Unemployment insurance provides periodic payments to eligible workers who are unemployed through no fault of their own and are looking for work. Although it varies from state to state, the base period generally covers the past year to 18 months of work.

To be eligible for unemployment insurance , immigrant workers must satisfy the same basic requirements as other workers. First, they must be unemployed through no fault of their own. Second, they must have enough wages earned or hours worked in their base period to establish a claim. Third, they must be able and available to work.

I Am About To Exhaust My Regular Unemployment Compensation Benefits What Kinds Of Relief Does The Cares Act Provide For Me

Under the CARES Act states are permitted to extend unemployment benefits by up to 13 weeks under the new Pandemic Emergency Unemployment Compensation program. PEUC benefits are available for weeks of unemployment beginning after your state implements the new program and ending with weeks of unemployment ending on or before December 31, 2020. The program covers most individuals who have exhausted all rights to regular unemployment compensation under state or federal law and who are able to work, available for work, and actively seeking work as defined by state law. Importantly, the CARES Act gives states flexibility in determining whether you are actively seeking work if you are unable to search for work because of COVID-19, including because of illness, quarantine, or movement restrictions.

In addition, if you have exhausted the 13 weeks of additional benefits available under the PEUC program, you may be eligible to continue receiving benefits under the PUA program. PUA benefits are available for a period of unemployment of up to 39 weeks, meaning that if you have exhausted regular UC and PEUC benefits in fewer than 39 weeks, you may be eligible to receive assistance under PUA for the remaining weeks within PUAs 39 week period.

The Structure And Goals Of The Ui System

UI is a joint federal-state system that features extensive state flexibility. As Franklin D. Roosevelts Committee on Economic Security, which provided the basic blueprint for what would become the Social Security Act, stated, The States shall have broad freedom to set up the type of unemployment compensation they wish.

Federal requirements for state UI systems are minimal and are designed to ensure both that UI provides a basic level of protection for eligible workers and that the program serves as a macroeconomic stabilizer in times of economic weakness. Federal law defines unemployment compensation as cash benefits payable to individuals with respect to their unemployment and lays out a few basic requirements, principally the following two:

  • all money withdrawn from the unemployment fund of the State shall be used solely in the payment of unemployment compensation and
  • states cannot impose excessively burdensome methods of administration that block access for otherwise eligible individuals.

These requirements ensure that states maintain programs that offer a basic level of protection to workers with a sufficient employment record and who lose their jobs through no fault of their own. Within these basic protections, states are free to choose and adjust employer tax rates, benefit levels and duration, and eligibility criteria, such as the extent and duration of prior employment necessary to qualify for benefits.

Not every person who is out of work is eligible for unemployment benefits. Unemployment benefits are intended as a temporary wage replacement for those who are out of work, through no fault of their own, until they find a new job.

Unemployment insurance is a joint program of the federal and state governments. State law determines who is eligible for benefits, how much they will receive, and for how long.

  • The unemployment insurance system pays temporary assistance to eligible individuals who are unemployed through no fault of their own. Not everyone who applies for unemployment benefits will qualify. Certain conditions must be met in order to meet initial eligibility requirements and to remain eligible to receive benefits. Individuals pay no part of the costs of unemployment benefits. Employers pay the full cost of unemployment benefits.

Filing your claim will go faster if you have the following important documents before you begin.

Irs Says It Sent 12 Million Refunds Averaging $1232 A Pop

The IRS said it recently finished correcting tax returns filed for 2020 that included overpayments for unemployment benefits that workers received that year. The tax agency said it has issued 12 million tax refunds as a result.

The average tax refund is $1,232, with the agency sending a total of $14.8 billion back to taxpayers, the IRS said on Friday. Taxpayers were sent letters from the IRS to inform them about the fixes to their 2020 tax filings, it added.

The tax review came about due to the American Rescue Plan Act of 2021, which was signed into law by President Joe Biden in March 2021. The legislation excluded up to $10,200 in 2020 unemployment aid from being counted as taxable income, but some taxpayers had already filed their returns in early 2021 before the law became effective.

Because of that, the IRS reviewed returns filed by workers who reported jobless aid as income in 2020 but who filed their forms before the law was enacted. Unemployment aid is typically considered taxable income.

“Some taxpayers received refunds, while others had the overpayment applied to taxes due or other debts,” the IRS said on Friday. “In some cases, the exclusion only resulted in a reduction in their adjusted gross income.”

I Was Furloughed By My Employer But They Have Now Reopened And Asked Me To Return To My Job Can I Remain On Unemployment

No. As a general matter, individuals receiving regular unemployment compensation must act upon any referral to suitable employment and must accept any offer of suitable employment. Barring unusual circumstances, a request that a furloughed employee return to his or her job very likely constitutes an offer of suitable employment that the employee must accept.

