WILMINGTON, N.C. – Gov. Roy Cooper issued an Executive Order Tuesday in response to the coronavirus pandemic that limits bars and restaurants to takeout and delivery orders only. No one is allowed to eat inside these establishments.

Many people in the service and hospitality industries, among others, have lost their jobs during this tumultuous time.

The reality is, people will be losing jobs and businesses have lost customers, Governor Cooper said.

That being said, Coopers executive order does the following:

    • removes the one-week waiting period to apply for unemployment benefits for those workers who lose their jobs
    • removes the requirement that a person must look for another job during this time when so many potential employers are closed and social distancing guidelines are in effect
    • allows employees who lose their jobs or, in certain cases have their hours reduced due to COVID-19 issues, to apply for unemployment benefits
    • waives the requirement that part of the application process be in person
    • directs that these unemployment losses wont be counted against employers

Do I Have To Look For A Job To Get North Carolina Unemployment Benefits

One of the requirements for collecting benefits is that recipients must conduct an active and ongoing job search each week. Claimants must contact at least five potential employers during the week. Failure to make at least five contacts in a week could result in your benefits being denied or delayed for that week.

The DES has the right to check your work search records for up to five years after you claim benefits, so not only should you keep an accurate log of your work search records every week you are claiming benefits, you will need to keep those records for that five year period. If you have questions about how to maintain these records, you can visit one of several North Carolina unemployment office locations.

Most job hunters are able to find new work before their benefits run out. In some cases, such as high North Carolina unemployment rates, you may contact the unemployment department to inquire about filing an extension.

You will need to keep a detailed record of your work search activities, providing the following information:

    • Employers name.
    • Job position you inquired about or applied for.
    • Contact information for the employer, including URL address of their website, an email address, telephone number and/or their physical address.
    • The date you applied for the job or made contact with the employer.
    • Confirmation information that may include the name and job title of the employer you contacted or an email or confirmation number.

    DES: Unemployment Benefits Data

If you are wondering, What can I do if unemployment denied my first appeal? the NC DES provides an option to submit a second-level appeal. After an initial appeal hearing with the North Carolina Appeals Section, you will receive a written decision stating whether your appeal has been granted or not. If you lose your appeal with the Appeals Section, you can file a level-two appeal within 10 days of receiving the decision letter. A second-level appeal will grant you a hearing with the Board of Review. During a hearing with the Board of Review, claimants will not be able to present additional evidence supporting their case. Once the Board of Review has reviewed your second appeal disputing the denied unemployment benefits, its members will issue a written decision, which is referred to as a Higher Authority Decision. If you disagree with the decision the board has made, you may file a follow-up appeal with the North Carolina Superior Court.

    Expired Federal Pandemic Unemployment Programs

However, these federal programs ended on September 6, 2021. In some states, they ended even earlier: About half the states decided to stop participating in these programs before they expired.

For weeks of unemployment beginning on or after September 6, 2021, these benefits will no longer be available. That means:

    • Benefits will no longer be available to the millions of gig workers, contractors, and freelancers who were receiving unemployment through the Pandemic Unemployment Assistance program.
    • Benefits will no longer be available through the Pandemic Emergency Unemployment Compensation program, which offered additional benefits to those who were still unemployed when they used up their state benefits.
    • Benefits will be reduced for those who were receiving Pandemic Unemployment Compensation, a program that offered $300 extra per week to those collecting unemployment.

All told, experts estimate that more than seven million people lost their benefits on Labor Day, 2021. More than two million more saw their benefits cut by $300 per week.

In North Carolina, the minimum benefit is $15 per week, and the maximum benefit is $350 per week.
