EI sickness benefits are payable only to those people who are unable to work because of sickness, injury or quarantine but who would otherwise be available for work if not for their incapacity due to medical reasons. However, even if you qualify for an exemption for a disability or a deeply held religious belief, an employer could still have a defense against paying unemployment “if it can show that accommodating a religious view would be an undue hardship,” Professor Kohler said.
Also, once it’s been established that vaccine mandates are a reasonable policy, and that the employee refused to comply with that policy, “the employee would have the burden of establishing that he or she was justified in noncompliance,” Rushovich said.
What Other Legal Issues Are At Play
The other critical question lawyers are confronting is whether employer-mandated vaccinations are considered a “reasonable policy” in the first place. “I think most of the time you’re going to find that the policies are deemed reasonable because of the amount of scientific literature suggesting that vaccines are safe,” said Eliot Rushovich, managing partner at Rise Law Firm in Los Angeles.
“I can’t see the government mandating the vaccines and then saying you have to terminate these people, but you’re also liable for paying unemployment insurance benefits,” said Darren Rumack, a partner at the Klein Law Group in New York City.

Im Partially Employed Because Im A Student And Work Part Time Doing Ride
You may be eligible for PUA, depending on your personal circumstances. A gig economy worker, such as a driver for a ride-sharing service, is eligible for PUA provided that he or she is unemployed, partially employed, or unable or unavailable to work for one or more of the qualifying reasons provided for by the CARES Act. For example, a driver for a ride-sharing service may be forced to quit his or her job if he or she was diagnosed with COVID-19 by a qualified medical professional, and although the driver no longer has COVID-19, the illness caused health complications that render the driver objectively unable to perform his or her essential job functions, with or without a reasonable accommodation. Similarly, under an additional eligibility criterion established by the Secretary of Labor pursuant to 2102, a driver who receives an IRS Form 1099 from the ride-sharing service may qualify for PUA benefits if he or she has been forced to suspend operations as a direct result of the COVID-19 public health emergency, such as if an emergency state or municipal order restricting movement makes continued operations unsustainable. Relatedly, widespread social distancing undertaken in response to guidance from federal, state, or local governments may so severely reduce customer demand for a drivers services as to force him or her to suspend operations, and thus make the driver eligible for PUA.
How To Apply For Unemployment Insurance
To apply for UI, you must follow your state’s guidelines, which you can link to via the DOL website, CareerOneStop. Depending on the state, you can file a claim in person, online, or over the phone. When you file a claim, you must provide your Social Security number, contact information, and details about your former employment.
In the case of the pandemic, there are several reasons due to COVID-19 that qualify you for unemployment, outside of regular unemployment criteria. These include:
- Having to leave your job because you or a member of your family has contracted COVID-19
- Having to provide childcare because your child’s school is closed due to COVID-19
- Resigning for a good cause like unsafe work conditions or because you are denied accommodations to work from home, in the case that you have a family member with an increased risk of death or serious illness if they contract COVID-19
You cannot claim pandemic benefits if you resign or are allowed to work from home and simply don’t want to.
