Information Needed For Your Federal Income Tax Return

Each January, we mail an IRS Form 1099-G to individuals we paid unemployment benefits during the prior calendar year. The 1099-G form provides information you need to report your benefits. Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS. You can file your federal tax return without a 1099-G form, as explained below in Filing Your Return Without Your 1099-G.

A 1099-G form is a federal tax form that lists the total amount of benefits TWC paid you, including:

  • Unemployment benefits
  • Federal income tax withheld from unemployment benefits, if any
  • Alternative Trade Adjustment Assistance and Reemployment Trade Adjustment Assistance payments

How To Get Another W

The Internal Revenue Service Form W-2 is the wage and tax statement you receive from your employer at the end of the year. This form is sent to the employee, federal, state and local governments.

The deadline for your employer to send your W-2 form to you is January 31. Allow a few extra days for it to reach you in the mail.

The W-2 form will show your annual earnings, taxable fringe benefits, income taxes withheld, 401 contributions and other vital tax information.

If you do not receive Form W-2 by early February or misplace it before filing your tax return, the first thing to do is ask your employer for another copy. There may be a fee for this, especially if your employer uses a payroll tax service.

Some employers have their Form W-2s posted on a secure webpage accessible on the internet. If this is the case in your situation, you can log onto the website and print another copy of your W-2.

We will mail a paper copy of your 1099-G to the address we had on file for you on December 31, 2021.

We will start to mail out 1099-Gs in mid-January and will complete all mailings by January 31, 2022.

It is too late to change your address for the 1099-G mailing, but you can access your 1099-G online.

Q: How do I access the 1099-G tax form if I am the representative of a deceased claimant?

A: For the New York State Department of Labor to provide you with information belonging to a deceased unemployment insurance claimant, you must first show that you are legally authorized to receive this information. Authorization often comes from the New York State Surrogate Court, and may be one of the following:

If the deceased claimant had no assets, or all property owned by the deceased claimant was owned in common with someone else, then no Executor or Administrator may have been appointed. The representative of the deceased claimant must provide proof that they are authorized to obtain the information. In this case, a surviving spouse should provide NYS DOL with:

    1099-G forms will be sent via United States Postal Service. 1099-G forms cannot be sent by email, fax or any other electronic method. 1099-G forms are mailed to the address on record as of January 1, 2022. The USPS will not forward 1099-G tax forms unless it has a change of address on file.

    • PUA Claimants: If you filed for benefits in PUA, your 1099-G has been mailed to you. The Department is also currently working to upload 1099-G forms for PUA claimants to the PUA online portal. We will notify you as soon as PUA 1099-G forms are available online..
    • If you filed in the regular unemployment insurance system, we are unable to upload your 1099-G to your online claimant portal due to system limitations.

    Taxes On Unemployment Benefits

    2011 Form W

    All benefits are considered gross income for federal income tax purposes. This includes benefits paid under the federal CARES Act, Federal Pandemic Unemployment Compensation , state Extended Benefits , Trade Adjustment Assistance , Pandemic Unemployment Assistance , Pandemic Emergency Unemployment Compensation , and Lost Wages Assistance . DES reports these benefits to the Internal Revenue Service for the calendar year in which the benefits were paid.

    You may choose to have federal income tax withheld from your unemployment benefit payments at the rate of 10% of your gross weekly benefit rate , plus the allowance for dependents .

    The amount deducted for state income tax will be 10% of the amount deducted for federal taxes, which is currently calculated as 1% of the gross weekly benefit amount. Please Note: State income tax cannot be withheld from the $300 additional weekly benefit in Lost Wages Assistance and the $600 additional weekly FPUC benefit for regular UI claims. Claimants who received FPUC and/or LWA in regular UI will be responsible for paying any tax due on those amounts when filing state income taxes for calendar year 2020.
