started landing in bank accounts in May and ran through the summer, as the IRS processed the returns.

    The first phase included the simplest returns, made by single taxpayers who didn’t claim for children or any refundable tax credits.

    More complicated ones took longer to process.

    In mid-July, the IRS issued 4million refunds, of which those by direct deposit landed in bank accounts from July 14.

    Meanwhile, households who receive the cash refund by paper check could expect this from July 16.

    Another batch of payments were then sent out at the end of July, with direct deposits on July 28 and paper checks on July 30.

    The IRS didn’t announce payouts in August, September nor October – but on November 1, it noted another 430,000 refunds had been paid out.

    These refunds were worth a collective $551million.

    The IRS also said it’ll issue another refund batch before the end of the year, but as of December 30, it’s yet to confirm when and how many it applies to you.

    It comes as Erin Collins, of the independent Taxpayer Advocate Service within the IRS, in September revealed that 13million accounts had been processed so far.

    She added that there were still about 436,000 returns yet to be processed, as they were waiting in the Error Resolution System as of September 11.

    This mean they had to be manually reviewed by the IRS, after which the refund was either released or the error confirmed.