While eligibility for PUA does not turn on whether an individual is actively seeking work, it does require that the individual be unemployed, partially employed, or unable or unavailable to work due to certain circumstances that are a direct result of COVID-19 or the COVID-19 public health emergency. In the situation outlined here, an employee who had been furloughed because his or her employer has closed the place of employment would potentially be eligible for PUA while the employer remained closed, assuming the closure was a direct result of the COVID-19 public health emergency and other qualifying conditions are satisfied. However, as soon as the business reopens and the employee is recalled for work, as in the example above, eligibility for PUA would cease unless the individual could identify some other qualifying circumstance outlined in the CARES Act.

    Federal Pandemic Unemployment Compensation

Illinois struggling unemployment program to run out of money in May

The Federal Pandemic Unemployment Compensation provided an extra weekly benefit on top of regular unemployment insurance .

The original benefit provided an additional $600 weekly under the CARES Act, but that benefit expired on July 31, 2020. The FPUC was modified and extended as part of the Consolidated Appropriations Act in December 2020. Unemployed individuals receive an additional $300 per week in benefits beginning after Dec. 26, 2020.

Another extension of the FPUC was approved after President Joe Biden signed the $1.9 trillion American Rescue Plan Act of 2021 on March 11, 2021. Under the plan, FPUC benefits expired on Sept. 6, 2021.

Keep in mind that the FPUC benefit was not payable during the gap from July 31, 2020, to Dec. 26, 2020. In other words, the $600 in extra money added to unemployment benefits ended on July 31, 2020. This means the $300 didnt kick in until after Dec. 26, 2020.

Although FPUC payments ended on Sept. 6, 2021, eligible claimants will continue to receive regular unemployment compensation from their state if they are eligible. According to the U.S. Department of Labor, regular unemployment benefits currently replace about 38% of a workers wages, on average.

When Can Newly Eligible Workers Start Filing For Unemployment

While the CARES Act makes these federal funds available to unemployed workers, states still have to individually sign on to the agreement and set up the infrastructure to accept new unemployment claims and pay out increased unemployment benefits.

“What happens now is the U.S. Department of Labor has to issue guidance for states on how to set up these Pandemic Unemployment Assistance benefits,” says Michele Evermore, senior researcher and policy analyst at the National Employment Law Project. That said, “I can’t imaging a state not wanting to enter into an agreement with federal agency to get these benefits out.”

Evermore adds it generally takes two to three weeks once someone has applied to actually get approved and start receiving payment. However, given the surge in unemployment claims, “I’d imagine it taking at least three to four weeks now,” she tells CNBC Make It. “Some states may surprise us and get benefits out the door before that.”

New York’s Department of Labor website already has instructions for newly eligible workers to get organized and file for Pandemic Unemployment Assistance once it becomes available. This week, Michigan Gov. Gretchen Whitmer signed on to create new state assistance programs under the CARESAct guidance around new eligibility and increased benefits will be announced “in the coming days.”

After you file for unemployment, the state may accept your claim, and youll receive your benefits. But what if youre denied benefits or the state asks you to provide additional information? You can file an unemployment appeal and explain your situation in a hearing.

The state unemployment office will typically send you a letter that will list the date and time of your hearing. These hearings are generally conducted over the phone.

What If You Can’t Get Through To File A Claim

Where’s The Money: Could there be a fourth stimulus check?

Many state labor department offices have been overwhelmed with activity in recent weeks, resulting in site crashes and long waiting times to contact someone by phone. To avoid overwhelming websites and phone lines, some states are advising workers file a claim on a certain day of the week based on the first letter of their last name.

When workers do get through, benefits payments will be applied retroactively to workers who have lost their job due to the pandemic as far back as January 27, 2020.

The additional $600 weekly benefit will also be back-dated to March 27.

Ultimately, Evermore’s guidance is to remain persistent.

“These benefits aren’t going to be out tomorrow,” she says. “Just like we were standing in line for toilet paper last week, this week people are going to have to wait to get their benefits filed. My advice is to be patient and keep trying.”

Expanded unemployment assistance under the CARES Act is effective through December 2020.

    Requirements For Unemployment Insurance

An unemployed person must meet two primary requirements to qualify for unemployment insurance benefits. An unemployed individual must meet state-mandated thresholds for either earned wages or time worked in a stated base period. The state must also determine that the eligible person is unemployed through no fault of their own. A person may file an unemployment insurance claim when fulfilling these two requirements.

Individuals file claims in the state where they work. A participant may file claims by phone or on the state unemployment insurance agencys website. After the first application, it generally takes two to three weeks for the processing and approval of a claim.

After approval of a claim, the participant must either file weekly or biweekly reports that test or confirm their employment situation. Reports must be submitted to remain eligible for benefit payments. An unemployed worker cannot refuse work during a week, and on each weekly or biweekly claim, they must report any income that they earned from freelance or consulting gigs.
